The City Council, City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 23 September 2024.

Present were Council President Corey Martin, Councilmembers: Jack Burrell,
Jimmy Conyers, and Kevin Boone, Mayor Sherry Sullivan, City Attorney Marcus E.
McDowell, and City Clerk Lisa A. Hanks . Councilmember Jay Robinson was absent.
There being a · quorum present, Council President Martin called the meeting to
order at 6:06 p.m . The invocation was given by Pastor Pat Davey of Eastern Shore
Presbyterian Church and the Pledge of Allegiance was recited. Councilmember
Conyers moved to approve minutes of the 9 September 2024, regular meeting; and
minutes of the 9 September 2024, work session. Seconded by Councilmember
Burrell , motion passed unanimously by voice vote.
Mayor Sullivan addressed the City Council and read the following statemen
on behalf of herself and the Fairhope City Council:
First, I want to speak to rumors and citizen communications about alleged
resettlement of large numbers of immigrants in our community. To be clear, we
have not seen or received any official notification of that happening -nor is it
expected to happen -in Fairhope .
As you all know, Fairhope city officials don't write our national immigration laws ,
and our country has been debating immigration for as long as we've had a country.
It is an issue where good and well-meaning people can and do disagree.
Councilman Martin is one of those well-meaning people who signed what he
thought was a simple petition to support the women and children impacted by the
Ukrainian War. He never intended on bringing legal immigrants to our area . I want
to make sure our residents understand that Council members have no power
individually. To have power, the Council must be in session and/or pass a resolution
or ordinance by a majority vote. They did not pass an ordinance or resolution in
support of this petition . Councilman Martin signed this as an individual citizen and
not as a public official.
As a City, we do not support nor do we have the resources to provide for large-scale
resettlements of new arrivals to our country, specifically in Fairhope. I and other
Fairhope officials have been in close contact with our federal delegation and state
officials on this issue. We are appreciative of their open lines of communication,
ongoing assistance , and responsiveness to local needs and insights .

I want to personally thank the City Council , our Federal and State elected officials ,
State Representative Jennifer Fidler and members of our Baldwin County
Legislative Delegation, Baldwin County Commissioner Matt McKenzie and the
Baldwin County Commission , Baldwin County Sheriff Anthony Lowery and
Sheriff Hoss Mack of the Alabama Sheriff 's Association . We have been
communicating all weekend to navigate this very complicated conversation . I want
to assure the residents of Fairhope and Baldwin County that all your elected
officials from the federal level to the local level are working together and do not
take this situation lightly.
The laws surrounding immigration are complex and change frequently, and too
often , the tasks of enforcement and providing resources fall on the local
communities that are least-equipped to deal with the challenges. In Fairhope , we
will enforce these laws , but we have little say in how they are written . We will also
enforce all local laws to make sure our community and citizens are safe.
Our country has a long and proud history as a safe haven for those fleeing
oppression, but our country also has a responsibility to ensure that immigration
does not place undue burden on our citizens and our limited resources . Enforcing
immigration laws and fixing our flawed system should be a top priority of the
federal government, and that conversation should include the perspectives of local
officials with on-the-ground knowledge.
Mayor Sullivan thanked Community Affairs Director and her staff, and
everyone who volunteered for Coastal Cleanup this past Saturday. She thanked City
Treasurer and her staff for their work on the budget. Mayor Sullivan said she would
be watching tropical updates for Hurricane Helene. She announced the Homecoming
Parade for Thursday.
Mayor Sullivan introduced the 2024 -2025 Junior City Council: Jillian
Nichols (President), Jenna Kowal (President Pro Tempore), Audrey Small (Project
Manager), Erin Foutch (Social Media Manager), Grant Kelly (Secretary), Celia
Cocke, Epsie Dorman , William Garner, Camille Hausman, Ezra Langley, George
Talbot , Teagan Lanicek (Ex Officio Member -SGA President), and Aidan Berry (Ex
Officio Member -SGA Vice President). Mayor Sullivan thanked City Clerk Lisa
Hanks and Assistant City Clerk Jenny Wilson for taking them on and working with
the Junior City Council.
The following individuals spoke during Public Participation for Agenda Items :
1) Don De Gutz , 110 Blakeney Avenue, addressed the City Council regarding
Agenda Item Number 10 : a resolution that the City Council authorizes
acceptance of a Department of Justice Appropriations Act grant of $200 ,000 .00
(Grant# l SPBJA-24-GG-00286-BRND). The funding will be used to develop a
comprehensive , community-based program to educate school-aged children and
adults on the dangers of Fentanyl and life-saving techniques if exposed . He
mentioned a Board of Adjustment item that was approved for a vaping and BD
store. He commented that it should have come to the City Council for approval.

