COUNTY OF BALDWIN
The Town Council of the Town of Fairhope met in regular session
October 7, 1940 at the Town Hall at 7:30 P.M. The following
persons, elected at the Municipal election held September 16,
1.940, were presents. Howard Ruge, Mayor; Councilmen M.O. Berglin,
Sam Dyson, C.A. Gaston, H.P. Kamper and J.O. Stimpson, each
having taken the oath of office as prescribed by Section 279
of the Constitution of Alabama and the duelling oath as pres-
cribed by Section 2587 of the Code 19 23, and Howard Ruge pre-
siding, the Town Council of the Town of Fairhope was by him
duly called to order and the following business transacted:
On motion of Councilman C•A. Gaston, seconded by Councilman
Sam Dyson, the following resolution was read, put upon its
passage and duly adopted:
BE IT RESOLVED that E'valyn Berglin be and she is hereby
elected as Acting Clerk to serve as and have and exercise
the powers, duties and responsibilities of Clerk until such
time as a clerk shall be elected by this Council.
BE' IT FURTHER RESOLVED, that the :salary of the said Clerk
be and the same is hereby fixed at $75.00 a month, payable
on the first day of each calendar month commencing November
1, 1940.
Voting for the same, Howard Ruge, Mayor, Councilmen Sam Dyson,
C.A. Gaston, H.P. Kamper, and J.O. Stimpson. M.O. Berglin
not voting. Against the same, none.
Councilman M.O. Berglin offered the following ordinance:

BE IT ORDAINED BY TH^ TOWN COUNCIL OF TM T07TN OF FAIR-
HOPE AS FOLLOWSs
1. That at them first meeting held by each duly elected
Town Council of the Town of Fairhope a Chief of Police for
i the Town of Fairhope be elected to serve for the term co-
extensive with the term of the Mayor.
2. That the Chief of Police of. the Town of Fairhope
have and exercise all the f urisdiction, powers and privil-
eges Conferred upon its officers under the laws of the
State of Alabama.
3. That the Chief of Police of the Town of Fairhope
shall be paid for the services required of him the sum of
$1200.00 per year, payable in equal monthly installments
commencing on the first day of the calendar month. next
after his election.
4. All ordinances in conflict
same are hereby expressly repealed.

Said ordinance having been read in full, Councilman J.O.
Stimpson moved that all rules prohibiting the passage and
adoption of such ordinance at this meeting be suspended. Said
motion having been seconded by Councilman M.O. Berglin, was
put by the Mayor, voting for the same, Howard Ruge, lAayor;
Councilmen M.O. Berglin, Sam Dyson, C.A. Gaston, H.P. Kamper
and J.O. Stimpson; against the same, none.
Thereupon the Mayor declared such motion carried and the reg-
ulations prohibiting the passage of such ordinance at this
meeting duly suspended.
!Thereupon Councilman C .A. Gaston moved that the said ordinance
be put upon its immediate passage and the same having been read
in full, the said ordinance was put upon its immediate passage,
and on foll call, the following persons voted for the same:
Howard Ruge, Mayor; Councilmen: M.O. Berglin, Sam Dyson, C.A.
Gaston, H.P. Kamper and J.O. Stimpson; against the same, none.
Whereupon the Mayor declared said ordinance duly adopted and
approved the same.
On motion of Councilman M.O. Berglin, seconded by Gouncilman
J.O. Stimpson, J.H. Titus was duly elected Chief of Police,
voting therefor, Howard Ruge, Mayor; Councilmen Sam Dyson, M.O.
Berglin, C .A. Gaston, H.P. pamper and J.O. Stimpson; against
the same, none.
On motion of Councilman Sam Dyson, seconded by Councilman H.P.
Kamper, the following resolution was unanimously adopted.
BE IT RESOLVED, that the Town Council of the Town of Fair -
hope meeti in regular session on the second and fourth Mondays
of each calendar month at 7:30 P.M.
BE IT FURTHER RESOLVED, That bills and claims against the
Town of Fairhope shall be considered at the first meeting of the
' Town Council in each claendar month, provided the same shall have
been filed with the Mayor or Clerk of the Town on or before Sat-
urday at noon preceding the first meeting of each month herein
s provided for.
Be it FURTHER RESOLVED, That the compensation payable to
the Mayor of the Town of rairhope as such, and the compensation
l payable to him as Superintendent of the electric Sight and power
" system, and of the water and sewerage system of the Town of
Fair -hope, and the compensation of the Acting Clerk and the members of
the Town Council, and of the Chief of Police be paid on the first
day of each calendar month without the formality of bill filed
r' therefor and without previous order by the Town Council,. the Mayor
and Clerk being hereby authorized to issue checks therefor without
i further order of this Council.
BE IT FURTHER RESOLVED, That the salaries or other compen-
sation of all other persons now or hereafter employed by the
Town of Fairhope on a salary basis, or in a fixed monthly amount,
shall be paid on the loth day of each calendar month, and the
Mayor and Clerk be and they are hereby authorized to issue checks
therefor on the loth day of each calendar month without the form-
ality of the filing of a bill therefor and without further order
of this Town Council.
Said.mortion having been read in,full, was put u.on its passage and
unanimously adopted; voting for the same,
Councilmen: M.O. Berglin, Sam Dyson, C.A. Gaston, H.P. Kamper
and J.O. Stimpson; voting against the same, none.
On motion of Councilman M.O. Berglin and seconded by Councilman
A-.. Gaston the follo-wing. resolution was unanimously adopted:
- BE IT RT'SOhVvD by the Town Council of the Town of Fairhope
that the Mayor of the Town of Fairhope be and he is hereby auth-
orized and directed to employ W.C.-Beebe as Town Attorney and
to enter into contract with him to perform any and all legal

(4) years commencing(October 1st, 1940, sir and at the sum of
$600.00 per year, payab�le''ir-mmorrth"Ty installments of $50.00 each
on the loth day of each calendar month, such sum to be in full
for all services to be rendered by him to the Town of Fairhone,
but shall not include actual expenses incurred by him when out
of Baldwin County on business for the Town.
Voting for the same, Howard Ruge, Mayor; Councilmen Sam Dyson,
14.0. Berglin, C.A. Gaston, H.P. Kamper and J.O. Stimpson; voting
against the same, none.
The following committees were appointed by the Mayor:
