HomeMy WebLinkAbout02-14-1944 Regular MeetingN STATE OF ALABAITA: COUNTY OF BALDWIN The Town Council of the Town of Fairhope met in regular session at the Town Hall, Monday February 14, 1944, at 7:30 P.M. with the following members present: Howard Ruge, Mayor, Councilmen: C. A. Gaston, H. P. Kamper and J. 0. Stimpson. The minutes of the previous regular meeting were approved as read. Elec. 6.'57 IV& S 3.50 Councilman C. A. Gaston offored the following resolution and moved its adoption. Seconded by Councilman J. 0. Stimpson. STATE OF ALABAM BALDWIN COUNTY AREAS, the Town of Fairhope has the record title to the lands hereinafter described and conveyed and Charles Burkel has owned the buildings thereon and has been in con- tinuous possession of the same, he and those through whom he claims, -for more than twenty years next preceding this date, and in the opinion of the Town Council it is equitable that the Town execute and deliver to the said Charles Burkel a Quit Claim Deed for such lands namely: From an iron pipe at the Southwest corner of the intersection of Beach View Avenue and Pier Street run North 58 degrees and no minutes 'Nest 187.5 feet along the South side of Pier Street for a point of begining, thence South 30 degrees and 40 minutes West 110 feet to a point, thence north 58 degrees and no minutes Test 84 feet to a point, thence Z;ort1h 30 Aegr_e_es- and 4:0 _minutes East to the South side of Pier Street, thence along the South side of Pier Street to point of begining. NOW THEREFORE be it resolved that Howard Ruge, as Mayor of the Town of Fairhope and he is hereby authorized and directed to execute and deliver to Charles Burkel a Quit Claim Deed to the aforesaid lands for and in the consideration of the sum of ONE (t1.00) DOLLAR upon his paying of back taxes on the improvements situated on said property owing to the Town of Fairhope and to the State of Alabama and to Baldwin County, Alabama. If any of the buildings owned by Charles Burkel shall be on or project over into Pier Street the Town shall have the right to require the removal of any such building on or pro- jecting into Pier Street upon sixty days notice to Charles Burkel or to the then owner of such building. An easement to construct, operate and maintain a private walk way* from bluff line to the building on said lands be also given until such time as other adequate access to said building can be provided.
