AN ORDINANCE AMENDING ORDINANCE NO. 1510
KNOWN AS THE PERSONNEL RULES, POLICIES
AND PROCEDURES ORDINANCE
BE IT ORDAINED BY THE CITY OF FAIRHOPE GOVERNING BODY OF THE CITY OF
FAIRHOPE, FAIRHOPE, ALABAMA, as follows:
Section 1. The ordinance known as the Personnel Rules, Policies, and Procedures Ordinance
(No. 1510), adopted 14 April 2014, together with the Personnel Handbook of the
City of Fairhope, be and the same hereby is changed and altered in respect to the
certain sections below:
SECTION - IV. Wage and Salary Administration
4.04. Overtime
Non -Exempt Employees
Except for Police Department law enforcement and corrections officers, nonexempt employees
will be paid 1-1/2 times their regular rate of pay for all hours worked in excess of 40 hours in a
work week. Hours paid, but not worked, are not counted in computing overtime. For example,
paid holidays, vacations and sick leave are not hours worked and do not count in computing
overtime. Under certain conditions approved by the Mayor, employees of the City of Fairhope
may receive compensatory time off, at a rate of one and one-half half hours (units of time) for
each overtime hour (unit of time) worked, instead of cash overtime pay. Employees engaged in
approved authorized activities may accrue up to 48 hours of compensatory time. An employee
may request to use compensatory time on a subsequent date during the current work period
unless doing so would "unduly disrupt" the operations of the City of Fairhope, in which case
the employee will be permitted to use the compensatory time in the succeeding work period.
Police Department law enforcement and corrections officers are subject to special overtime pay
and compensatory time off requirements under Personnel Rules Section 4.05.
SECTION - XI. Personnel Board
11.01. Selection of Members
The Personnel Board is an independent board comprised of six (6) City residents appointed by
the Mayor and confirmed by the City Council. Members serve five year staggered terms, with
one new member appointed or reappointed each year.
Section 2. Any ordinance, resolution, or part(s) thereof, in conflict with said "Personnel Rules,
Policies, and Procedures — 2014", Section IV — Wage and Salary Administration,
4.04. Overtime and Section XI — Personnel Board, 11.01 Selection of Members is
hereby repealed.
Section 3. If any section or provision of this ordinance, or of "Personnel Rules, Policies, and
Procedures — 2014", be declared invalid or unconstitutional by judgment or decree
shall not affect any other section or provision.
Section 4. This Ordinance shall take effect immediately upon its due adoption and
publication as required by law.
