A REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF FAIR -
HOPE, ALABAft,A, HELD JUNE 121

The City Council of the City of Fairhope met
in regular session at the city hall of said city, the
regular place of meeting, on Monday, June 12, 1R50, at
7:30 o'clock P.M., with the following members present:
Mayor T. J. Klumpp and Councilmen M. 0. Berglin, J. T.
Bradford, R. H. Brown, E. B. Overton, and Ira N. Steele;
absent:
Miss Marie Moore, the City Clerk, was also present and
acted as clerk of the meeting. The mayor acted as Chair-
man of the meeting and stated that a quorum being present
the meeting was open for the transaction of business.
The minutes of the previous regular meeting were read
and approved.
Discussion was had of a proposal that the city
sell the General Obligation Sewer Bonds authorized at a
special election held in the city of May 9, 1950, and
after such discussion Councilman LALb-eit�
introduced the following resolution which was read to
the meeting:

THE GIVING OF NOTICE OF A
SALE OF GENERAL OBLIGATION
SEWER BONDS OF THE CITY AND
FIXING A DATE FOR SUCH SALE
BE IT RESOLVED by the City Council of the City
of Fairhope as follows:
1. June 28, 1950, beginning at 2:00 o'clock P.M.,
Central Standard Time, is hereby fixed as the date and
time, and the city hall in the said city i;10000

as the place of sale at public auction of prin-
cipal amount of General Obligation Sewer Bonds of the

city to be dated July 1, 1950, which were authorized
by the electors of the city at a special election held
in the city on May 9, 1950, to be issued for the pur-
pose of constructing sewers in the city. The details
pertaining to the said bonds will be provided for in an
ordinance of the city to be adopted by the council prior
to the sale thereof.
2. The mayor is hereby authorized and directed
to cause notice of the said sale to be given in substan-
tially the following form by filing or causing a copy
thereof to be filed with the Department of Finance of
the State of Alabama not less than fourteen days prior
to the date fixed for the said sale, and by causing such
notice to be published in the Fairhope Courier, a news-
paper published and having general circulation in the
City, once a week for two consecutive weeks, the first
publication to be not less than ten days prior to the
date of said sale:

The City of Fairhope in the State of Alabama will
offer for sale at public auction at the city hall in said
city, begin ' at 2:00 o'clock, P.M. (C.S.T.), on June
2$, 1950, W000 principal amount of General Obligation
Sewer BoDdsof the city to be dated July 1, 1950, consist-
ing of c coupon bonds in the denomination
of $1,000 eacIf, maturing on July 1, in the following agg-
regate principal amounts and in the following years (all
years inclusive): N3 000 in 1951 to 1953; 9"4,000 in 1954
to 1962; �5,000`in 19�3 to 1968; and 66,000 in 1969 +.
The following bonds shall be subject to redemption
at the option of the city on the following dates, as a
whole or in part in inverse numerical order, after thirty
days' prior published notice:
those maturing in 1953 to 1969, inclus-
ive, on any interest payment date on,}anydafter July 11, 1952•

