County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall Monday May 12 1952 with the
following members preseni: Mayor T.J. klumpp, City Manager
C. B. Niemeyer, Councilmen: J. T. Bradford, M. 0. Berglin,
E. B. Overton and Ira Steele, Councilman Brown being absent.
The minutes of the previous regular meeting were read and
approved.
Motion by Councilman Steele Seconded by Councilman Berglin
that the following bills be approved for Payment:

Mr. Robert Nahrgang met with the Council in regard to
opening new street between Gayfer Street and North Street.
Motion by Councilman Steele seconded by Councilman Bradford
that the City purchase Studebaker Pick -Up Truck from the
A-G Service Station. Motion carried.
Motion by Councilman Bradford seconded by Councilman Overton
that Mr. L. A. Berglin, Sr. be reappointed to the Board of
Directors of the Water and Sewer Board for a period of six
years beginning June 26, 1952. Motion carried.
Mr. Niemeyer, City Manager read a report from Mr. Ed Reid,
Executive Director of the Alabama League of municipalities,
on financing recreation centers in various Town in Alabama.
Motion by Councilman Overton seconded by Councilman Bradford
that the following Resolution be adopted:
WHEREAS, it appearing that the Waterworks Board of
the City of Fairhope, Alabama is without the funds to pay to
Layne Central Company the cost of the construction of a deep
well and installation of pump and accessories in connection
therewith under contract dated November 14, 195k, and to pay
to Donald Mills, consulting engineer, the amount of its con-
tract with him, and is without the funds to pay to M. Dyson
the cost of construction of pump house in connection with the
said deep well, under contract between the Waterworks Board
and the said M. Dyson heretofore entered into, and the Water-
works Board having proposed to the City Council of the City

of Fairhope that it transfer and assign the contract between
it and the said Layne Central Company, and its contract with
the said Donald Mills, consulting engineer, and its contract
with the said M. Dyson, and as well its, right, title and
interest in and to the said deep well, pump and pump house con -
strutted under the said contracts, and that the said Waterworks
Board lease the said deep well, pump and pump house from the
City of Fairhope for a period of five years commencing May 10,
1952 and ending May 10, 1957, for and at the sum of $5,000.00
cash in advance, under the terms of the said lease the Water-
works Board would operate and maintain the said deep well, pump
and pump house and keep the same in a good state of repair and
not commit, or permit waste to be committed thereon and return
the well, pump and pump house in as good condition as the same
is when completed, reasonable wear and tear excepted, the City
of Fairhope would pay the entire amounts payable thereunder by
the Waterworks Board and hold the Waterworks Board free from
Liability and loss thereon and to make such lease of the said
properties to the Waterworks Board under the aforesaid terms and
conditions;
NOW THEREFORE, BE IT RESOLVED that the proposal of the
'�aterworks board be and the same is hereby accepted and that
this City Council for and on behalf of the City of Fairhope
does agree to accept transfer, assignment and conveyance from
the Waterworks Board of its contracts with Layne Central
Company, dated November 14, 1951, with Donald Mills, consulting
engineer, and iith 1J. Dyson, and the City of Fairhope agrees
to and does hereby assume any and all obligations on the part
of the Waterworks Board under the aforesaid contracts and
agrees to pay to the said Layne Central Company, the said
Donald Mills and the said M. Dyson any and all sums owing by
the said .Vaterworks Board under the aforesaid contracts and
does hereby agree to lease to the said :laterworks Board the
properties covered by the said contracts for the period, under
the terms and for the rentals hereinabove set out, and T. J.
Klumpp, Sr., mayor of the City of Fairhope, and Marie Moore,
clerk, of the City of Fairhope, be and they are hereby authorized
and directed to receive such transfer and assignment and to
execute and deliver to the i°aterworks Board a lease on the
said properties as herein provided, and to pay to the said
Layne -Central Company, the said Donald Tills and M. Dyson
any and all moneys owing to them under the contracts with the
said Waterworks Board when and as the same shall become due.
Motion carried.
Motion by Councilman Bradford seconded by Councilman Steele
that the meeting adjourn. Motion carried.
