Fairhope, of its meeting held on the 6th day of October, 19;2,-
bein- the first Monday in October, the same being the organization-
al meeting of the said council held at the City Hall in the City
of Fairhope, at 7:30 of lock, P.M. Present at said meeting

councilmen at the regular general election held September 15,
1952, being the third Monday in said month, each of whom took
and subscribed to the oath of office in woards and figures as
follows:
I, , duly elected ,
of the City of Fairhope, do solemnly swear that I will
support the constitution of the United States, and tre con-
stitution of the State of Alabama, so long as I continue a
citizen thereof; and that I will faithfully and honestly
discharbe the duties of the office upon which I am about to
enter, to the best of my ability. So help me God.

And the said mayor and City Council having been duly elected
and qualified and all being present, the mayor called the meeting
to order and upon roll c
noted the following members as present:

and acting is temporary clerk; whereupon
as mayor presiding announced that the first rder of business was
the election of clerk and treasurer, and chief of police, and
fixing the salaries of such officers: Upon nomination, duly made,

there being no other nomination, .,,�.�"� was
unanimously elected as clerk and treasurer; and upon motion of

the following resolution fixing th4w salary of the clerk was
unanimously adopted;
Be it resolved by t__is 6ouncil that the salary of
the clerk, who shall also act as treasurer, be and the same
is hereby fixed at 037J, �- per month, payable on the
day of eacj calendar month, for the term of four vears
commencing with t1lis date. Irovided however, that the
Town Council reserves the right at any time during such
term decrea� or increase such salary and to dismiss the
said as clerk and treasurer with or�

seconded by the following reso ution fixing
the salary of the Cl:,,ief of i'olice was unanimously adopted;
Be It Resolved by this council that the salary of
the Chieefa of 'olice, be ar_d the same is hereby fixed at
7 1,/• per month, payable on the/i/Sday of each
calendar month, for the term of four wears commencing viith
this date. 1--rovided however, t:,at the City Council reserves
the right at any time duking such term to de rease or in: --
crease such salary and to dismiss the said
as Chief of Police with or without cause.
On motion o' f seconded by
the following resolution was unanimously
adopted:
Be It further Resolved that any and all other employees
of the City of Fairhope now regularly employed be and they
are hereby re-employed for ufid at the salary heretofore paid
them; this council reserves the right to dismiss them at
will, with or raithout cause, and to increase or decrease
their salaries from time to time at the council's discretion.
The Flavor then a:_nounced that the next order of business
was the election of a City Liana ger for the City of Fairhope,
and C. B. Iiiemeyer having been duly nominated for City Manager,
and there being no other nomination the said C. B. Niemeyer was
unamimously elected City "tanager for the term_ of" four _years
commencing this date;
The following Resolution having been offered by Councilman
Mason who moved its adoption, and the same having been
seconded by Councilman Berglin, was unanimously adopted:
Be It Resolved that the City Yanager shall exercise the powers,
rights, authority and jurisdiction and perform duties required
of city managers under the laws of the State of Alabama and
such other duty or duties as this City Council shall from
time to time require and this council does reserve the right
from time to time to change or order such duties, and powers
and to enlarge, extend or restrict the same at will and to
dismiss the said C. B. Niemeyer at will with or without cause.
And upon motion of Councilman Mason seconded by Councilman
Berglin the following resolution was unanimously adopted:
Be It Resolved that the salary of the city manager
of the City of Fairhope be and the same is hereby fixed
at the suml of $400.00 per month, payable on the lst and
15th day of each month; but this City Council does reserve
the right to increase or decrease such salary at any time
during such term.
On motion of Councilman Berglin seconded by Councilman
Overton the following resolution was unanimously adopted:
Be It Resolved that George Dyson be re-employed as
Superintendent of the Pdunicipal Gas Department at a salary
of $200.00 per month, payable on the lst day of each calendar
month; this council reserves the right to dismiss the said
George Dyson at will, with on without cause, and to increase
or decrease such salary from time to time at the Council's
discretion.
On motion by Councilman Overton seconded by Councilman
Mason the following resolution was unanimously adopted:
Be It Resolved that W. C. Beebe, esquire, and E. G.
Rickarby, Jr., esquire, be and they are hereby employed
as City Attorneys to perform such services as has here-
tofore been required of them by the City Council and that
each of them shall be paid a retainer in the sum of $50.00
per month, on the lst day of each month; but this council
reserves the right to dismiss them or either of them at will,
with or without cause, and to increase or decrease their or
either of their retainers at will.
Motion by Councilman Mason seconded by Councilman
Macon that the regular meetingsof the City Council be Yield
on the 2nd and. 4th Monday of each month at 7:00 P.M.
Motion carried.
The Mayor then appointed the following Councilmen as
Commissioners of the various department of the City:
Councilman Berglin - Streets and Fire Department
Councilman Blatchford - Parks, Recreation and Wharves.
Councilman bacon - Police Department
Councilman Mason - Electric and Gas Departments.
Councilman Overton - Finance and Sanitation.
On motion by Councilman Berglin seconded by Council-
man Mason the meeting adjourned. Motion carr&ed.
