County of Baldwin
The Town Council of the Tow of Fai rhope met in regular
session at the Town Hall, Monday, December 12, 1949 with
the following Tembers present: MayorT.J. K>lumpp, City
Superintendent C. B. Niemeyer, Councilman J. T. Bradford,
R. H. Brown, E. B. bverton and Ira Steele. Councilman
11. 0. Berglin being absent.
The minutes of the previous regular meeting were read
and approved as read.
Motion by Councilman Steele seconded -by Councilman Bradford
that the following Resolution be adopted. Motion carried.
This being the date, time and place hereto set
for the purpose of hearing objections to assessment
of Town AdValorem Taxes for the year 1949, due notice
having been given and no objections having been
filed, the said assessments as made up and certified
by Marie Moore, be and the same are hereby confirmed,
December 12, 1949.
Ylotion by Councilman Overton seconded by Councilman Brown
that the Mayor and Clerk of the Town of Fairhope be
authorized to negotiate a loan of $8,000.00 for the pur-
pose of paying viestinghouse Electric Corporation for
Transformers. Motion carried.
Motion by Councilman Brown seconded by Councilman Steele
that the following Ordinance be adopted.

BE IT ORDAIFED BY THE TOWN CCUI,CIL CF TI:E TO15T OF FAIRHOPE,
ALABAIYA :
That Subsection B of Section 2 of Ordinance # 132
adopted on the 17th day of July, 1935, be and the same
is hereby amended to read as follows:
(b) All pipe shall be of standard vitrified clay or
cast iron sail pipe, bell or spigot type not less than
four (4) inches in diameter, except where a single line
serves two premises a minimum of six (6) inch pipe shall
be used.

It was moved by Councilman Brown seconded by Councilman
Bradford that all rules and regulations of the statutes
of the Town Council of the Town of Fairhope which might
prevent, unless suspended, the immediate consideration and
final passage and adoption of said Ordinance at this
meeting.
The question being put upon the adoption of said motion and
the sus^ension of the said rules and regulations, the roll
was called with the follo:ing results:
Voting Aye, Yayor T.J.Klumpp, Councilman R.H. Brown, J. T.
Bradford, E. B. Overton and Ira Steele. Councilman Berglin
being absent. Voting Nay, None.
The Mayor ddclared the motion carried.
Councilman Overton therefor moved that the said Ordinance
be finally passed and adopted as introduced. Councilman
Steele seconded the motion.
The question being put upon the final passage and adoption
of the said Ordinance the roll was called with the follow-
ing results: Voting Aye: Mayor T.J.ulumpp, Councilmen
➢'. T. Bradford, R.H. Brown, E. B. 0,,erton and Ira Steele.
Voting Nay, None. Councilman Berglin being absent.
Thereupon the Llayor declared

Notion by Councilman Bradford seconded by Councilman
Brown that the i,Taycr be authorized to have the Ordinance
Book of the Town of Fairhope indexed. Yotion carried.
Notion b,1'Councilman Brown seconded by Councilman Steele
that the Mayor be authorized and directed to pay off
$10,000.00 General Fund Warrants issued on the 12th day
of January, 1949. motion carried.
Motion by Councilman Overton seconded by Councilman Steele
that the following Resolution be adopted. Yotion carried.
RESOLUTION
WHEREAS as shown by t.re Town of Fairhope Audit made by
Smith, Dukes and Buckalew, Certified Accountants, as of
September 39, 1949, there are carried to the credit of
The Electric Fund certain General Fund Warrants
aggregating the sum of $68,500.00 and an account in the
sum of $50.86 of the Electric Fund against the General
Fund, and
WHEREAS, the 11unicipal Electric Light System is not in
debt or otheri^aise obligated or encumbered, and the assets
of such system are wholly the property of the Toth and
subject to the action of this Council, and it appears to
be right and proper teat such Vtiarrants and such account
being the property of the To-°-n be cancelled and discharged;
1\'Ov9 TFLdREFORE BE -IT RESOLVED by the Town Council that such
warrants and account be and They are hereby cancelled and
discharged and the Eayor and Clerk are authorized to cancel
such warrants and account and.to make proper entry thereof
on the books of the Town.
And it further appearing that there is carried by the
General Fund a IFarrant issued by the Grater and Sewerage Fund
in the sum of $3,000.00 and the General Fund is indebted
to the Grater and Sewerage Fund as of that date, in the sum
of '47542.98;
NCW THEREFORE BE IT FURTHER RESOLVED that the 1.'ayor and
Clerk surrender to the General Fund the said Giiarrant,
cancel the same, and credit the proceeds on the General%
Fund Account o- ing to the Water and Sewerage Fund.
11otion by Councilman Brown seconded by Councilmen Bradford
that the meeting adjourn. Motion carried.
