The Council of the gown of xairhope , County of Baldwin, Alabama, met in regular session at the Town Hall at 7:30 o'clock P. M.,. on the 24th day of February, 1936, when and where the following members were present, to wit: Howard Ruge, hlayor; M. 0. Berglin, C. A. Gaston, W. 0. Keeble, T. J. Klumpp and J. 0. Stimpson, Councilmen; the same constituting the full member ship of the 'Town Council. The following Ordinance No. 137' and entitled e 6 U f J AN ORDINANICS. NO. 137 To call and order an election to be held in and by the qualified electors: of the Town of Fairhope, in Baldwin County, Alabama, voting at an election to be held on the 31st day of March, A. D., 1936, at the: Town Hall of Fairhope, the only place of voting, for the voting upon and deciding the question as to whether or not the negotiable coupon bonds of said municipality to the amount of Forty-two Thousand ($42,000. 00) Dollars shall be issued for the purpose of refunding an outstanding bonded indebtedness, of Twelve Thousand ($120000.00) Dollars, issued October 15th, 1927, for the purpose of building a fill across, Bgyou Charbon on Section Street in Fairhope, Ala- bama, and maturing October 15th, 1937, and Thirty Thousand ($300'000:00) Dollars, in outstanding municipal obligations aris- ing from the acquisition of property for public use and the con- struction of improvements in, and the funding of floating debts of said municipality; said bonds, if issued, to be issued in denominations of One Thousand ($1,000.00) Dollars each, and to bear interest from the date of issuance at a rate not to exceed six per cent (6%) per annum, payable semi-annually, and to mature as follows: Two Thousand ($2,000.00).Dollars on the First day of May, of the years 19370 1938, 19392 1940, 1941, 194a, respective- ly; Three Thousand ($3,000.00) Dollars on the First day of May, of the years 1943, 19440 1945, 1946, 1947, and 1948, respectively; and Four Thousand ($43,000.00) Dollars on the First day of May, of the years 1949, 1950 and 1951, respectively; said bonds as to interest and principal to be payable in lawful money of the United States of America, at the Bank of Fairhope, in Fairhope, Baldwin County, Alabama. was in&roduced by J. 0. Stimpson, read in full by the Clerk and considered by the Council, said ordinance being as follows: - 2w BE IT ORDAINED BY THE MAYOR AND COUNCILMEN OF THE TOWN OF FAIRHOPE, BALDWIN COUNTY, ALA- BAMA, AS FOLLOWS: SECTION ONE: That there shall be and there is hereby called and ordered an election to be held in and by the qualified electors of the Town of Fairhope, -in Baldwin County, Alabama, on Tuesday, the 31st day of March, 1936, at the Town Hall of said Town, the only place of voting, for the purpose of voting upon and deciding, by ballot, the question as to whether or not negotiable coupon bonds of said municipality to the amount of Forty-two Thousand ($42,000:00) Dollars shall be issued for the purpose of refunding an outstanding bonded indebtedness of Twelve Thousand ($la#000.00) Dollars, issued October 15th, 19272 for the purpose of building a fill across: Bayou Charbon on Sec- tion Street in Fairhope, Alabama, and maturing October 15th, 1937, and Thirty Thousand ($30,000.00) Dollars in outstanding municipal obligations arising from the acquisition of property for public use and the construction of improvements in, and the funding of floating debts, of said municipality; said bonds as to interest and principal to be payable in lawful money of the United States of America, at the Bank of Fairhope, el ew 3w in Fairhope, Baldwin County, Alabama4, SECTICI TWO: That notice of said election shall be given by publication in the Fairhope Courier, a newspaper pub- lished in Fairhope, Baldwin County, Alabama, once a week for three successive weeks, the first publication to be made at least thirty days before the election, and which notice shall be substantially in the: following form: NOTICE OF ELECTION Notice is hereby given that a special election will be held in the Town of Fair - hope, Baldwin County, Alabama, at the Town Hall, Tuesday, March 31st, 1936, for the purpose of deciding the question as to whether or not the Town of Fairhope issue its negotiable coupon bonds to the amount of Forty-two Thousand ( $42, 000.00 ) Dollars for the purpose of refunding an outstanding bonded indebtedness of Twelve Thousand ($1.2,1 000*00) Dollars, issued October 15th, 1927, for the purpose of building a fill across Bayou Charbon on Section Street in Fairhope, Alabama, and maturing October 15th, 19379 and Thirty Thousand ($30i"000.00) Dollars in outstanding municipal obligations arising from the acquisition of property for public use and the eonstruction of improvements in, and the funding of floating debts: of said municipality; Cliftor, as returning officer; that said officers shall qualify and hold said election and make their return, as required by the Statute and laws of the State of Alabama. SECTION FIVE: The Mayor and Town Council of the Town of Fairhope, Alabama, shall meet at the Town Hall in the Town of Fairhope, Alabama, on Wednesday, the first day of April, 1936, at 8:00 o'clock P. M. and canvass the returns and declare the W result of said election and transact such other business in the premises as may be required or authorized by lava'. Mayor. 0 It.iwas,moved -by -C. The question being upon the adoption of said motion and the suspension of such rule, the roll was called with the following re- sults: .AYES:. Howard Huge., -Layor; M. 0. Berglin, C. A. Gaston, W. -0. Keeble, T. J. Klumpp and J. 0. Stim, son, Councilmen. NAYS: None. The Mayor declared said motion carried and such rules suspended. Councilman W. 0. Keeble then moved that Maid ordinance be now placed upon its final passage. Councilman T. U. Klumpp seconded the motion. The question being put upon placing of said ordinance upon its final passage, the roll was called with the following results. AYES: Howard Kuge, Mayor; LI. 0. Berglin, C. A. Gaston, W. 0. Keeble, T. J. Klumpp and J. 0. Stimpson, Councilmen.. NAYS: done The Mayor declared thh motion carried. Councilman C. A. Gaston thereupon moved that the said ordinance be finally passed and adopted as introduced and read. Councilman M. 0. Berglin seconded the motion. The question being put upon the final passage ant adoption or said ordinancq the roll was called with the following results: AYES: Howard Huge, Mayor; M. 0. Berglin, 0. A. Gaston, W. 0. Keeble, T. J. Klumpp and J. 0. Stimpson, Councilmen. NAYS: None. The Mayor thereupon declared said motion carried and the ordinance finally passed ad adopted. The Mayor thereupon signed said ordinance in approval thereof. The following resolution was offered by Councilman C. A. Gaston who moved its adoption; the same being read at length, the motion of adoption was seconded by Councilman J. 0. Stimpson, and the same being put upon iti,passage was unanimously adopted as follows: BE IT RESOLVED, byt he Town Council of the Town of Fairhope, Baldwin County, Alabazathat, the resery i- .i Job, B, dater and Savwer Contract, P.W.A Docket 6762 be accepted as complete in every r,e- tpect and is occupied by the Town o)f hairhope at present as a part of the water system. This action being taken as the recommendation of J. B. Converse & Co., Inc. Engineers for the 'sown of 11'airhopex Lt -vas moved by CouncilnL-n C. r.. Gaston seconded by Council- man T. J.Mumpp that the wharf committee be instructed to pro- ceed with plans for rebuilding section of the wharf for recreation purposes. Motion carried Keeting Udjourned to meet. / �� 97
