County of Baldwin
The City Council of the City of Fairhope met in regular session
at the City Hall, Monday, June 8, 1953 with the following
members present: Mayor T. J. Klumpp, Councilmen M. 0, Berglin,
L. E. Blatchford, R. C. Macon, J. D. Mason and E. B. Overton.
The minutes of the previous regular meeting were read'and
approved as read.
Motion by Councilman Berglin seconded by Councilman Mason that
the City have test run of Mobile Bay water over a period of
five or six weeks. Motion carried.
Motion by Councilman Mason seconded by Councilman Blatchford
that the following Resolution be adoptad: Motion carried.
WHEREAS, the adverse publicity resulting from the
pollution of the western waters of Mobile Bay is causing
serious injury and harm to the whole Mobile Bay area
AND WHEREAS, the Eastern Shore including Fairhope,
in in danger of pollution emanating from the western side
of Mobile Bay and/or upstream rivers, but such pollution
poses a serious threat to the Eastern Shore area, unless
comprehensive remedial measures are taken
NOW THEREFORE BE IT RESOLVED that the Fairhope City
Council go on record this 8th day of June as:
1. Urging the City of Mobile to do all possible to
speed its program to install adequate sewago treatment plants
to stop pollution of public waters by that municipality.
2. Petitioning the Alabama'Legislature now in session to
adopt adequate anti -pollution legislation with a long range
view of cleaning up the waters of this State and keeping them
clean in the future.
3. BE IT FURTHER RESOLVED that copies of this resolution
be given the local press, the newspapers of Mobile and be
sent immediately to the proper legislative committees studying
the pollution problem.
Motion by Councilman Macon seconded by Councilman Berglin
that the City donate $300.00 to the Fairhope Youth Council.
Motion carried.
Motion by Council'Macon seconded by Councilman Overton
that the City give Quit -Claim Deed to Mr. P. A. Frederick
for the following described property:
That portion of Railroad Avenue running southeastwardly
from the south line of Rosa Avenue to the Southwest
corner of Lot 15, Block 229 being according to map
of Volanta as per plat therof recorded in the Probate
R-'cords of Baldwin County, Alabama, in miscellaneous
Book One, Page 341, and being further described as
being bounded on the north by the south line of said
Rosa Avenue, on the northeast by Block 22 as shown on
said Map of Volanta, on the south by a westwardly
continuation of the south line of said Block 22 to
Block 23 on said Map of Volanta and on the southwest by
said Block 23; being located in the City of Fairhope,
Alabama;
The consideration for this deed is an exchange of the above
lands for more suitable lands for street purposes and a relocation
of the street. Motion carried. /
Motion by Councilman Blatchford seconded by Councilman Berglin
that the application of Dale Radcliff to install awning at
Dale's on Fairhope Avenue be approved. Motion carried.
Motion by Councilman Mason seconded by Councilman Blatch-
ford that the application of Kenneth Cain to hang sign be
approved. Motion carried.
Motion by Councilman Blatchford seconded by Councilman Berglin
that the building permit of Standard Oil Co. be approved as
submitted. Motion carried.
Motion by Councilman Blatchford seconded by Councilman Mason
that the Mayor appoint a Park Committee consisting of seven
members to study the parks and beaches in Fairhope and report
to the City Council; members of this Committee to become the
Fairhope Park Board when and if such a Board is organized.
Motion carried.
The Mayor appointed the following to the Park Committee;
Mr. L. E. Blatchford, Chairman, Mr. M. Dyson, Rev. Lyle Mueller,
Mr. C. 0. Jacobson, Mrs. Harry Peters, Jr., Mrs. Clark Taylor
and Mr. Byrd Moore.
Motion by Councilman Overton seconded by Councilman Berglin

This being the date set for final consideration of Ordinance
#220 introduced at a previous meeting the Ordinance was called
up for consideration and having been read in full Councilman
Macon moved its final adoption which motion having been second-
ed by Councilman Blatchford the Ordinance wasput on its final
passage and on roll call was adopted with the following vote:
Voting Yea, Councilman Berglin, Blatchford, Macon, Mason and
Overton. Voting Nay; None. The mayor thereupon declared the
Ordinance adopted and signed the same in approval thereof,
Ordinance #220 being as follows:
ORDINANCE #220
AN ORDINANCE TO PROVIDE FOR THE ESTABLISHEMTN AND MAINTENANCE
OF A MUNICIPAL PLANNING COMMISSION FOR THE CITY OF FAIRHOPE,
ALABAMA AND TO PRESCRIBE ITS POWERS AND AUTHORITY.
BE IT ORDAINED by the Mayor and City Council of the City
of Fairhope, Alabama, as follows:
SECTION 1. Pursuant to Act. No. 534, H. 992, approved
September 14, 1935 (General Acts 1935, P• 1126, Alabama Code
of 1940, Section 7A6 et seq), there is hereby created a Plann-
ing Commission for the City of Fairhope, Alabama, to consist
of nine members, to be appointed for the terms and in the
manner set forth in said Act.
SECTION 2. The said Commission is authorized and empowered
to make and adopt a master plan for the physical development
of the said City of Fairhope, Alabama, including any areas
outside its boundaries which, in zxmk the Commission's judg-
ment, bear relation to the planning of such municipality. Such
plan, with the accompanying maps, plats, charts and descriptii7e
matter, shall show the Commission's recommendations for the
development of said territigry, including among other things
the general location, character, and extent of streets, via-
ducts, subways, bridges, waterways, waterfronts, boulevards,
parkways; playgrounds, squares, parks, a4tation fields, and
other public ways, grounds and open spaces, the general location
of public buildings and other public property, and the general
location and extent of public utilities and terminals, whether
publicly or privately owned or operated, for water, light,
sanitation, transportation, communication, power, and other
purposes; also the removal, relocation, widening, narrowing,
vacating, abandonment, change of use or extension of any of the
foregoing ways, grounds, open spaces, buildings, property,
utilities, or terminals; as well as a zoning plan for the control
of the height, area, bulk, location and use of the bdildings
and premises. As the work of making the whole master plan
progresses, said Commission may from time to time adopt and
publish a part or parts thereof, any such part to cover one
or more major sections or divisions of the municipality, or
one or more of the aforesaid or other functional matters to be
included in the said plan. The said Commission is hereby
authorized and empowered to exercise all powers and do all
things authorized to such Commission by said Act 534 as it may
deem necessary for its work. The said Commission is also author-
ized and empowered to exercise all powers and to do all things
authorized to such Commission -by the said Act, and to exercise
such control as is authorized under the aforementioned Act 534
with reference to subdivision of unimproved property within
five miles of the corporate limits of the City of Fairhope,
Alabama.
SECTION . The Mayor and City Council of Fairhope are
hereby authorized to make all appointments andexercise all
authority as authorized by the said Act.
SECTION 4.. This ordinance shall take effect from and after
the date of its passage, but the same shall, nevertheless, be
published as required by law.
