EXCERPTS FROM THE MINUTES OF A
MEETING OF THE CITY COUNCIL OF
THE CITY OF FAIRHOPE, ALABAMA,
HELD ON MAY 229 1950
The City Council of the City of Fairhope,
Alabama, met in regular session at the city hall in
said city, the regular place of meeting, on May 22,
1950, at 7:30 o'clock, P.M. On roll call the fol-
lowing were found to be present: Mayor T. J. Klumpp,
and Councilmen M. 0. Berglin, J. T. Bradford, R. H.
Brown, Edward B. Overton, and Ira N. Steele; absent:
tee. The mayor acted as
chairman of the meeting and Miss Marie Moore the city
clerk, who was also present at the meeting, acted as
clerk thereof. The mayor stated that a quorum was
present and declared that the meeting was open for
the transaction of business. The minutes of the pre-
ceding meeting were read and approved.
The mayor stated that an application in
writing had been filed with the mayor and city coun-
cil for a permit to apply for the incorporation of
a water works and sewer board for the city, which ap-
plication was in words and figures as follows:

THE CITY OF FAIRHOPE, ALABAMA:
We, the undersigned, natural persons who
are duly qualified electors and property owners in
said city, do hereby file with you as the governing
body of said city and do hereby make this application
in writing for a permit to apply for the incorporation
of a water works and sewer board of said city pursuant
to the provisions of Title 37, Sections 394 to 402,
inclusive, of the Code of Alabama of 1940, as amended,
and we do hereby request that said application be
granted and that a proper resolution be adopted by
you authorizing the incorporation of a water works
and sewer board of and in said city under the name
of "The Water Works and Sewer Board of the City of
Fairhope".

and property owners of said city; and
WHEREAS, the mayor and council of said city
have examined the said application and have found that
the same is regular in all respects and conforms with
the requirements of the laws of Alabama under which
the said corporation is proposed to be organized, and
the said mayor and council deem it wise, expedient,
necessary and advisable that said corporation be formed;
NOW, THEREFORE, BE IT RESOLVED by the Mayor
and City Council of the City of Fairhope as follows:

that there be formed the corpo-

said application has been made.
(3) Said application is hereby allowed,

ration of The Water Works and Sewer Board
of the City of Fairhope in the manner
provided by the laws of Alabama under
which said corporation is proposed to be
organized.

Councilman ��n�.g-u� moved that the rules be
suspended and unanimous consent be given for immediate
consideration of and action on said preambles and
resolution, which motion was seconded by Councilman
, and upon the motion being put to
vote th following vote was recorded: Yeas: Mayor
Klumpp and Councilmen Berglin, Bradford, Brown, Overton,
and Steele; Nays: None. The mayor thereupon declared
that the motion for unanimous consent for immediate
consideration of and action on said preambles and reso-
lution had been unanimously carried. Councilman
thereupon moved that the said preambles
and resolution be finally adoptte--d, which motion was
seconded by Councilman ,gyp t_ , and upon
said motion being put to vote the following vote was
recorded: Yeas: Mayor Klumpp and Councilmen Berglin,
Bradford, Brown, Overton, and Steele; Nays: None. The
mayor thereupon announced that the motion for adoption
of said preambles and resolution had been unanimously
carried and he thereupon signed the same in approval
thereof.
Councilman introduced the fol-
lowing resolution:
RESOLVED that the resolution heretcfore
adopted at this meeting granting permission
for the incorporation of a water works and
sewer board in this city shall be published
one time in The Fairhope Courier, a news-
paper published and having general circula-
tion in the City of Fairhope, Alabama.

resolution be ad ted, which motion was seconded by
Councilman and upon the same being
put to vote, the following voted in favor of said
motion: Mayor Klumpp and Councilmen Berglin, Bradford,
Brown, Overton, and Steele; and the following voted
against the adoption thereof: None. The mayor there-
upon announced that the motion for adoption of said
resolution had been unanimously carried.
There being no further business to come before
the meeting the same was on motion duly adjourned to
