County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday July 14, 1952 with the -
following members present: Mayor T. J. Klumpp, City Manager
C. B. Niemeyer, Councilmen: M. 0. Berglin, J. T. Bradford,
J. D. Mason, E. B. Overton and Ira Steele.
The minutes of the previous regular meeting were read and
approved as read.
Motion by Councilman Berglin seconded by Councilman Mason
that the following bills be approved for payment:

Motion by Councilman Steele seconded by Councilman Mason that
the application of W. Bagby for building permit be approved.
Motion carried.

Motion by Councilman Berglin seconded by Councilman Steele
taht the permit of•Prince Griffin be approved. Motion carried.
Motion by Councilman Mason seconded by Councilman Overton
that the resignation of Mr. Edgar R. Nelson as Civil Defense
Director be accepted and that a letter of thanks be rendered
Mr. Nelson. Motion carried.
Motion by Councilman Steele seonded by Councilman Berglin that
Mr. E. G. Rickarby, Jr. be appointed as Civil Defense Director
in the City of Fairhope. Motion carried.
Councilman Overton offered the following Ordinance to adopt
Fire Prevention Code which Ordinance was read in words and
figures as follows:
An Ordinance Providing for Fire Prevention
and Protection in Connection with Hazardous
Materials and Processes.
Be it Ordained by the City Council of the City of Fairhope,
Alabama as follows:
SECTION 1. Adoption of Fire Prevention Code.
There is hereby adopted by the City Council of Fairhope,
Alabama for the purpose of providing for fire prevention and
protection in connection with hazardous materials and pro-
cesses, that certain code known as the Fire Prevention Code,
Abbreviated Edition, recommended by the National Board of
Fire Underwriters of New York, being particularly the 1950
edition thereof and the whole thereof, save and except such
portions as are hereinafter deleted, modified or amended, of
which not less than three (3) copies have* been and now are
filed in the office of the Clerk of the City of Fairhope
and the same are hereby adopted and incorporated as fully as
if set out at length herein, and from the date on whichthis
ordinance shall take effect, the provisions -thereof shall be
controlling within the limits of the City of Fairhope.
SECTION 2. Definitions.
Whenever the worj "Municipality" is used in said code,
it shall be held to mean the City of Fairhope.
SECTION 3. Establishemnt of Limits in which Bulk Storage
of Flamable Liquids is Prohibited.
(1) The limits in Section 312 of said code in which
bulk storage of flammable liquids in outside aboveground
tanks is prohibited, are hereby established as follows:
Fairhope Avenue from School St. to BW view.
Section St. from Magnolia to Morphy
Delamare St. from Section to Church

SECTION 4. Validity
The invalidity of any section or provision of this
ordinance or of the code hereby adopted shall not invalidate
other sections or provisions thereof.
SECTION 5. Inconsistent Ordinances ]Repealed.
Ordinances or parts thereof in force at the time that
this ordinance shall take effect and inconsistent herewith,
are hereby repealed.
SECTION 6. Date of Effect.
This ordinance shall take effect and be in force from
and after its approval as required by law.
Councilman Mason moved the adoption of said Ordinance and
seconded by Councilman Berglin said Ordinance was ordered
to lie over for further consideration and adoption at the
next regular meeting of the City Council.
Councilman Overton offered the following Ordinance to
adopt National Building Code which Ordinance was read in words
and figures as follows:
An Ordinance Providing for Fire Limits, and
Regulations Governing the Construction, Alter-
ation, Equipment, or Removal of Buildings or
Structures.
Be It Ordained by the City Council of the City of Fairhope,
Alabama
Section 1. Adoption of Building Code.
There is hereby adopted by the City of Fairhope, Ala.
for the purpose of establishing rules and regulations for
the construction, alteration, removal, demolition, equipment,
use and occupancy, location and miantenance of buildings and
structures, including permits and penalties, that certain
building code known as the National Building Code, Abbreviated
Edition, recommended by the National Baord of Fire Under-
writers of New York, being particularly the 1949 edition there-
of and the whole thereof, save and except such portions as
are hereinafter deleted, modified or amended, of Kx1gamk
xxzkx,gzxkioxxx2ExxxxHxkmxffjLx.xgtmx which not less than three(3)
copies have been and now are filed in the office of the
Clerk of the City of Fairhope, Alabama and the same are hereby
adopted and incorporated as fully as if set out at length here-
in, and from the date on which this ordinance shall take effect,
the provisions thereof shall be controlling in the construct-
ion of all buildings and other structures therein contained
within the corporate limits of the City of Fairhope.
Section 2. Definitions.
(a) Wherever the word "Municipality" is used in said
code, it shall be held to mean the City of Fairhope.
(b) Wherever the term "Corporation Counsel" is used in
said code, it shall be held to mean the Attorney for the
City of Fairhope.
Section 3. Fire Limits Established.
The fire limits of the City of Fairhope are hereby es-
tablished as follows:
Fairhope Avenue from School St. to Bayview.
Section St. from Magnolia to Morphy
Delamate St. from Section to Church
Section 4. Saving Clause.
Nothing in this ordinance or in the code hereby adopted
shall be construed to affect any suit or proceeding now pending
in any court, or any rights acquired, or liability incurred,
nor any cause or causes of action accrued or existing, under
any act..Aor ordinance repealed hereby. Nor shall any right
or remedy of any character be lost, impaired or affected by
this ordinance.
Section 5. Validity.
The invalidity of any section or provision of this
ordinance or of the code hereby adopted shall not invalidate
other sections or provisions thereof.
Section 6. Inconsistent Ordinances Repealed
Ordinances or parts thereof in force at the time that
this ordinance shall take effect and inconsistent herewith,
are hereby repealed.
Section 6. Date of B'ffect.
This ordinance shall take effect and be in force from
and after its approval as required by law.

Councilman Mason moved the adoption of said ordinance and
seconded by Councilman ,erglin said ordinance was ordered
to lie over for further consideration and adoption at the
next regular meeting of the City Council.
Motion by Councilman Steele seconded by Councilman Mason
that the meeting adjourn. Motion carried.
