COUNTY OF BALDWIN
The Town Council of the Town of Fairhope met in
regular session at the Town Hall Tuesday, October
2F,1947 at 7:30 P.M. with the _following members
present: Mayor Howard Ruge, Councilmen: J.H. Bennett,
C. A. Gaston, H.P. Kamper, W.O.Keeble and J. 0.
Stimpson.
The minutes of the previous regular mmeting were read
and approved.
Councilman Gaston moved the adoption of the following
Resolution seconded'by Councilman J.O. Stimpson.
BE TT RESOLVED BY THE TOWN COUNCIL
OF THE TOWN OF FAIRHOPE:
FIRST: That an easement be and is hereby
granted to W. F. Harie to construct and maintain a
for entrance to and exit from the second floor
of the building known as the "Casino" on the
west side thereof, projecting over and resting
on lands of the Town of Fnirhope,(the west wall
of the Casino bean? on the west line of the
Casino property), but subject to the conditions
herein set out.
SECOND: The said easement given hereby
shall be revocable at will by the Town Council
by resolution entered upon its minutes; and
the said W. F. Hawie, his heirs and assigns,
shall remove such stairway within ten days
after revocaticn of this easement; such stair-
way shall be constructed and maintained in all
things in strict conformity with, and of
materials and construction required by the
building co, e of the Town of Fairhope and of the
State Fire Marshpl a.ndit shall fully conform to
and comply with all the laws, rules and renu lati.cns
of the Town of Fairhope anclof the State of
Alabama and of any department, agency and. sub-
division thereof.
THIRD: The Mayor, Howard Ruge, is hereby
authorized and directed to execute and deliver
to 71. F. Harie an instrument in writing
evidencing the easement and rights herein granted
subject to all limitations and restrictions
embodied in tris resolution.
Councilman J.H. Bennett offered the following resolution
and moved its adoption, seconded by Councilman C. A.
Gaston.
i-FEF.EAS, The assessment of and on all property
and subjects to taxation liable for taxes in t'-e
Town of Fairhope for t-e ,year 1947 riving been
made by R. C. Yohn, the person designated by the
Town Council of the Town.of Fairhope, Alabama,
to assess such taxes, and having been returned
to the Council, all in accordance with the laws
of the State of Alabama and of the Town of
Fairhope.

Motion by Councilman Gaston seconded by Councilman
Stimpson that the application of Henry Creamer for
permit to add to present building on Lot 7-8, Block
2, Division 4 be allowed. Motion carried.
Motion by Councilman Stimpson seconded by Councilman
Gaston that the application of W.K.Byers for permit
to add 3 foot canopy on building, at White Avenue
and Liberty Street be allowed. Motion carried.
Motion by Councilman Gaston seconded by Councilman
Ka'fper that the application of E. T. Hoffman for
permit to move and remodel garage on Lot 1, Block 8
Division 2 be allowed. Motion carried.
Motion by Councilman Kamper seconded by Councilman
Gaston that Smith, Dukes and Bu.ckaler be employed
to make the annual audit. Motion carried.
It was duly moved and seconded that the meeting
adjourn.

On motion by Councilman Gaston seconded by Council-
man Fennett the following resolution on roll call was
unanimously adopted. Voting Aye: Mayor R1ige, Council-
men J.H.Bennett, C. A. Gaston, H.P.Kamper, !A,+.O.Keeble
and J.O. Stimpson. Voting Nay: None.
BE IT RESOLVED that R. C. Sohn be and he is
designated to make up the assessment roll of
all property and subjects of taxation in the
Town of Fairhope, For the taxes to become due
December 1, 1947. Resolution adopted by the
Council.
Moved by Councilman C. A. Gaston, seconded
by Councilman F.P. Kamper that tie following
resolution be adopted.
BE IT RESOLVED by the Town Council of the
Town of Fairhope, there be and is hereby levied
for general purposes, for the year. of 1947,
a tax of one-half of one percentu.m of the value
of all property and subject to taxation as
assessed for State Taxation during the pre-
ceeding year in the Town of Fairhope.
BE IT FURTHER RESOLVED that there be and is
hereby levied for the year 1947, for the pur-
pose of acquiring, installing and maintain-
ing street lights and fire fighting equipment,
and for the purpose of constructing,, acquiring,
maintaining and improving public property, a
special tax of one-half of one percentum of the
value of all property and subjects of taxation
in the Town of Fairhope as assessed for State
taxation durin- the preceeding year, as author-
ized by the result of election held September
3, 1946.
WHERAS, under Amendemnt number.V:III,
Municipal Tax Amendment, to the Constitution
of the State of Alabama, the TOVTn of Fairhope
is authorized and empowered to levy and collect
an additional.tax of one-half on one per centum
on the taxable properties and subjects of tax-
ation in the Town of Fairhope for the purpose
of paying the principal of bonds and interest
thereon; and
WFEREAS, the Town of Fairhope has out-
standing bonds in the sum of $15,000.00 and it
is necessary and proper and to the interest of
the citizenry of the Town of Fairhope that such
tax be levied for such purposes;
N0W THEREFORE, be it resolved that there
be and is hereby levied and shall be collected
for the municipal tax year commencing October 1,
1947, a tax of one-half of one per centum on
all properties and subjects of taxation within,
the Town of Fairhope for the purpose of paying
the principal of outstanding bonds of the Town
of Fairhope and interest thereon;
BE IT FURTHER RESOLVED that the proceeds
of such tax when collected shall be kept sep-
arate and apart from other taxes of the Town
of Fairhope and shall be used exclusively for
the payment of the principal of the'outstand-
ing bonds of the Tovn of Fairhope and interest
thereon when and as the same shall become due.
