AN ORDINANCE TO AMEND ORDINANCE NO. 1371 AND ORDINANCE
NO. 1437, KNOWN AS THE CITY COUNCIL RULES OF PROCEDURE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
The ordinance known as the City of Fairhope's Council Procedures Ordinance (No. 1371),
adopted 10 November 2008, is hereby amended in respect to the certain section below and all
other sections within this ordinance remain as written and adopted:
AMENDING SECTION VIII:
If any individual who wants to address the City Council, he or she must sign in with name,
address and e-mail address prior to the beginning of the Council meeting and to which item on
the published agenda he or she wishes to speak. The City Clerk will retrieve the sign in sheet
immediately prior to the meeting and hand to the presiding officer.
No person shall be allowed to address the Council on any matter which shall be the subject of a
public hearing scheduled by the Council until the meeting under which the public hearing on that
matter is scheduled to be heard.
Severability. The sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by a court of competent jurisdiction, then such ruling shall not affect
any other paragraphs and sections, since the same would have been enacted by the municipality
council without the incorporation of any such unconstitutional phrase, clause, sentence, paragraph
or section.
Effective Date. This ordinance shall take effect upon its due adoption and publication as required
by law.
