County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday, May 26, 1952 with the
following members present: Mayor T.J. Klumpp, City
Manager C. B. Niemeyer, Councilmen: M. 0. Berglin, R. H.
Brown, E. B. Overton and Ira Steele, Councilman Bradford
being absent.
The minutes of the previous regular meeting and speciAl
meeting of 21, 1952 were read and approved as read.

Mr. W. M. Walston met with the Council to apply for space
east of the Fairhope Casino for beach concession. Applica-
tion denied but space north of Casino offered.
Motion by Councilman Berglin seconded by Councilman Brown '
that the building permit of Mr. Lyle Euler be approved
as per sketch on file. Motion carried..
Motion by Councilman Overton seconded by Councilman Berglin
that the following Resolution be adopted. Motion carried.
WHEREAS, the property owners on Church Street from
Magnolia Avenue to Oak Street have proposed to the Council
that the City pave such portion of said street and that
they will pay the entire cost thereof.
NOW THEREFORE BE IT RESOLVED by the City Council
that the Mayor and City Manager are authorized and directed
to pave said portion of such street upon the property
owners paying into the City Treasury such cost over and
payable at such rate as may be determined by actual cost
for each front foot owned by each property owner.
Motion by Councilman Overton seconded by Councilman Brown
that the following resolution be aftpted. Motion carried.
WHEREAS the Single Tax Corporation having proposed
to the City Council that the City do all proper grading
which can be done by present city street equipment on
Magnolia Avenue from Bancroft Street to Fairhope Avenue,
on Bancroft Street from Magnolia Avenue to Fairhope Avenue,
to place the same'in condition to widen and for construction
of curb and Gutters and sidewalks, the Corporation to pay
all additional cost of pavement, construction of curb and
gutters, sidewalks and engineering.
NOW THEREFORE BE IT RESOLVED that the City do such
grading and cause such pavement, curb and gutters and side-
walks to be constructed upon the Single Tax Colony paying
to the Engineer and Contractors the cost of that portion of
such construction to be paid by it and giving to this
Council written agreement to pay any such additional costs
as shall be necessary and proper.
Motion by Councilman Overton seconded by Councilman Berglin
that the following Resolution`be;,adopted.-Motioft carried.
RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF FAIRHOPE, ALABAMA
WHEREAS, moneys are deposited monthly in the Bond
Cushion Fund of the Trust Department of the Merchants
National Bank of Mobile, Alabama for the purpose of pay-
ing outstanding Gas Revenue Bonds and Interest in case
of default, and
WHEREAS, in accordance with Article V, Section VIII
of the indenture between the City of Fairhope, Alabama,
a municipal corporation and the Merchants National Bank
of Mobile as Trustee_, dated February 1st., 1950, so long
as the City shall not be in default, it may at any time
from time to time at its option cause any or all of the
moneys in the Bond Cushion Fund which the City may determine
shall not be needed during the then ensuing six calendar
months for the purpose for which.said fund is created, to be
invested in any securities which are direct general obliga-
tions of the United States of America or which are uncondition-
ally guaranteed as to both principal and interest by the
United States of America. In the event of any such invest-
ment such securities together with all income derived there-
from shall become a part of the fund from which moneys were
used to make such investment, and shall be held by the
depository therefor to the same extent as if they were moneys
on deposit in such fund.
WHEREAS, the Treasury Department has discontinued
United States Treasury Savings Series G Bonds and is
issuing in their place a Series K Bond which runs for a
period of twelve years and bears interest at the rate of
2 3/4%.
NOW THEREFORE BE IT RESOLVED by the City Council of
the City of Fairhope, Alabama that the Merchants National
Bank of Mobile as Trustee, is authorized to invest accumulated
fund s in multiples of $1,000.00 Series K, United States
Savings Bonds, Interest Rate 2 V4%.
This Resolution to be retroactive to May 20, 1952•

M otion by Councilman Overton seconded by Councilman Berglin
that the City accept, with regret, the. resignation of
of Mr. Ralph Brown as Councilman due to a change in
position which prohibits him from attending Council
meetings and other duties of a City Councilman. Motion
carried.
Motion by Councilman Overton seconded by Councilman Berglin
that Mr. J. D. Mason be elected to fill unexpired term of
Mr. Ralph Brown as Councilman. Motion carried.
Motion by Councilman Steele seconded by Councilman Berglin
that the meeting adjourn. Motion carried.
