HomeMy WebLinkAboutO-1568ORDINANCE NO. 1568 AN ORDINANCE AMENDING ORDINANCE NO. 1253 KNOWN AS THE ZONING ORDINANCE The ordinance known as the Zoning Ordinance (No. 1253), adopted 27 June 2005, is changed and altered as described below; WHEREAS, the City of Fairhope Planning Commission directed the Planning Department to prepare amendments to our Zoning Ordinance; and, WHEREAS, the proposed amendments relate to amending the Colony at the Grand Tourism Resort District zoning map; and, WHEREAS, after the appropriate public notice and hearing of ZC 15.14, the Planning Commission of the City of Fairhope, Alabama has forwarded a favorable recommendation; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA; 1. THAT, Attached as "Exhibit A" is an approved zoning map for the Colony at the Grand Tourism Resort District. Severability Clause - if any part, section or subdivision of this ordinance shall be held unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or impair the remainder of this ordinance, which shall continue in full force and effect notwithstanding such holding. Effective Date — This ordinance shall take effect immediately upon its due adoption and publication as required by law. The property is located on the north side of Battles Road, just west of the intersection of Section Street and Battles Road. STAFF INTERPRETATION: The subject property is located in the City of Fairhope and is zoned TR (Tourist Resort) District. This property contains approximately 184.6 ± acres. The applicant is proposing to modify the previously approved TR District, known as the Colony at the Grand. An additional 1.9 acre Low Rise (LR) area is proposed to come into the existing approximate 184.6 acres, which will result in a total acreage of approximately 186.5 acres. The additional acreage added is proposed to be the Azalea at the Colony Subdivision, which will be annexed into the City and consist of six (6) single family lots that conform to the minimum lot and layout standards outlined in the TR District Regulations for the Colony at the Grand. The additional land is contiguous with the TR District; per the TR District provisions in the Zoning Ordinance, the subject 1.9 acres can be added to the existing Land Use Map. The only other portion of the subject TR District amendment includes an approximate area of 34.4 acres (a 29.2 acre area and. an additional 5.2 acre area) that was previously dedicated as Mid -Rise Zone and is now proposed to be a Low -Rise Zone. It appears that this change will add a bit more consistency to the development as a whole, and it is in character with the surrounding, existing development. It appears a reduction in overall density for the entire Colony at the Grand TR District will occur as a result in changing a substantial amount of Mid -Rise acreage to Low -Rise acreage. All aspects of the Colony at the Grand TR District shall remain as is, unless otherwise specified in the subject application. PLANNING COMMISSION RECOMMENDATION: On November 2, 2015, with an 8 to one 1 vote, the Planning Commission recommended the City Council approve the proposed amendment to the Colony at the Grand TR district.