2) Dev Wakeley, 8856 Lake View Drive , addressed the City Council regarding
Agenda Item Number 6: an ordinance to amend Ordinance No. 1800 : VI. Leave
Policies , Section C. Sick Leave; specifically adding 10. Paid Sick Leave
Donation . He suggested adding paid parental leave and do an actuarial study for
same .
Councilmember Burrell commented he received multiple texts and e-mails
regarding refugees being brought to Fairhope. Councilmember Burrell said he
appreciated everyone for coming out tonight; and said call us and have a little faith.
He said Council President replied to an e-mail in 2022 regarding women and children
being displaced from Ukraine War. Councilmember Burrell said there was no hidden
agenda ; and it is tough out there with social media. He said we would push back if the
Federal Government tried to place immigrants here.
Councilmember Conyers said he loves seeing the Junior City Council here
and sees many familiar faces. He said stories on social media have legs; and agreed
with Councilmember Burrell . He said we have not heard any reliable source saying
they were sending immigrants to Fairhope; and if they tried , we could push back.
Councilmember Boone stated he does not do social media. He said when I
read the article, I lost 30 minutes.
Council President Martin said he answered a 2022 e-mail in the height of
Ukraine War when women, children, and the elderly being displaced, murdered, and
killed. He said "I hope and pray that those of you that know me know that I don't
believe in anything illegal. So, it kind of hurt me at first when people took that, with
all the work that I've done and put into this community, that they would just believe
such a thing as if, without calling and the people that did call me, I really appreciate
you guys. As a city, we do not support, nor do we have the resources to provide for
large scale resettlement of new arrivals to our country, specifically in Fairhope."
He went on to say, "I did my due diligence on this particular program, USARP. It is
legitimate. The people, the refugees are vetted . They have to fill out applications .
They have to go through the IFIC before they get into the country. They are vetted .
They can be refused. It is a legal process. Once I did my due diligence, I decided to
sign in support. I thought it was important that the women and children of Ukraine
were taken care of."
Council President Martin also said it was a national letter intended to strengthen
support for Congress to continue to build a robust USARP, and it has nothing to do
with him asking for immigrants or refugees to move to Fairhope. Council President
Martin said we are in this thing together; and the Campaign was to work together.

Councilmember Burrell moved for final adoption of Ordinance No. 1812 , an
ordinance to amend Zoning Ordinance No. 1253 and to rezone the property of
Christopher Lieb form R-1 , Low Density Single-Family Residential District to B-4 ,
Business and Professional District with Staff recommendations. The property is
approximately 0.69 acres and is located at 7671 Parker Road. PPINS #: 98380, 7684 .
(Introduced at the September 9, 2024 City Council Meeting) Seconded by
Councilmember Conyers , motion for final adoption passed by the following voice
votes : AYE -Burrell , Martin, Conyers , and Boone. NAY -None ..
Councilmember Boone introduced in writing an ordinance to amend
Ordinance No. 1800: VI. Leave Policies , Section C. Sick Leave ; specifically adding
10. Paid Sick Leave Donation. Due to lack of a motion for immediate consideration,
this ordinance will layover until the October 14 , 2024 City Council meeting.
Councilmember Conyers introduced in writing an ordinance to repeal and
replace Ordinance No . 1756: Fairhope Code of Ordinances: Article VI , Garbage and
Trash Collection and Disposal -Section 21-75 : Rates . Due to lack of a motion for
immediate consideration , thi s ordinance will layover until the October 14 , 2024 City
Council meeting.
Planning Director Hunter Simmons addressed the City Council to explain the
request by FST RW LLC for a 180-day extension of the Site Plan approval granted
for the property located at the northeast comer of Magnolia Avenue and North Church
Street know as Vatan. The Site Plan was approved on October 23 , 2023 .
Councilmember Burrell moved to grant the 180-day extension by FST RW
LLC listed above. Seconded by Councilmember Conyers , motion passed
unanimously by voice vote .
Councilmember Burrell introduced in writing, and moved for the adoption of
the following resolution , a resolution that the City of Fairhope supports the Baldwin
County Multimodal Connectivity Vision Plan and will u se it as a planning guide for
future projects in order to gain benefits mentioned above and strengthen the quality of
life within Baldwin County. Seconded by Councilmember Conyers , motion passed
unanimously by voice vote. The Baldwin County Trailblazers and the Bicycle and
Pedestrian Committee were thanked for their work on thi s Plan.

