COUNTY OF BALDWIN
The Town Council of the Town of Fairhope met in regular session at
the Town Hall, December 9, 1940 at 7:30 P.M. with the following mem-
bers presents Howard Ruge, Mayor: Councilmen: H.P. Kamper, C.A. Gas-
ton,Sam Dyson and J.O. Stimpson.

It was moved by Councilman C.A. Gaston and seconded by Councilman
H.P. hamper that the Town raise the present $55.00 contribution
toward E.D.. Swift salary to $60.00 per mo. Motion carried.
On motion of Councilman C'.A. Gaston and seconded by- Councilman
J.O. Stimpson the following resolution was unanimously adopted:
WHEREAS by a local act of the legislature adopted and approved
on the_U day fff SEAT- 1939 the corporate limits of the Town of
Yairhope were extended and at the time of the extension of such
limits the Baldwin County Power Company owned and operated electric
light and power lines in a portion of the area so included in the
Town and
WHEREAS the Town has recently purchased from the Baldwin Cou-
nty Power Company a portion of such electric light and power lines
and the. said Baldwin '%ounty Power Company is operating the remain-
der of its electric lines in such &rea and is desirous of having
a_ franchise therefore
Now therefore, BE IT RESOLVED that the right and franchise
be and is hereby given and granted to the Baldwin County rower Com-
pany, subject to the limitations and provisions of this resolution,
to erect own operation and maintain electric light and power lines
in that portion of the Town of Fairhope north and west of the north
extremity of the Town light and power line in the Town of Fairhope
including the right to serve present customers along the present
lines of the Baldwin Gounty Power Company and with the right to
extend its lines to the north and serve present and additional
customers in the subdivision known as Seacliff and as well the use
of the streets, avenues and alleys in such area for the purpose
of erecting, operating and maintaining such lines provided however
that at any time after one year from date the Town may, after
giving ninety days notice to the Baldwin County Power Company,
revoke this resolution and the rights,: powers and privileges herein
given and provided further that in the exercise of the rights,
powers and privileges hereby in given the Baldwin County rower
Company shall not interfere with the full rights of the Town and
the public in the same for construction and maintainance thereof
and to the use of such streets,: avenues and alleys for travel over
and along the same and any sidewalks now or hereafter constructed
it
or used and for the purpose of laying, repairing and maintaining
water and sewer mains and connections therewith.
It was moved by Councilman H.P. Ka.mper and seconded by Councilman
Sam Dyson that the audit be accepted and ordered published..
Motion carried.
It was moved by Cou*cilman J.O. Stimgson and seconded by Council
man H.P. Kamper that $35.00 a month of five months be appropriated
to rent of Tourist Club and that the light and water service be
furnished for same length of time. Motion carried.
