HomeMy WebLinkAboutO-1577ORDINANCE NO. 1577 AN ORDINANCE AMENDING ORDINANCE NO. 1253 KNOWN AS THE ZONING ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA as follows: The ordinance known as the Zoning Ordinance (No. 1253), adopted 27 June 2005, together with the Zoning Map of the City of Fairhope, be and the same hereby is changed and altered in respect to that certain property described below: After the appropriate public notice and hearing of the Planning Commission of the City of Fairhope, Alabama has forwarded a favorable recommendation, The property of Fred and Kris Hayek located at 848 N. Greeno Road, Fairhope, Alabama. TAX PARCEL 05-46-03-08-0-003-062.000 Legal Description: (Case number ZC 15.11) BEGINNING AT THE SOUTHEAST CORNER OF THE WILLIAM PATTERSON GRANT SECTION 8, TOWNSHIP 6 SOUTH, RANGE 2 EAST, BALDWIN COUNTY, ALABAMA, AND RUN THENCE WEST 435.42 FEET TO AN IRON PIN LYING ON EAST RIGHT-OF- WAY LINE OF U.S. HIGHWAY NO.98; THENCE RUN NORTH 16 DEGREES 06' WEST, ALONG THE SAID EAST RIGHT-OF-WAY LINE, A DISTANCE OF 301.84 FEET TO AN IRON PIN; THENCE RUN EAST 518.28 FEET TO AN IRON PIN; THENCE RUN SOUTH 00 DEGREES 10' EAST, 290.0 FEET TO THE POINT OF BEGINNING. INTENDING TO DESCRIBE LOT "A" OF THE SUBDIVISION OF THE TAYLOR TRACT IN WILLIAM PATTERSON GRANT SECTION 8, AS RECORDED IN MAP BOOK 5, PAGE 195, IN THE OFFICE OF THE JUDGE OF PROBATE, BALDWIN COUNTY, ALABAMA, LESS AND EXCEPT THE NEWLY ACQUIRED RIGHT-OF-WAY BY THE STATE OF ALABAMA. That, Attached as "Exhibit A" is an approved site plan. The property must develop in substantial conformance with the approved site plan and supporting documents. Any substantial deviation from the attached site plan, as determined by the Director of Planning, will require re -approval by the Planning Commission and the City Council of the City of Fairhope, Alabama, as a PUD amendment. 2. That, the following development regulations shall govern: Uses: Office/Professional, Medical/Professional, and Limited Retail — Retail shall be limited to the following uses: Sandwich shop or deli, coffee shop, juice/smoothie shop, ice cream/candy shop, office supplies, computer services, barber shop, gift shop, pharmacy/medical supplies, medical testing/laboratory, other unanticipated but appropriate uses, subject to approval by the Fairhope Planning & Zoning Department. The retail use shall not exceed 19% of the total gross square footage for the entire development. Drive-Thru/Drive-up Windows: No business in the development will be allowed to have a drive- thru or drive -up window. Fuel/Service Stations: There will be no fuel or service stations in the development. Setbacks: These are indicated on the site plan. Building Height: Maximum building height shall be 35'. Ordinance No. 1577 Page -2- The property is hereby rezoned from R-1 Low Density Single Family Residential District to PUD (Planned Unit Development). This property shall hereafter be lawful to construct on such property any structures permitted by Ordinance No. 1253 and to use said premises for any use permitted or building sought to be erected on said property shall be in compliance with the building laws of the City of Fairhope and that any structure shall be approved by the Building Official of the City of Fairhope and that any structure be erected only in compliance with such laws, including the requirements of Ordinance No. 1253. Severability Clause - if any part, section or subdivision of this ordinance shall be held unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or impair the remainder of this ordinance, which shall continue in full force and effect notwithstanding such holding. Effective Date — This ordinance shall take effect immediately upon its due adoption and publication as required by law.
