The Town Council of the Town of Fairhope, County of Baldwin, Alabama, met in regular, session at Town Hall at 7:30 o'clock P. M. , on the 8 day of April, 1940, when and where the following members were present, to -wit: Howard Ruge, Mayor; I.I. 0. Berglin, San Dyson, C . A. Gaston, H. P. Kamper and J. 0. Stimpson; the same constituting the full membership of the Town Council. The following business was transacted: Te following ordinance was offered by Councilman and he.sa'd ordinance having been read in full, C oiticilman moved its adoption, Coun- cilman econded the motion; whereupon the said ordinance and the said motion were ordered to lie over for further consideration at the next regular meeting of the Town Council: BE IT ORDAINED ALAB.P1,1A: ORDINANCE NO. /•J O BY THE TOXIN COUNCIL OF THE TOUN OF FAIRHOPE , Section 1. Every person, firm, company, corporation or association, receiver or trustee, but not governmental subdi- vision, engaged in any business, vocation, occupation, calling or profession herein enumerated, or who shall exercise any privilege herein described, for which a license or privilege tax shall be t required, shall first procure a town license and shall pay for the same, or shall pay for the exercise of such privilege the a amounts herein provided, and comply with all provisions Of this ordinance. SCHEDULE: No. 1. TELEPHONE COMPAT71Y EXCHANGES: Each person, firm, ` corporation or association operating or conducting a telephone ex- change or exchanges, per year $40.00. No. 2. TELEPHONE COMPANIES, LONG DISTANCE: Each per- son, firm, corporation or association operating a long distance . telephone or telephones shall pay for the privilege of doing in- tra-state business, per year $10.00. No. 3. TELEGRAPH COMPIU�TIES : Each person, f irm, cor- poration or association conmercially engaged in business in this Town and sending messages from the Town to any part of the State or from any part of the State to the Town (it is not the purpose hereof to tax interstate or foreign messages or any United States business), per year $25.00. No. 4. INSURANCE COMP11NIE , OTHER THAN FIRE AND 1 ARINE: Each insurbLnce company other than fire, marine and fraternal, shall pay an annual license of �10 plus $1 on each w100 and major frae- tion thereof, of. gross premiums, less returned premiums on poli- cies issued during the preceding year to citizens of the Tower. of Fairhope, provided that in case such company shall not have con- ducted business for the full period of said preceding year, it shall pay 010.plus one per cent of that amount which bears the same relationship to the gross amount of premiums, less return premiums, on policies issued during said preceding year as 365 bears to the number of days during which business was conducted in such preceding year. Companies commencing business after the first of the current license tax year shall pay 010 plus $1 on each 0100 and major fraction thereof of gross premiums, less return premiums, on policies issued during the said current year to citizens of the said Town of Fairhope. Such new companies shall pay a flat minimum of 010 at the time of commencement of business upon which there shall be an adjustment at the end of the year upon the basis hefein provided for new companies, provided that in no event shall the li-• tense of any such new company be less than 010. License'under this 4 schedule and the next succeeding schedule shall be deemed delinquent the first day of Idarch of each year., There shall be no pro -ration ' of the $10 deposit required of new companies entering into business' R in the city during the year. No. 5. INSURANCE C 01,1PAN ES , FIB AND 11I RINE : Each fire insurance company $2.50 on each $100 of gross premiums, less return premiums, received on policies issued during the preceding year on { property located in the Town of Fairhope, provided that in case such company shall not have conducted business in the Town of Fairhope dur- ing the entire period of the preceding year, it shall pay 22 per cent. of that amount which bears the same relationship to the gross amount " of premiums, less return premiums, received on policies issued dur- ing the said preceding year on property located in said Town as 365 bears to the number of days during which such company conducted busi- ness in said Town. Companies commencing business after the first �- of the current ' license tax year shall pay ;?2.50 on each A100 of �t gross premiums, less return premiums, received on policies issued du--ing the said current Near on property located in the Town of Fairhope. Such new companies shall pay a flat minimum license of 015 at the time of the commencement of business upon which there shall be an adjustment at the end of the year upon the basis herein provide(. for such new companies, provided that in no event shall the license of any such new company be less than �15. There is to be no pro -ration of the 015 deposit required of new companies entering into business in the Town during the year. Section 2. Every person, firm, company, corporation or association, receiver or trustee, but not a governmental subdivi- sion, operating without the corporate limits of the Town of Fairhope, but within the police jurisdiction thereof, engaged in any business, vocation, occupation, calling or profession enumerated in Section 1 hereof, or who shall exercise any privilege therein described, and for which a license or privilege tax is therein required, shall first procure a town license from the town of Fairhope and shall pay for the same or shall pay for the exercise of such privilege, one- half of the amount required for the operation of such business with- in the corporate limits. Section 3. Every person, firm, company, corporation or association, receiver or trustee, but not a governmental subdivi- sion, engaged in any business, vocation, occupation, calling or profession within the corporate limits of the town of Fairhope, or within the police jurisdiction of the town of Fairhope, shall pay the license required in this ordinance on July 1, 1940, and on January 1, 1941, and annually thereafter, and if any person shall commence to engage in any such business, vocation, occupation, calling or profession after January 1st, before engaging therein he shall pay the license tax required by this ordinance. The li- cense when issued hereunder shall be for the calendar year in which the same is issued and shall expire on December 31st of each year. Provided, however, that if any person shall commence to engage in s any such business on or after July lst of each year, only one-half the license herein provided shall be required. Section 4. It shall be unlawful for any person to en- gage in any business for which the license is required under Sec- tions 1 and 2 hereof without having first applied for and obtained the said license and paid the said license tax, and upon conviction thereof shall be fined not less than $1.00 nor more than p100.00 for each day in which such business was engaged in without such license. Section 5. The Mayor, Clerk and Town. of Fairhope, Ala- bama, shall have power and authority to issue all licenses required in Sections 1 and 2 of this ordinance, and the said Mayor and Town Clerk shall have the power and authority to require sworn statement as to the amount of capital or stock or the amount of sales or stock invested, or value of goods, receipts, where the amount of license is made to depend thereon, and any person, firm, company, corporation or association, trustee or receiver, but not govern- mental agency, failing or refusing to make such statements or mak- ing false statements in reference thereto when required to furnish proper officers with such statement, shall,be guilty of a misde- meanor and upon conviction shall be fined not less than $1.00 nor more than 0100.00 for each offense. Section 6. This ordinance shall not repeal any ordinance heretofore adopted licensing any business other than those licensed herein, and the provisions and schedules of this ordinance are sev- erable and if any of the same shall be invalid for any reason, such invalidity shall not invalidate any other provisions or schedule of this ordinance. Kamper that the renewal of fire insurance on the 120 and 180 electric units in the amount of $150000,00 be authorized. Motion carried. It was moved by Councilman C.A. Gaston and seconded by Council- man M.O. Berglin that the commercial electric schedule be amended as presented by the Mayor fo� become effective with the May billing. Motion carried.
