The Town Council of the Town of Fairhope met in regular session at.
the Town Hall, Monday, Jttly 8, 1940 at 7 t30 P.M.. with the following
members pr.esentt Howard Ruge, Mayor, Councilmen: H.P. Kamper, C.A.
Gaston, M.O. Berglin, Sam Dyson and J.O. Stimpson, the same cons.tit-
u.ting the full membership of the Town Council.
The minutes of the previous regular meeting were approved as read.

It was. moved by Councilman M.O. Berglin and seconded by
Councilman H.P. Kamper that the application of rhilipE.
Thompson for the erection of sign at the Central Cafe be
granted, subject to approved specifications. Motion carr-
ied.
It. was moved by Councilman C.A. Gaston and seconded by
Councilman J.O. Stimpson that the proposal of the Commercial
Soft Ball League be approved by the Town and the light rate
of $1.00 per team per game be adopted. Motion carried.
The following resolution was offered by_C ouncilman C.A.
Gaston and seconded by Councilman J.O. Stimpson: and passed
unanimously.
WHEREAS certain residents of the Tmmm of Fairhope res-
iding on Volanta Ave: have petitioned the Town of Fairhope
to make the T:own's electric service available to them, there-
fore.::
BE IT RESOLVED that the Mayor be insturcted to take such
steps as may be necessary to extend electric service to such
petitioners.
On motion of Councilman H.P. Kamper and secnriddd by louncil-
man J.O. Stimpson the following resolution was offered:

BE IT RESOLVED BY THE TMN COUNCIL OF THE T9,7N OF FAIR -
HOPE, AL.z1BAMA :
First: That an election is hereby called and ordered to
be held -in the town of FairhopeAlabama,
y , Alabama , on the �th day of August,
1940,,for the purpose of determining whether or not a majority of
the qualified electors of the town of Fairhope, Alabama, favor the
town's levying and collecting five mills excess rate of taxation

for the years 1940 to 1944 both inclusive, for the purpose of ac-
quiring, installing and maintaining street lights and fire fighting
equipment and for the purpose of constructing, grading, -draining,
maintaining and improving public streets, avenues and sidewalks,
and for the purpose of constructing, acquiring, maintaining and
improving public buildings, parks and any other public property.
Second: BE IT FURTHER RESOLVED that said election shall be
held at the town ball in the town of Fairhope, Alabama, on the IRth
day of Kugust, 194. , that the polls be kept open between the hours
of 8 A. M. and 5 P. M., and that the following are hereby appointed

Third: BE IT FURTHER RESOLVED, that the Mayor and Clerk
cause notice of said election and of the proposition to be voted on
to be given by publication once a week for three consecutive weeks,
the first publication being 30 days before the day of the election,
in the Fairhope Courier, a newspaper` published in Fairhope, Alabama,
in its issues of July A, July and �-, 1q�0, that the said

notice shall be substantially in words and figures as follows:
NOTICE OF SPECIAL MI]NICIPAL TAX ELECTION.
By authority of and in compliance with ^a resolution of
the Town Counci Qf they own of Fairhope, Alabama,,adopted on
the"8th day of lye, 194, notice is hereby given that a spe-
cial election has been and hereby is walled and ordE dito ,
hel in the town of Fairhope, at the town hall, on KU' ust ,
1940, between the hours of 8 A. M. and 5 P. M., to determine
whether or not a majority of the qualified electors of,the
town of Fairhope, Alabama, favor levying and collecting by the
town of Fairhope, Alabam five mill excess rate of taxation
for the years 194b to 194.E both inclusive, for the purpose of
acquiring, installing and maintaining street lights and fire

Fourth: BE IT FURTHER RESOLVED, that the Mayor and Clerk
be and are hereby authorized 'and directed to notify said officers of -
their appointment to hold said'election and to prepare and to deliv-
er to said election officers herein named 'all necessary ballots and
other necessary election supplies and equipment; and that the ballot
to be supplied therefor be in words and figures as follows:

BE IT FURTHER RESOLVED, that said election be called,
held and the results thereof canvassed and returned in all respects
in full compliance and in strict conformity with the laws applicable
to municipal corporation elections for the issuance or municipal
bonds.
The foregoing resolution having been read was put upon its
passage and on roll call the following Councilmen voted for the
same: Councilmen H.P. Kampen, 'J.O. Stimpson, 112.0. Berglin, Sam
Dyson and C.A. Gaston and Mayor Howard Ruge voting "Yes", Voting
"No" None.
Whereupon the Mayor d6clared the Pesol.ution duly ad6pted.

carried.
