HomeMy WebLinkAbout10-23-1950 Regular MeetingSTATE OF ALABAMA County of Baldwin The City Council of the City of'Fairhope met in regular session at the City Hall, Monday, October 23, 1950 with the following members present: Mayor, T.J. Klumpp, City Superintendent C. B. Niemeyer; Councilmen: M. 0. Berglin, J. T. Bradford, R.H. Brown, E. B. Overton and Ira Steele. On motion by Councilman Overton seconded by Councilman Steele the minutes of the previous regular meeting were read and approved. Motion by Councilman Steele seconded by Council man Berglin that the application of J. E. Gooden for Building permit be allowed. Motion carried. Motion by Councilman Berglin seconded by Councilman Brown that the application of Boone -Huffman Development Corp. for building permit on Lot 3, Block 8, Division 1, be approved. Motion carried. Motion by Councilman Steele seconded by Councilman Brown that the Water and Sewer Depesits in the amount of $2,352.50 be transferred from the'General Fund to the Water and Sewer Fund as of September 30, 1950. Motion carried. Motion by Councilman Berglin seconded by Councilman Brown that the balances due from AdValorem assessments for the year 1936 thru 1944 in the amount of $777.35 be written off the books as of September 30, 1950. Motion by Councilman Berglin seconded by Councilman Overton that the Clerk be'authorized and directed to take necessary action to collect all back City Taxes from 1945 thru 1949. Motion carried. Motion by Councilman Berglin seconded by Councilman Steele BE IT RESOLVED by said Coucnil of the City of Fairhope that: LHEREAS On the 31st day of January, 1949, the City entered into an agreement with ROBERT R. NAHRGANG wherein and whereby the City agreed to credit Nahrgang's account for+clay used by the City in the sure of Fifteen Hundred Dollars against the cost of road construction of Fairwood Boulevard cnd the cost of which was to be assessid against the property owned by Nahrgang abutting Fairwood Boulevard and in the event the cost of construction work exceed Fifteen Hundred Dollars to Nahrgang when and if additional work was to be made on property owned by I-Tahrgang than the balance of'the Fifteen Hundred Dollar credit was to be applied on the cost of this construction that the cost of construction already done was ",1,043.75 leaving a balance of $456.25 to be applied on the cost of the next construction project on the streets adjacent to the Nahrgang land and not to apply on any paving cost. a Yotion by Councilman Bradford seconded by Councilman Brown that the following resolution be adopted: BE IT by the City Council of the City of Fatrhope, Alabamt, that the m,<.yor of the City Is hereby -authorized end "irected to execute and deliver in tlae name behalf of .,he, city <.n R ogre*.-m.7nt vvith The Water Works anO sewer Board. of the City of Fa.irhopa in sulbstantially the following form, to -,7:lii(,h 'uh;,, city clerk is hereby authorized and directed ro -nffix land .attest the seal of the city: AGREEMENT between the CITY OF FAIRHQPE, a municipal corporation under the laws of Alabama (herein called "the city"), and THE WATER WORKS AND SEWER BOARD OF THE CITY OF FAIRHQPE, a public corporation under the laws of Alabama (herein called "the board"); 11I R E S S E T H In consideration of the respective agreements herein contained, the parties do hereby agree one with the other as follows: (1) The city does hereby assign to the board that certain agreement between Harbert Construction Corporation and the city dated June 5, 1950, providing for construction of sanitary sewers. (2) The board hereby assumes and agrees to perform all the obligations on the part of the city under the agreement described in the foregoing paragraph (1). BE IT RESOLVED by the City Council of the City of Fairhope, Alabama, that the mayor of the city is hereby authorized and directed to execute and deliver in the name and behalf of the city an agreement with The Water Works and Sewer Board of the Uity of Fairhope in substantially the following form, to which the city clerk is hereby authorized and directed to affix and attest the seal of the city: F -4F 41 AGREEMENT between the CITY OF FAIRHOPE., a municipal corporation under the laws of Alabama (herein called "the city"), and THE WATER WORKS AND SEWER BOARD OF THE CITY OF FAIRHOPE, a public corporation under the laws of Alabama (herein called "the board"); WI T�I E S�SE�� In consideration of the respective agreements herein contained, the parties do hereby agree one with the other as follows: (1) The city does hereby assign to the board that certain agreement between J. E. Woolley and the city dated June 5, 1950, providing for construction of a sewage disposal plant.
