ORDINANCE NO. 1598
AN ORDINANCE TO PROTECT THE PUBLIC SAFETY, HEALTH AND
WELFARE BY PRESCRIBING REGULATIONS FOR
FEEDING WILD DUCKS, GEESE AND OTHER FOWL
WITHIN THE FAIRHOPE CORPORATE LIMITS
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
FAIRHOPE, ALABAMA, AS FOLLOWS:
SECTION I: POLICY AND PROCEDURE FOR FEEDING WILD DUCKS,
GEESE AND OTHER FOWL.
It is expressly declared that the purpose of this regulation is for the safety, health and
welfare of the citizens of the City of Fairhope.
No person shall purposely or knowingly feed, bait, or in any manner provide access
to food to any wild, undomesticated waterfowl on any public property within the city
limits of the City of Fairhope.
A separate offense shall be deemed committed on each day or part of each day
during which a violation occurs or continues.
SECTION II. PENALTY FOR VIOLATION.
Any person who violates any provision herein shall be subject to a penalty not to
exceed that provided in Section 1-8 of the Fairhope Code of Ordinances.
SECTION III. SEVERABILITY
The sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this ordinance
shall be declared unconstitutional by a court of competent jurisdiction, then such
ruling shall not affect any other paragraphs and sections, since the same would have
been enacted by the municipality council without the incorporation of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION IV. EFFECTIVE DATE
This ordinance shall take effect immediately upon its due adoption and publication
as required by law.
