The City Council, City of Fairhope, met in regular session at
6:00 p.m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532, on
Monday, 22 January 2024.

Present were Council President Corey Martin, Councilmembers: Jack Burrell,
Jimmy Conyers, Jay Robinson, and Kevin Boone, Mayor Sherry Sullivan, City
Attorney Marcus E. McDowell, and City Clerk Lisa A. Hanks.
There being a quorum present, Council President Martin called the meeting to
order. The invocation was given by Pastor Kyle Parker of Eastern Shore Presbyterian
Church and the Pledge of Allegiance was recited. Councilmember Boone moved to
approve minutes of the 8 January 2024, regular meeting; and minutes of the 8 January
2024, work session. Seconded by Councilmember Conyers, motion passed
unanimously by voice vote.
Mayor Sullivan addressed the City Council regarding the following items: 1)State of the City will be he]d Thursday from 5:00 p.m. to 7:00 p.m.;2)Chocolate and Champagne Gala 2024 on January 27, 2024 at the Fairhope PublicLibrary;3)Reminded everyone of the MMOR, KOER, MOJ, OOMM Parades.Councilmember Burrell mentioned the need to increase water and sewer rates
and the "Rate Study," appealed for an increase of 6 percent, and possible future
adjustments.
Councilmember Conyers commented that being Number 5 in the State for
high schools is a great job with a 91 Grade. He said we have well rounded students
and liked the 3-mil update.
Council President Martin said that the increase is rates is house maintenance
and past due. He said we are blessed to have a school system like ours.
A Public Hearing was held as advertised on a proposed ordinance to amend
Zoning Ordinance No. 1253. Councilmember Burrell introduced in writing Ordinanc e
No. 1788, an ordinance to rezone the property of 404 Oak LLC from B-4, Business
and Professional District to B-2, General Business District. The property is
approximately 0.18 acres and is located at 404 Oak Avenue. PPIN# 14546. The
Planning Commission gave a favorable recommendation of this ordinance. Council
President Martin read the proposed ordinance. Planning Director Hunter Si mmons
briefly explained the proposed ordinance.
10332 22 January 2024 Council President Martin opened the Public Hearing at 6: 15 p.m. No one present opposed the proposed ordinance, the Public Hearing closed at 6: 15 p.m. In order to take immediate action, Councilmember Burrell moved for immediate consideration. Seconded by Councilmember Boone, motion for immediate consideration passed unanimously by the following voice votes: AYE -Burrell, Martin, Conyers, Robinson, and Boone. NAY -None. Councilmember Burrell then moved for final adoption of Ordinance No. 1788. Seconded by Councilmember Conyers, motion for final adoption passed by the following voice votes: AYE -Burrell, Martin, Conyers, Robinson, and Boone. NAY -None. Councilmember Conyers moved for final adoption of Ordinance No. 1789, an ordinance to amend Ordinance No. 1253 and to zone the property of Ry an Creel and Vincent Boothe to PUD concurrent with annexation; and to be known as The Tin Tops at Gayfer. The property is approximately 5.33 acres and is located at 8437 Gayfer Road Extension. PPIN #77258. (Introduced at the January 8, 2024 City Council Meeting). Seconded by Councilmember Robinson, motion for final adoption passed by the following voice votes: A YE -Burrell, Martin, Conyers, Robinson, and Boone. NAY -None. Councilmember Burrell introduced in writing, and moved for the adoption of the following resolution, a resolution that the City Council authorizes and approves the addition of one (1) Part-Time Administrative Assistant (Grade 7) in the Purchasing Department to the FY 2024 Budget with a weekly schedule not to exceed 29 hours per week. a weekly schedule not to exceed twenty-nine (2 hours p r eek.

