County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall, February 26, 1951 with the
following members present: Mayor T.J. Klumpp, City Supt.
C. B. Niemeyer, Councilmen: M. 0. Berglin, J. T. Bradford,
R. H. Brown, E. B. Overton and Ira Steele.
On motion by Councilman Brown seconded by Councilman
Berglin the minutes of the previous regular meeting were
read and approved as read.
Motion by Councilman Bradford seconded by Councilman
Brown that the application of Mr. J. C. Rushing for permit
to remodel store on Fairhope Avenue be approved. Motion
carried.
The following Ordinance was introduced by Councilman
Steele:
ORDINANCE 1-40. a/
An ordinance declaring the policy and purpose of the City (�)
of -.,__ _, Ala to xtend to the employees and officials
of said City er-Tty r}t of , Alabaria., not excluded
by law or by this ordinance, whether eilployed in connection with a govern-
mental or proprietary function of'said City (or Town), the benefits of
the systems of Federal Old Age and Survivor's insurance, as authorized by
the Federal Social Security Act, and amendments thereto, upon the basis
of applicable State and Federal laws or regulations; authorizing and di-
recting the Mayor, or other chief executive officer, to execute agreements
and amendments thereto with the State Agency authorized to enter into
such agreements, for coverage of said employees and officials; providing
for withholdings fro::i salaries and wages of employees and officials of
said City (or Town) so covered to be made and paid over as provided by
applicable State or Federal lairs or regulations; providing that said
City or (Town) shall appropriate and pay over employer's contributions
as provided by applicable State or Federal laws or regulations; providing
that said City (or Town) shall keep records and make reports as required
by applicable State or Federal laws or regulations; excluding from this
ordinance any authority to make any agreement with respect to any position,
employee, or official now covered or authorized to be covered by any
other ordinance or law creating any retirement system for any employee
or official of said City (or Town); excluding from this ordinance any
authority to make any agreement with respect to any position, employee
or official, compensation for which is on a fee basis, or any position,
employee or official not authorized to be covered under applicable
State or Federal laws or regulations.
BE ITT ORDAINED BY Tn' CITY COUNCIL OF TIM CITY (GR-TG�4) OF
(;), Alabama as follows:
Section 1.. It is hereby declared to be the policy and purpose of
the City (aP-Tenn) of A_ , Alabama, to extend, at
the earliest date, to the employees and officials thereof, not excluded
by law or by this ordinance, and whether employed in connection with
a governmental or proprietary function, the benefits of the system of
Old. Age and Survivor's Insurance as authorized by the Federal Social
Security Act and amendments thereto, including Public Law 734 of the
81st Congress. In pursuance of said policy, and for that purpose, the
City (or Town) shall take such action as may be required by applicable
State or Federal laws or regulations.

Section 2.' The Mayor, or other chief executive officer, of the
City (or Town) of , Alabama is hereby authorized
and directed to excecute all necessary agreements and amendments thereto
with the State Agency authorized to act to secure coverage of employees
and officials as provided in Section 1 hereof,
Section 3. Withholdings from salaries or wages of employees and of-
ficials for the purpose provided in Section 1 hereof are hereby authorized
to be made in the amounts and at such times as may be required by appli-
cable State or Federal laws or regulations, and shall be paid over to
the State or Federal Agency designated by said laws or regulations to
receive such amounts.
Section 4. Where shall be -appropriated from available funds such
amounts at such tirnes as may be required by applicable State or. Federal
laws or regulations for employer's contributions, which shall be paid
over to the State Agency designated by such laws or regulations to receive
same,
Section 5. The City (or Toim) shall keep such records and make
such reports as may be required by applicable State or Federal laws or
regulations.
Section 6. There is hereby excluded from this ordinance any authority
to make any agreement with respect to any position or any employee or
official now covered, or authorized to be covered, by any other ordinance
or law creating any retirement system for any employee or official of
the said City (or Town).
Section 7. There is hereby excluded from this ordinance any
authority to make any agreement with respect to any position, or any
employee or official, compensation for which is on a fee basis,

or any position, or any employee or official not authorized to be
covered by applicable State or Federal laws or regulations.
Section 8. This ordinance shall take effect upon its approval and
publication as required by law.

Councilman Berglin moved that the rues be suspended and
unanimous consent be given for immediate consideration of and
action on said ordinance, which motion was seconded by
Councilman Overton and upon the motion being put to vote
the following vote -was recorded: Yeas, Mayor Klumpp and
Councilmen Berglin, Bradford, Brown; Overton and Steele;
Nays, None. The Mayor thereupon declared that the motion fo
for unanimous consent for immediate consideration of and
action on said Ordinance had been unanimously carried.
Councilman Bradford thereupon moved that the said Ordinance
be finally adopted, which motion was seconded by Councilman
Brown and upon said motion being put to vote the following
vote was recorded:Yeas, Mayor Klumpp, Councilmen Berglin,
Bradford, Brown, Overton and Steele: Nays, None. The
Mayor then announced that the motion for adoption of said
Ordinance had been unanimously -carried and signed the same
in approval thereof.
Several other subjects were discussed but no action taken.
Motion by Councilman Berglin seconded by Councilman
Overton that the meeting adjourn. Motion carried.