RESOLUTION NO. 5191-24
RESOLUTION OF SUPPORT FOR BALDWIN COUNTY
MULTIMODAL CONNECTIVITY VISION PLAN

WHEREAS, the Baldwin County Trailblazers requested the Baldwin County Commission
facilitate an effort among its 14 municipalities to develop a county-wide bicycle-pedestrian
plan; and
WHEREAS , the Baldwin County Multimodal Connectivity Vision Plan addresses both
bicycle and pedestrian needs , with a focus on connecting missing links in the network that
provides for connectivity, safety, and additional modal choices to residents and visitors within
Baldwin County and to encourage walking and biking as viable options for commuting and
recreational purposes ; and
WHEREAS, Municipalities can use the county-wide map as a reference tool to guide future
infrastructure development as well as make grant applications for its buildout and
maintenance more attractive to funders ; and
WHEREAS , the City of Fairhope supports programs that promote health , wellness , and
provide safe and accommodating bicycle and pedestrian infrastructure ; now
THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, That the City of Fairhope supports the Baldwin County
Multimodal Connectivity Vision Plan and will use it as a planning guide for future projects in
order to gain benefits mentioned above and strengthen the quality of life within Baldwin
County.

the following resolution, a resolution that the City Council authorizes Mayor Sherry
Sullivan to execute an extension of the PFM Financial Advisors , LLC Engagement
Letter Agreement for the City of Fairhope for Professional Consulting Services as
Financial Advisor for year-long services with a not-to-exceed retainer of $20,000.00.
This professional service is exempt from formal bidding per Code of Alabama 197 5,
Section 41-16-51 (a)(3). Seconded by Councilmember Conyers , motion passed
unanimously by voice vote.

WHEREAS , the City of Fairhope did solicit Requests for Proposals (RFP 002-19 -
Program Administrative Services for Working Waterfront and Green Space Project) in
accordance with applicable federal , state and local laws , codes, regulations,
ordinances , etc., including, but not limited to all executive orders (EO), Office of
Management and Budget (0MB) requirements , and U.S . Treasury Regulations ; and
WHEREAS , on August 26 , 2019 the City Council awarded RFP 002-19 to Grant
Management, LLC for ADCNR Grant #M1A14-FHWW; and
WHEREAS , on August 14, 2024, ADCNR issued Amendment No. 3 to the grant,
that extends the period of performance to October 31, 2026 ; and
WHEREAS, the current period of performance for the Program Administration
Contract ends on October 31 , 2024 ;
BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, that the City Council approves Amendment No. 2 to RFP

Councilmember Bun-ell introduced in writing , and moved for the adoption of
the following resolution, a resolution that the City Council hereby authorizes Mayor
Sherry Sullivan, on behalf of the City of Fairhope, to execute a purchase agreement
and all closing documents related to the sale of the Barnwell "Recreation" Land
Property (PPIN 6877) from Most Rev. Thomas J. Rodi , Archbishop of Mobile, a
Corporation Sole , for a purchase price of $1.1 million ; and allocated funding out of
the Reserves. Seconded by Councilmember Conyers , motion passed unanimously by
voice vote. In order to annex this property, it would be done via a Legislative Act.

the following resolution, a resolution that the City Council hereby authorizes Mayor

