County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall February 11, 1952 with the
following members present: Mayor T.J. Klumpp, City Manager
C. B. Niemeyer, Councilmen: M. 0. Berglin, J. T. Bradford,
E. B. Overton and Ira Steele. Councilman Brown being absent.
Motion by Councilman Steele seconded by Councilman Bradford
that the minutes of the previous regular meeting be approved
as read.
Motion by Councilman Steele seconded by Councilman Overton
that the following bills be approved for payment: Motion
carried.

Motion by Councilman Steele seconded by Councilman Berglin
that the following Resolution be Adopted. Motion carried.
RESOLVED THAT WHEREAS CHARLES M.
MILNER AND SARAH MILNER,
husband and wife; JOHN No PARKER and
AMY PARKER, husband and
wife; RAYMOND RADFORD and MARGIE C. RADFORD, husband and wife,
F'LORENCE THAMES, a widow; and RUDOLPH ROSENQUIST and IRENE
M. Rosenquist, husband and wife, own
all the property in
Block SIX of Magnolia Beach Subdivision and desire that the
alleyway described, as follows, to -wit:
Alleyway running -East and West from
Bayview Avenue to adjoining alley-
way running North and South in Block
SIX of Magnolia Beach Subdivision in
the City of Fairhope, Baldwin County,
Alabama, and
be vacated and
WHEREAS the City of Fairhope does not desire to open
said alleyway or keep it opern
THEREFORE BE IT REROLVED, that the City of Fairhope assent
to the vacation of the above described alleyway.

I, MARIE MOORE, Clerk of the City of Fairhope, hereby
certify that I am the Custodian of the Records of the City
of Fairhope, and that the above is a true and correct copy of
a Resolution passed by the Council as shown in the Minute
Book Number 0 Page of the City of Fairhope on the
day of February, 1952.

Motion by Councilman Berglin seconded by Councilman Bradford
that the following Resolution by adopted: Motion carried.
RESOLVED THAT WHEREAS FAIRHOPE SINGLE TAX CORPORATION, a
corporation owns all of the land in Block 5, Division 3 and it
desires that the alleyways therein described as follows to -wit:
All platted alleys in Block 5, Division 3
of the lands of said Fairhope Single Tax
Corporation in the City of Fairhope, Ala-
bama as per its plat thereof filed for
record Sept. 13, 1911 and recorded in Mis-
cellaneous Book No. 1, Pages 320-21 at
the office of the Judge of Probate of
Baldwin County, Alabama
be vacated and,
WHEREAS the city of Fairhope does not desire to open said
alleyways or keep them open,
THEREFORE BE IT RESOLVED, that the City of Fairhope assents
to the vacation of the above described alleyways.

KNOW ALL MEN BY THESE PRESENTS that FAIRHOPE SINGLE TAX
CORPORATION, a corporation, is the owner of all land abutting
on the streets or alleyways described as follows:
All platted alleys in Block 5, Division 3
of the lands of said Fairhope Single Tax
Corporation in the City of Fairhope Ala-
bama as per its plat thereof filed for
record Sept. 13, 1911 and recorded in Mis-
cellaneous Book -No. 1, Pages 320-21 at
the office of the Judge of Probate of
Baldwin County, Alabama
and that said abutting owner desires such streets or alleyways
vacated and it does by these presents declare that same shall
be vacated under and by virtue of Section 32 of title 56 of the
-1940 Code of Alabama, and that said land is within the City of
Fairhope, Baldwin County, Alabama, and it causes its President
M. Dyson and its Secretary C. A. Gaston to sign this declara-
tion to be recorded in the Probate Records of Baldwin County,
Alabama, together with the assent to such vacation by the City
Council of the City of Fairhope, the municipality within which
this land lies.
