COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Hall,, Monday July 24, 1950 at 7:30
P.M. with the following members present: Mayor T.J.
Kluipp City Superintendent C. B. Niemeyert Councilmen:
M. 0. Lerglin, R. H. Brown, E. B. Overton and Ira N.
Steele, Councilman J. T. Bradford being absent.
The minutes of the previous meeting were read and approved
on motion by -Councilman Berglin seconded by Councilman
Steele.
Motion by Councilman Brown seconded by Councilman
Steele that the Mayor and City Superintendent be author-
ized to accept bid of the Town of Robertsdale on the sale
of three transformers, Motion carried.
Motion by Councilman Steele seconded by Councilman
Brown that the meeting adjour in unadjourned session
to meet at the City Hall on 9S o at

(1) The officers of the city hereinafter
named are the duly elected, qualified and acting officers

Assessor
The mayor and members of the city council (herein called
"the council") together constitute the governing body of
the city and exercise the legislative functions thereof.
Those of said officers who are required to post bond as
security for any funds handled by them duly posted with
the proper officers all bonds with sufficient surety re-
quired of them, which bonds were duly approved by the
officers required by law to approve the site• Those of
said officers who are required by lax to take an oath
of office duly took such oath before the officers required
by law. All of such officers are now and have been,
since their respective terms of office began, performing
the duties pertaining to their respective offices. The
second and fourth Mondays of each month, beginning at
7:30 otclock P.M., have heretofore been fixed by the
council as tie dates and time for the holding of regular
meetings of the council.
(2) The city is now and has been for more
than 40 years a municipal corporation duly organized and
existing under the laws of Alabama. There are no local
or special laws of said state pertaining to or having
any bearing on or restricting the borrowing of money by
the city, or the execution, issuance or sale of notes,
warrants or bonds by the city in evidence of any money
so borrowed. No proceedings for the dissolutio n of the
city have ever been taken. The population of the city as
shown by the preliminary 1950 federal Census was 3 3.
No subsequent census of the inhabitants of the city has
been taken.
(3) The undersigned mayor and treasurer of
the city have officially signed and caused the offidki
seal of the city to be affixed to each of the General
Obligation Sewer Bonds of the city dated July 1 19500
numbered from 1 to 81 inclusive, aggregating 1,00O
in principal amount (Herein called "the bondsn which
were authorised to be issued by the city by Ordinances
Nos. 205 and 206 adopted by the council and approved
on July 12, 1950. At the time the bonds were so signed
there were attached to each thereof the interest coupons
evidencing the installments of interest payable thereon
as provided in said ordinances. The said mayor and
treasurer do hereby adopt their facsimile signatures
appearing on said coupons in all respects as if they had
a the same in person. An impression of said seal
of the city is hereunder made, which seal has heretofore
been adopted as the official seal of the city. Each of
the bonds and each of said coupons was in the form and
contained the provisions set out in said Ordinances Nos.
205 and 206. No bonds other than those hereinabove de-
scribed have been executed by the undersigned or have been
issued under or pursuant to said ordinances.
(4) There is no litigation threatened or
pending in any court, whether state or federal attack-
ing or in any way questioning the corporate existence
of the city, or the territorial boundaries of the city
or the election or title of any of the aforesaid officials
as herein stated, or the power of the council to au-
thorize the execution and issuance of the bonds, or the
power or duty of the undersigned mayor and treasurer to
execute the bonds and to cause the offidal seal of the
city to be affixed thereto and to cause their facsimile
signatures to be affixed to said interest coupons, or
this power or duty of the council to sell the bonds in
behalf of the city and to cause the same to be delivered
to the purchasers thereof, or the validity of the
election held in the city on May 9; 1950 at which 4he
bands were authorized to be issued, or tie validity of
the aforesaid ordinances or either of them, or the
power of the city to construct sewers in the city for the
payment of which the bonds were authorized to be issued, or

the ggeeneral obligation of the city to pay the bonds and
the interest coupons applicable thereto at the respective
maturities thereof. The said ordinances Nos. 205 and 206
are still in full force and effect and neither thereof
has been repealed, revoked or amended,

11, the undersigned City Treasurer of the City
of Fairhope, Alabama, hereby certify that on the date
hereof at the time of the delivery by said city of the
$$1,008 principal amount of general Obligation. Sewer Bonds -
of said city dated July 1 1950, to the purchasers thereof,
which were authorized by Ordinances Mos. 205 and 206
adopted by the city council and approved on July 12, 19500
the following constituted the total indebtedness of the
city of all kinds whatsoever (other than the 755 #000
principal amount of First Mortgage Gas Revenue Banda of
said city dated February 1, 19509 which were originally
issued for the acquisition of a gas system by said city
and which are payable solely out of revenues from the
operation of such gas system):

I, the undersigned Tax Assessor for the City
of Fairhope in the State of Alabama, hereby certify that
the following constitutes the total assessed valuation
of all properties of any kind whatsoever located within
the corporate limits of said city and subject to ad
valorem taxation by it, as the same were assessed for
taxation by the State of Alabama for the tax year ending

The undersigned officers of the City of Fair -
hope, Alabama, hereby certify as follows:
On the date of this certificate the city treas-
urer of the city did receive from Sterne, Agee & Leach
Thornton, Mohr do Co., and Bush Securities Co « , the foliow-
ing,repressenting the purchase price bid by them for the
General Obligation Sewer Bonds of the city dated July 1,
1950 numbered from 1 to 81, inclusive, and aggregating
$81,600 in principal amount:

from July 1, 1950,
to date of payment
Total Payment
At the time of the payment for said bonds there
were delivered to the said purchasers the aforesaid bonds
of the city in the amount and form and executed in the
manner provided in Ordinances Mos. 205 and 206 of the
city. At the time of such delivery there were attached
to said bonds all semi-annual interest coupons applicable
thereto due January 1, 1951, and subsequent thereto.
