HomeMy WebLinkAbout05-10-1950 Adjourned Regular MeetingEXCERPTS FROM THE MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, HELD ON MAY 10, 1950 The City Council of the City of Fairhope met in adjourned regular session at the city hall in said city, the regular place of meeting, on May 10, 1950, at a? ; 0 d ofclock, P.M., pursuant to adjourn- ment of the regular meeting held on May 8, 1950. On roll call the following were found to be present: Mayor T. J. Klumpp, and Councilmen M. 0. Berglin, J. T. Bradford, R. H. Brown, Edward B. Overton, and Ira N. Steele; absent: . Miss Marie Moore, the city clerk, was present at the meeting and acted as clerk thereof. The mayor acted as chairman of the meeting and stated that a quorum being present the meeting was open for the transaction of business. The mayor stated that this was the time fixed by law for the canvass of the returns of the special municipal bond election held in the city*on May 9, 1950,. which had been called by resolution adopted by the coun- cil at its meeting held on March 27, 1950. The council, constituting a board of canvassers, thereupon proceeded to canvass the returns of the said election and upon the completion thereof the following resolution, and the pre - am" thereto, were introduced in writing by Councilman 1W-4m WHEREAS, at a meeting of the City Council (herein called "the council") of the City of Fairhope (herein called "the city") held on March 27, 1950, a resolution was duly adopted calling a special election to be held in the city on May 9, 1950, for the purpose of submitting to the qualified electors of the city for determining their will by ballot on the question of whether or not the city should issue, on its credit, $111,000 principal amount of its General Obligation Sewer Bonds for the purpose of constructing sewers in the city; and WHEREAS, notice of said election was published in The Fairhope Courier, a newspaper published and having general circulation in the city, in the issues of that newspaper published on April 6, 1950, April 13, 1950, and April 20, 1950, in the form of said notice as provided in the said resolution wherein the said elec- tion was called, the first of said dates of publication being more than thirty (30) days before the date of said election; and WHEREAS, the said election was held in the city on May 9, 1950, in all respects as provided in the said notice, and the ballots used at the said election were in all respects in the form provided therefor set out in the said resolution calling the said election, and the inspectors and managers conducting said election have duly made and the returning officers have duly filed with the council their respective reports, returns, and certificates, which have been duly canvassed by the council acting as a board of canvassers which canvass discloses the following results: FOR proposed City of Fairhope General Obli- gation Sewer Bonds Box No. 1 Location: City Hall Box No. 2 Location: Cummings Hall Fairhope Avenue AGAINST proposed City of Fairhope General Obligation Sewer Bonds NOW, THEREFORE, BE IT RESOLVED by the council, acting as a board of canvassers for the purpose of can- vassing the returns of said election, as follows: (1) The recitations contained in the foregoing preambles are hereby ascertained and found to be true and - 3 - are hereby adopted as a part of this resolution. (2) The said election was duly called, notice thereof was given and the said election was held and the ballots used thereat were in all respects as provi- ded by law, and at said election a majority of the quali- fied electors of the city voted at said election voting in favor of the issuance of said bonds and the city is accordingly authorized to issue said bonds.in accordance with the terms of the notice calling said election and the ballots cast thereat, and the provisions of law. (3) The said preambles and this resolution, together comprising the canvass and declarations and findings by the council, acting as a board of canvas- sers, shall be recorded in the proceedings of the council. Adopted and approved this loth day of May, 1950. Authenticated: Mayor, "_7� `�7� -o-6-L-e— City Clerk Councilman moved that unanimous consent be given for immediate consideration of and action on said resolution, which motion was seconded by Councilman , and upon the motion being put to vote the following vote was recorded: Yeas: Mayor Klumpp and Councilmen Berglin, Bradford, Brown, Overton, and Steele; Nays: None. The mayor thereupon declared that the motion for unanimous consent for the immediate considera- tion of and action on said resolution had been unanimously carried. Councilma thereupon moved that the said resolution be finally adopted, which motion was sec- onded by Councilman , and upon the motion being put to vote the following q0te was recorded: Yeas: Mayor Klumpp and Councilmen Berglin, Bradford, Brown, Overton, and Steele; Nays: None. The mayor thereupon announced -4- that the motion for adoption of said resolution had been unanimously carried and he thereupon signed the same in approval thereof.
