Be it Ordained by the Town Council of the Town
of Fairhone as follo,lrs:
Section 1. That any person, male or feYaa,le, -who
jranders or strolls about in idleness, or Who lives in
idleness, or v.1ho loafs, loiters or idles, or remains
in the Town of-?airhope, .11abama, or within its police
jurisdiction without any regular emmoloyment, having no
income producing:; pronerty sufficient for his support,
and for the sur-port of his dependents, is hereby de-
clared to ')e a vagrant, and on conviction of vagrancy*
shall be. runished as provided in Title 37, 3ection
586 of the lode of Alabaria, of 19 40 .
Section 2. The terra "regular edployY.lent" as
used in the -preceding section shall be construed to
mean regular and continuous employ,Yent to the reason-
able physical capacity and op-portunity of each person
subject to the provisions of this Ordinance.
Section 3. wn the prosecution for va€rancy,
whenever it shall be established by the -proof that t,,.e
defendant has-been guilty of vndering or strolling
about, or remaining in idleness during any working
day in any calendar v,•eer., the burden of -proof shall
be upon the defendant to shoti, that he is not a vagrant
within the meaning of this Ordinance, or of any other
valid Ordinance, of the Town of Fairhope.
Section 4. T As Ordinance shall be in force and
effect from, the date hereof until ratification of a
treaty of -peace between the United States of ,_iierica
and the Axis countries.