Councilmember Conyers moved to grant the request of Fairhope East K-6
Parent Teacher Corporation in collaboration with the Fairhope West Parent Teacher
Partnership and J. Larry Newton Parent Teacher Organization, are requesting
permission to close the streets in downtown Fairhope on Saturday, February 8 , 2025 ,
from 6:00 a.m. to 10:00 a.m. for the 10th Annual "The Pirate Dash"; and requesting
electricity at the starting/ending point of the race on the bluff with barricades at major
road intersections to protect our runners . The Pirate Dash will begin and end at the
same location on Magnolia Avenue on the bluff (Henry George Park). Seconded by
Councilmember Boone, motion passed unanimously by voice vote .
Council President Martin said to the audience, "please do not repeat or be
redundant with your comments .
The following individuals spoke during Public Participation for Non-Agenda
Items:
1) Donna Allsup , 11623 County Road One, addressed the City Council regarding
the refugee letter/petition sent to Washington , D.C. She said there is no division
but concerns with social media . She said it should have been shared with the
community before acting.

2) Ann Seeley, 8528 Lake View Drive, addressed the City Council regarding the
refugee letter/petition sent to Washington, D .C. Ms . Seeley said she contacted the
Lieutenant Governor Will Ainsworth 's office , Governor Kay Ivey 's office, and
Congressman Jerry Carl's office . She was told it is a Federal issue. Ms. Seeley
said Alabama towns have received no notice ; they just show up.
3) John Cutright, 434 Colony Drive , addressed the City Council regarding the
refugee letter/petition sent to Washington, D .C. He said my heart's good and
don 't make fun of us . He said it is my civic duty to show up. Mr. Cutright said
this is a good community and safe.
4) County Commissioner Matt McKenzie addressed the City Council and said
donating sick leave is great. He mentioned the 8 million for park and the agenda
was awesome . He said the County has not been made aware of an influx of
migrants to the area by any officials . Other cities across the state, such as
Sylacauga, confirmed they were not alerted by federal officials when migrants
moved into their area .
5) State Representative Jennifer Fidler addressed the City Council regarding the
refugee letter/petition sent to Washington, D .C. Representative Fidler said she
researched too and what she found out agrees with Ms . Seeley. She said we do
not know where they will be dropped off; and most have been in communities for
poultry workers . Representative Fidler said she has not found the "point person"
who runs this program . She said one main issue is insurance; and another issue is
not speaking the English language with upwards of 40% of our students who
speak non-English. She mentioned most have a sponsor and a card. She told the
audience her office is at the Satellite Court House.
6) Jody Harper, 104 Cliff Drive, addressed the City Council regarding the Water
Front and Greenspace Project. She questioned the railings on the pier being
replaced; and when did the City begin making all of the decisions. City Clerk
Lisa Hanks responded in the 1930s.
7) Abby Unrath, citizen of Magnolia Springs , addressed the City Council regarding
the refugee letter/petition sent to Washington, D.C . told the emotional story of the
deaths of her mother-in-law and another woman, who were both killed in a crash
caused by a Haitian immigrant in Michigan . "I'm a mother, a Christian," she
continued . "I'm not racist. I'm compassionate, I'm not a bigot. And I'm certainly
not a pretentious and entitled . I'm a wife. I'm a mom . I seek to be compassionate
and caring and understanding."
8) Rebecca Watson , 124 Fig Avenue, addressed the City Council regarding the
refugee letter/petition sent to Washington, D .C. She we are here because of the
letter you signed on behalf of the City. Ms. Watson said in December she was hit
by an illegal immigrant who did not have insurance. She said if they come , they
should follow our laws.
9) Brian Dasinger, 115 Keplar Place , addressed the City Council regarding the
library books and the resolution he and other groups submitted . He said there was
a "Drag Show" in the Fairhope Civic Center last year; and the Fourth Annual
Pride Event will be held in October. Mr. Dasinger said , "are you willing to do
something? Do something or we will make a change ."