10333 22 January 2024 Councilmember Conyers introduced in writing, and moved for the adoption of the following resolution, a resolution that the City Council hereby approves the payroll reallocation defined as the following effective immediately: the departmen ts are requesting to organize a program for six (6) temporary Utility Interns and two (2) temporary Public Works interns at an estimated cost of $7,560.00 per intern for the duration of the 14-week program [ est. $60,480.00 total]; and the available funding can be found in the table in said resolution. WHEREAS, Fairhope Utilities participated in the 2023 Baldwin County Utilities Internships Progra m available to rising High School Seniors; and WHEREAS, Fairhope Utilities and City of Fairhope Public Works departments have requested to expand the internship opportunities available to local students; and WHEREAS, the City of Fairhope provided for one (I) Utility Intern position in the FY 2024 Personnel Budget; and WHEREAS, the departments are requesting to organize a program for six (6) temporary Utility Interns and two (2) temporary Public Works interns at an estimated cost of $7,560.00 per intern for the duration of the 14-week program [est. $60,480.00 total]; and WHEREAS, Fairhope Utilities and City of Fairhope Public Works departments have identifi ed the following available funds in their respective departments due to payroll vacancies; and Dept Position Position# Total Amount Gas Gas Line Service Tech 1662 $15,120.00 Electric Electric Line Foreman 55 $15,120.00 Water Water Operator II 1947 $15,120.00 Public Works Asst. Councilmember Burrell introduced in writing, and moved for the adoption of
the following resolution, a resolution that the City Council authorizes and approves
the hiring of the new Public Works Administrative Assistant to allow the current
Public Works Administrative Assistant (Grade 7), who is retiring at the end of April
2024, to work with and train the new employee prior to their leaving. This will be
beneficial to the City as well as the new employee. The temporary position will expire
upon retirement of the current Public Works Administrative Assistant. Seconded by
Councilmember Conyers, motion passed unanimously by voice vote.

Schaffer, Inc. for Professional Engineering Services for (RFQ PS24-013) for
Construction Engineering and Inspection (CE&I) the Southland Place ADA
Compliant Sidewalks Project with a not-to-exceed oun of $154,330.06.

Councilmember Conyers introduced in writing, and moved for the adoption of
the following resolution, a resolution to Award (Bid No. 24-01,2) for a New Pinless
Powerlock Self Loading Turret Trailer to Reelstrong, LLC with a total bid proposal
not-to-exceed $41,079.42. Seconded by Councilmember Burrell, motion passed

City Council reviewed an application for a Special Events Retail License by
Bottles Up Mobile, Inc., .(dba Bottles Up Mobile, Inc.) for Mardi Gras February 9,
2024 through February 12, 2024 ending 11 :55 p.m. -161 North Section Street
(Fairhope Civic Center) Fairhope, Alabama. Councilmember Burrell moved to
approve the issuance of the license. Seconded by Councilmember Conyers, motion
passed unanimously by voice vote.
City Council reviewed an application for a Beer/Wine On/Off Premises
License by Elizabeth Skipper, The Reserve at Fairhope, (d/b/a Dominion Senior
Living of Fairhope LLC), 604 Reserve Loop, Fairhope, Alabama. Councilmember
Robinson moved to approve the issuance of the license conditioned on getting "CO".
Seconded by Councilmember Burrell, motion passed unanimously by voice vote.
City Council reviewed an application for a Beer/Wine On/Off Premises
License by Kirkland Hess, Mediterranean Sandwich Co, (d/b/a MSC Fairhope LLC),
9887 State Highway I 04, Fairhope, Alabama. Councilmember Conyers moved to
approve the issuance of the license. Seconded by Councilmember Robinson, motion
passed unanimously by voice vote.
Councilmember Robinson moved to appoint Tricia Gunnells to the Fairhope
Public Schools Commission for a three-year term which will expire January 2027.
Seconded by Councilmember Burrell, motion passed unanimously by voice vote.
The following individual spoke during Public Participation for Non-Agenda
Items:
I)John Stewart, 306 Morphy, addressed the City Council and told them they
were doing a great job.
Councilmember Burrell move adjourn the meeting. Seconded by
Councilmember Conyers, motion pass unanimously by voice vote.
There being no further busine s to co e before the City Council, the meeting
