COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday, May 14, 1951 with the
following members present: Mayor T.J.Klumpp, City Super-
intendent C. B. Niemeyer, Councilmen: M. 0. Berglin, J. T.
Bradford, R.H. Brown, E. B. Overton and Ira N. Steele.
On motion by -Councilman Brown seconded by Councilman Overton
the minutes of the previous regular meeting were read and
approved as read.
Motion by Councilman Brown seconded by Councilman Overton
that the following bills be approved for payment:

Motion by Councilman Brown seconded by Councilman Overton
that the application of Mrs. W. L. Price to build warehouse
on Lot 2, Block 12, Division 1 be approved. Motion carried.
Motion by Councilman Bradford seconded by Councilman Steele
that Mrs. Thornton be granted permission to hang sign on
Bloxham Bldg., Fairhope Avenue. Motion carried.
Motion by Councilman Berglin seconded by Councilman Brown
that Mr. W. L. Walker be granted permission to install an
electric sign on Pensacola Avenue between Tensaw Avenue
and Seminole Avenue, northeast of Eastern Shore Hotel Sign
providing sign does not obstruct view and subject to removal
by the City Council. Motion carried.
Motion by Councilman Bradford seconded by Councilman Brown
that the following Resolution be adopted:
RESOLUTION
WHEREAS, moneys are deposited monthly in the Bond Cushion Fund
of the Trust Department of the Merchants National Bank of
Mobile, Alabama for the purpose of IpaS ing. outstanding Gas
Revenue Bonds and Interest in case of default, and.i
WHEREAS, in accordance with Article V, Section VIII of the
indenture between the City of Fairhope, Alabama, a municipal
corporation and the Merchants National Bank of Mobile as
Trustee, dated February 1st., 1950, so long as the City tha-11
,not be in default, it may at any time from time to time
at its option cause any or all of the moneys in the\Bond
Cushion F.undtwhich the City may.determine shall not be
needed during the then ensu} ing six calendar months for
the purpose for which said fund is created, to be invested
in any securities which are direct general obligations of
the United States of America or which are unconditionally
guaranteed as to both principal and interest by the United
States of America. In the event of any such investment,
such securities together with all income derived therefrom
shall become a part of the fund from which moneys were used
to make such investment, and shall be held by the depository
therefor to the same extent as if they were moneys on deposit
in such fund.
NOW THEREFORE BE IT RESOLVED by the City Council of the
City of Fairhope, Alabama that the Merchants National Bank
of Mobile as Trustee, is authorized to invest accumulated
funds in multiples of $1,000 Series G, United States Saving
Bond, Interest Rate 2J-,%.

Councilman Berglin introduced the following Ordinance:
ORDINANCE #215
AN ORDINANCE TO PROVIDE FOR THE ASSESS-
MENT AND COLLECTION OF THE AD 1ALOREM
T AXES . ~�
BE IT ORDAINED by the City Council of the City of
Fairhope as follows:
SECTION 1. The tax year for the aseessment and collect-
ion of the ad valorem taxes for the City of Fairhope shall
commence on October 11 1951 and on October 1st of each
succeeding year thereafter and shall end September 30, 1951
and.on September 30th of each succeeding year thereafter.
SECTION 2. That the municipal ad valorem taxes for the
City of Fairhope assessable as of October 1, 1951 and of each
succeeding year thereafter, and due September 30, 1951 and of
each succeeding year thereafter, shall be assessed by the Tax
Assessor of Baldwin County and collected by the Tax Collector
of Baldwin County, under and in accordance with Article 2 of
Title 37 of the Code 1940 and any amendment to said article 2
heretofore or hereafter adopted. And any and all provisions
of the said Article 2 and amendments relating to the assess-
ment and collection of municipal ad valorem taxes be and the
same are hereby adopted as a part of this ordinance as effect
ively as if the same were incorporated herein. The Tax Assessor
and Tax Collector shall be paid for services rendered under
this ordinance such commissions and fees as are liable by law,'
the same to be retained by the Tax Collector and deducted bev','
fore remittance to the City of Fairhope and the portion there"
of owing to the Tax Assessor by him paid -over to the Tax
Assessor at the time and in the manner provided by law.
SECTION 3. There is hereby levied for general municipal
purposes for the fiscal year commencing October 1, 1951 and
for each fiscal year thereafter a tax of one-half of one per-
centum of the value of all property and subject of taxation
as Assessed for State taxation during the preceeding year
in the City of Fairhope.
SECTION 4. Under Amendment Number VIII to the 1901
Constitution there is hereby levied for the fiscal year
commencing October 1, 1951 and for each fiscal year there-
after, for the purpose of paying bonds issued and outstand-
ing by the City of Fairhope, a tax of one-half of one per-
centum on all properties and subject of taxation within
the City of Fairhope.
SECTION 5. Under Amendment No. VIII to the 1901
Constitution there is hereby levied for the fiscal year
commencing October 1, 1951 and for each fiscal year there-
after for the purpose of acquiring, installing and maintain-
ing street lights and fire fighting equipment, and for the
purpose of constructing, acquiring, maintaining and improving
public property, sewers and disposal plants, a special tax
of one-half of one percentum of the value of all property
and subjects of taxation in the City of Fairhope as assessed
for State taxation during the preceeding year, as authorized
by an election held September 3, 1946.
Councilman Brown moved that the rules be suspended and
unanimous consent be given for immediate consideration of and
action on said ordinance, which motion was seconded by
Councilman Overton and upon the motion being put to vote the
following vote was recorded: Yeas, Mayor Klumpp and Council-
men Berglin, Bradford, Brown, Overton and Steele; Nays, None.
The Mayor thereupon declared that the motion for unanimous
consent for immediate consideration of an action on said
Ordinance had been unanimously carried. Councilman Bradford
thereupon moved that the said Ordinance be finally adopted, which
motion was seconded by Councilman Steele and upon said motion
being put to vote the following vote was recorded: Yeas, Mayor
Klumpp, Councilmen Berglin, Bradford, Brown, Overton and Steele:
Nays, None. The Mayor then announced that the motion for
adoption of said Ordinance had been unanimously carried and sign-
ed the same in approval thereof.
It was duly moved and seconded that the meeting adjourn.
