ORDINANCE NO. 1512
WHEREAS, EDWARD E. MIDYETT and CINDY A. MIDYETT, the owners of the
hereinafter described property, did, in writing, petition the City of Fairhope, a municipal
corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as
arnended; and
WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW,
THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property, lying contiguous to the corporate limits
of the City of Fairhope, Alabama; and not within the corporate limits or the police
jurisdiction of any other municipality; be and the same is hereby annexed to the City of
Fairhope, Alabama, to -wit:
Property is located at 23923 Main Street, Montrose, Alabama.
LEGAL DESCRIPTION:
TAX PARCELS 43-09-31-0-000-009.000
Parcel A:
From a point at the Northeast corner of Lot 23 in. the Viliabe of Mo: rosc
according to a plat of same recorded in Deed Book E, Page 388, of the Probate
Records of Baldwin County, Alabama, run West along the North line of said lot,
100 feet to the Point or Place of Beginning; thence continue West along said
North line 50 feet to a point; thence run South and parallel with Eastern Shore
Highway, 207.56 feet to the South line of said Lot 23, 50 feet to a point, which
point is the Southwest corner of the property heretofore conveyed by the Grantor
to Frank B. Bristow, Jr., and Anita S. Bristow by Instrument recorded in Deed
Book 296, Page 197 of the Baldwin County Probate Records; from said point run
North along the West line of the property heretofore sold by Grantor to the
Bristows, 207.56 feet to the Point or Place of Beginning, SUBJECT TO building
restrictions in Miscellaneous Book 15, Page 165. There is a 30 foot right-of-way
along a portion of the South line of Lot 23 which is reserved for the use of owners
of other parts of Lot 23, Village of Montrose, run north 00 degrees 34 minutes
East, 30 feet; thence run West 554.7 feet to the beginning of a curve to the right,
said curve having a radius of 30 feet; thence run Northeastwardly along said
curve, 47.42 feet; thence run North 00 degrees 34 minutes East, 44.7 feet; thence
run South 88 degrees 13 minutes West, 20.33 feet; thence run South 00 degrees 34
feet West, 101.55 feet; thence run East 605 feet to the Point of Beginning.
Parcel B:
Begin at a point at the Northeast corner of Lot 23, in the Village of Montrose,
according to a plat of same recorded in Deed Book "E", Page 388, of the Probate
Records of Baldwin County, Alabama, run West along the North line of said lot
one hundred (100) feet; thence running South and parallel with the Eastern Shore
Highway two hundred and seven and fifty-six hundredths (207.56) feet to the
South line of Lot 23; thence run East along the South line of said lot one hundred
(100) feet to the Eastern Shore Highway; thence North on the Eastern Shore
Highway two hundred and seven and fifty-six hundredths (207.56) feet to the
Point of Beginning.

There is a thirty (30) foot right-of-way along the South line of Lot 23 which is
reserved for the use of owners of other parts of Lot 23. There is, also, conveyed
berewith the right to use away to the Bay over said thirty (30) f6ot right-of-way
and a foot path described as follows:
From the Southeast corner of said Lot 23 run North 00 degrees 34 minutes East
thirty (30) feet; thence run West along the North side of the thirty (30) foot right-
of-way five hundred (500) feet to the Point of Beginning of said foot path; thence
run North 00 degrees 34 minutes East one hundred and seventy-five and fifty-six
hundredths (177.56) feet to a corner; thence run West along the North line of Lot
23, 'seven hundred and twenty-two and ninety-seven hundredths (722.97) feet,
more or less, to Mobile Bay; thence run South five (5) feet; thence run East seven
hundred and twelve and ninety-seven hundredths (712.97) feet; thence run South
00 degrees 34 minutes West one hundred and seventy-two and fifty-six
hundredths (172.56) feet; thence run East ten (10) feet to the Point of Beginning.
This property shall be zoned R-1, Low Density Single -Family Residential District.
BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the
Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County,
Alabama.
Ties Ordinance shaii take effect immediately upon its due adoption and publication as
required by law.

We, the undersigned PETITIONER(S), owner(s) of the lands in fee simple described in the
attached EXHIBIT A, such property being without the Corporate Limits of the City of Fairhope,
Alabama, but being contiguous to the said Corporate Limits; and such property not lying within
the corporate limits or police jurisdiction of any other municipality, do, by these presents, hereby
petition the City of Fairhope, a municipal corporation, that said property be annexed into the City
of Fairhope, Alabama.
The subject land is delineated on the map attached hereto as EXHIBIT B.
This petition is filed under authority of Section 11-42-21, Code of Alabama, 1975, as amended.
