COUNTY OF BALDW IN
The Town Council of the Town of Fairhope met in regular
session at the Town Hall, Monday, October 12, 1942 at
7:30 P.M. with the following members present: Howard
Ruge, Mayor, Councilmen: C.A. Gaston, M.O. Berglin, H.P.
Kamper and J.O. Stimpson.
The minutes of the previous regular meeting were approved
as read.

It was moved by Councilman C.A. Gaston/nd seconded by
Councilman K.P. Kamper that the peticoncerning the
repeal of the Dog Ordinance be accepand placed on
file for action at the next regular, the-- n�--c-f-

The following ordinance was introduced by Councilman
C.A. Gaston, read in full by the Clerk and considered by
the Council, the said Ordinance being as fol-lows:
ORDINANCE NO. IV
An Ordinance to fix maximum ra;;es o:i speed at which auto-
motive vehicles may traverse the streets of Fairhope; to ma Le
it unlawful to exceed such speed limits and to provide a penalty
therefor

SECTION, I: The maximum rates of speed at which any person
shall drive an automobile, truck, bus, tractor, motorcycle or
other automotive vehicle on the streets, avenues, alleys o2 other
public highways in the town of Fairho pe is as follow;s:
(a) In the business district of the tovin - 15 miles an
hour;
(b) In residential districts of the town -25 miles an hour;
(e) In all other districts of the town - 35 miles an hour.
(d) On bridges - 20 miles an hour.
SECTION 2: The Mayor and the Councilman in charge of streets
shall classify the streets, avenues, alleys and. other public High-
ways and segments thereof as being in business, residential and other
districts and cause appropriate signs to be placed on or along; thy=
same stating the maximum speed limit permitted on the same, 'and.
in such manner that such si,-ns ,,iay be readily visible to driving
motorists. they shall also post the speed limit on bridges.
SECTIOIv 3: It shall be unlawful for any person to drive
any such automotive vehicle alon.� any street, avenue, alley or
other public highway at a greater rate of speed thatL that shown
on the signs placed along the saia.e hereunder;
ECTI0114 4: Any person convicted of violating thisOrdinance
shall be fined not less than $1.00 nor more than `100.00 and may
be also sentenced to hard labor for the tovin for not more than 90
days, either or both.
SECTION 5: This Ordinance shall be desi-nated and may be
known and cited as "Speed Limit Ordin_�nce y,o. 166 it,
SECTI01� 6: All Ordinances and parts of Ordinances in con-
flict herewith are hereby expressly repealed.

It was moved by Councilman C.A. Gaston and seconded by
Councilman J.O.. Stimpson that all rules and regulations
of the Statutes of the Town Council of the Town of Fair
hope which might prevent, unless suspended, the immediate
consideration and final passage and adoption of said
ordinance at this meeting, be suspended.
The question being put upon the adoption of said motion
and suspension of the said rulew and regulations, the :Poll
was called with the following results:
Voting Aye: Hoy-ard Ruge, 2-ayor,, C.A. Gaston, H.P.
Kamper, M.O. Berglin and.J.O. Stimpson, Councilmen.
Voting Nay: Ndne�.
Yayor declared the m \tion carried.
Councilman L.O. Berglin therefore moved that the
said Ordinance be finally passed and be adopted as into-
duced. Councilman H.P. Kamper seconded the motion.
The question being put upon the final passage and
adoption of said Drdinance, the Boll was called with the
following results:

Berglin, I.P. Kamper and J.O. Stimpson,. Councilmen.

Voting Nay: None.
Thereupon, the Mayor declared said motion carried and
the Ordinance finally passed and adopted. The Mayor
thereupon signed said Ordinance in approval of the same.
It was moved by Uouncilman H.P. Kamper'�7r and seconded by
Councilman M.O. Berglin that the Mayor be authorized
to arrange for the audit for the fiscal year ending Sept.
30th. :lotion carried.
BE IT RESOLVED: by the Town Council of the Town of Fairhope
that there be and is hereby levied for General purposes,
for the year of 1942, a tax of one-half of one percentun of
the value of all property and subject to taxation as assess-
ed for State Taxation during the preceeding year in the
Town of Fairhope.
BE IT FURT1172 RESOLVEDy that there be and is hereby levied
for the year 1942 for the purpose of acquiring, installing
and maintaining street lights and fire -fighting equipment
and for the purpose of constructing, acquiring, maintaining
and improving public buildings, parks and other public. pro-
perty. A special tax of one-half of one percentum of the
value of all property and subjects of taxation in the Town
of Fairhope as assessed for State taxation during the pre-
ceeding year.
BE IT FURTHER RESOLVED that R.C. Yohn be and is,hereby
designated as the person to make up the assessment roll
for the Town taxes levied by the i-esulution.
The rssulution was unanimously adopted.
It was duly moved and seconded that the meeting adjourn.
Motion carried.