10) Trae Corte, 101 Spring Park Drive, addressed the City Council regarding the
refugee letter/petition sent to Washington , D.C . He requested that Council
President Martin write a letter stating the citizens do not want this and resend
your position on this issue .
11) Doug Greengard, 311 Wakefield Avenue , addressed the City Council regarding
the library books being an issue; and the Drag Queen Show being a sexually
oriented event. He said man is known for his deeds.
12) Linda Dooley, 901 Gayfer Avenue, addressed the City Council regarding the
refugee letter/petition sent to Washington, D.C . She said we need a written plan;
and asked how you are going to handle these people . Ms . Dooley stated, "we do
not know if you are trustworthy."
13) Debra Fisher, 430 Rothley, addressed the City Council regarding the refugee
letter/petition sent to Washington, D .C. Ms. Fisher said she was against the
refugees; and we need to put a plan in place. She said it puts burden on growth,
schools, and medical fields.
14) Diana Yum-Bucher, 127 Oakbend Court , addressed the City Council regarding
the refugee letter/petition sent to Washington, D .C. She said it is going to happen;
and what plan do you have. She commented that the medical system is strained.
15) Sue David , 135 D 'estrehan Street, addressed the City Council regarding the
refugee letter/petition sent to Washington , D.C. Ms. David said she ran away
form a community in Washington; and lived near an elementary school bus stop
where she found heroin needles. She said we have laws and need to abide by
them .
16) Cheryl Corvo , 20 Burlington Drive, addressed the City Council regarding the
refugee letter/petition sent to Washington, D.C. She said we are a welcoming
community. She commented we need to take a look at Mobile Baykeepers; and
take a look at our environment.
17) Edward Bals , 502 Calibre, addressed the City Council regarding the refugee
letter/petition sent to Washington , D.C. Mr. Bals said he has 33 years in law
enforcement; spoke about the Somalians and a drug similar to heroin . He asked is
Fairhope Police Department ready to handle this.
I 8) Debbie Greengard, 311 Wakefield Avenue, addressed the City Council regarding
the library books ; and the Drag Show and brunches. She said you have awakened
a sleeping giant.
19) Stephanie Durnin , 209 Hemlock Drive , addressed the City Council and stated the
Council has failed. She said you refused to take a stand regarding the library
books and Drag Shows, and Council President Martin wanted to do away with
public comment. Ms . Durnin said you are all on notice; and your jobs are going
to be short.

20) Dev Wakeley, 88 56 Lake View Dri ve, addressed the City Council regarding the
refugee letter/petition sent to Wa shington , D.C. He said those expressing
concerns are all a part of a political movement. Mr. Wakeley added the
movement is meant to create outrage, take over, attack and hurt . He said, "Folks,
I have stood in front of the League of the South; I've stood in front of the Klan
and this is the Klan in slacks."
21) Devon Rigsby, 15875 Keeney Dri ve, addressed the City Council regarding the
refugee letter/petition sent to Washington, D .C. He mentioned in 2020 being sent
overseas to work, counter terrorist activist, and in 2015 working in "Lone Wolf '
incidents against ISIS. He said fear has been introduced regarding the refugee s;
and we need to vet the se people before allowing them to come here .
22) Betty Riley, 31 7 Lake Ridge Drive, addressed the City Council and asked, "Can
one Councilmember use his title to make a decision." City Attorney Marcu s
McDowell replied, "no one Councilmember can make a decision without the City
Council approval."
Councilmember Conyers said we do not support a massive influx on illegal
refugees; and we need a plan to react when this may happen .
Councilmember Burrell said, there was nothing we could communicate; and a
plan may be good but could be bad too .
23) Monetia Martin, 829 Summer Lake Street , addressed the City Council regarding
the refugee letter/petition se nt to Washington, D .C. Ms. Martin said she was
Corey Martin's wife; and if this letter came out in 2022, then no one would have
said anything.
Sh e said these are not illegal immigrants ; and the reporter/person from 1819
came to Cory after the article was written. Ms . Martin said the reporter tainted
everything; and said this is a resettlement program .
Ms. Martin told the City Council that they were doing a very good job. She told
the audience, "I am putting you on notice , and if you think you could do a better
job, bring it on ."
24) Sharon Coffee, 18172 South Section Street, addressed the City Council and said,
"we the people," everyone has one vote; and the way to take care of this is we
need to change the Federal Administration in Washington , D.C.
25) Stephan Sofianos, 20260 Azul Avenue, addressed the City Council regarding the
refugee lette r/petition se nt to Wa shington , D .C. He said we do not want to be
overwhelmed. Mr. Sofianos said, "do what you preach and repre se nt us ."
Councilmember Conyers moved to adjourn the meeting . Seconded by
Councilmember Boone, motion passed unanimously by voice vote.