shall be at the face value of the bonds redeem-
ed plus accrued interest to the redemption date and plus
the following applicable premium: if the redemption date
is on or prior to July 1, 1955, a premium equal to twelve
months' interest computed at the rate or rates the bonds
redeemed would bear on the redemption date had they not been
called for redemption; if the redemption date is after July
1, 1955, and on or prior to July 1, 1960, a premium equal
to six months' interest computed at the rate or rates the
bonds redeemed would bear on the redemption date had they
not been called for redemption; and if the redemption date
is after July 1, 1960, without premium.
The bonds will be general obligations of the
City for the payment of the principal of and interest
on which the full faith and credit of the city will
be irrevocably pledged. The city is specially auth-
orized by Amendment VIII to the Constitution of Ala-
bama to levy annually for the payment of the principal
of and interest on its bonds an ad valorem tax of 172
of 1%.
The bonds will be sold as a whole to the bidder
whose bid reflects the lowest net interest cost to the
city therefor; provided, that the city reserves the
right to reject any or all bids. The successful bidder
will be permitted to name the interest rate or rates to
be borne by the bonds, but no rate shall exceed 3% per
annum and all bonds having the same maturity must bear
the same rate of interest. The interest on the bonds
will be payable semi-annually on January land July 1.
All bids must include accrued interest to the date of
delivery of the bonds and the successful bid must be so
computed that the city will receive in payment for the
bonds not less than the face amount thereof plus such
accrued interest.
Each bidder must deposit with the city clerk
before bidding a cashiert,s check or a certified check
in an amount equal to 2% of the face value of the bonds
payable to the order of the city and drawn on a bank
having membership in the Federal Reserve System. No
interest will be allowed on any such check. The checks '
of the unsuccessful bidders will be returned to them
after the sale. The check of the successful bidder will
be retained by the city as security for the performance
of the successful bid and will be applied on the purchase
price of the bonds upon consumation of the purchase thereof.
The bonds will be delivered in such place as shall
be designated by the successful bidder, against payment
in bankable funds, as soon as the bonds may be prepared
following the sale. The city will furnish, without cost,
the printed bonds and the opinion of Messrs. White, Bradley
Arant & All approving the validity thereof. No condition-
al bids will be considered except that bids may be con-
ditioned upon such opinion.

Councilman moved that the said res-
olution be adopted, wh ch motion was seconded by Council-
man I1/9A,&vV-k-L1 and upon said motion being put
to vote the following vote was recorded: Yeas: Mayor Klumpp
and Councilmen Berglin, Bradford, Brown, Overton and
Steele; Nays: None. The Mayor thereupon announced
that the motion for adoption of said resolution had
been unanimously carried.

Motion by Councilman Steele Seconded by Councilman
Overton that the City accept the bild of Gaston Motor
company for Police Car. Motion carried.
Motion by Councilman Berglin seconded'by Council-
man Steele that the 4pplication of TVrs. IT. F. McNamee
for permission to hang sign be approved. Motion carried.
Motion by Councilman Brown seconded by Councilman

Berglin that the application of Klumpp L%otor Co., Inc.
for sign permit on used car lot be approved. Motion
carried.
On motion of Councilman
seconded by Councilman. , the follow-
ing resolution was unanimously adopted, voting for the same
Mayor, Klumpp, Councilmen Berglin, Bradford, Overton, Brown
and Steele, aainst, None:
Bids having been received by the City Council of
the City 6f Fairhope at its meeting of June 5, 1950, for
extensions, betterments, and improvements to the sewerage
system of the City of Fairhope in accordance with plans and
specifications prepared by Goodwin Engineers, Incorporated,
of Birmingham, Alabama;
And it appearing that the bid of Harbert Construct-
ion Corporation, of Birmingham, "labama, was the lowest and
best bid for the construction of that portion of the said
works specified in Section 1 of the said plans and specifi-
cations, being the construction and installation of extensions
and betterments to the system for the collection of sewerage,
(material to be of clay pine as specified in said --plans and
specifications) at the price of $144,344.6 , "he said bid
of the said Harbert construction Corpor on for such work
be and the same is hereby accepted;
And it appearing from such bids that the bid of
J. E. Wooley, of Birmingham, Alabama, contractor for the
construction and installation of a treatment plant in accord-
ance with the plans and specifications designated as Section
2, in the sum of %?94�9$.50, being the lowest and best bid
therefor, the bid of the said J. E. Wooley, contractor, be
and the same is hereby accepted.
The mayor and city clerk be and they are hereby
authorized and directed to enter into contract with the said
above named bidders, but subject however, to the sale of
bonds by the City of Fairh ope or by such corporation or
agency as it shall organize or set up for such purpose, in
an amount sufficient to pay the cost of such construction
and on terms acceptable to the City Council.
Motion by Councilman Steele seconded by Councilman
Bradford that the meeting adjourn. Motion carried.
