The ordinance known as the Zoning Ordinance (No. 1253), adopted 27 June 2005,

together with the Zoning Map of the City of Fairhope, be and the same hereby is changed
and altered in respect to that certain property described below:
After the appropriate public notice and hearing of the Planning and Zoning Commission
of the City of Fairhope, Alabama has forwarded a favorable recommendation,
The property of Fred Corte (containing 160 +/- acres county zoned R-A) and Angelo A.

1. That, Attached as "Exhibit A" is an approved site plan. The property must
develop in substantial conformance with the approved site plan.
2. That, the following development regulations shall govern:
Building Heights:

Connectivity:
• The street stub -out into the Woodlands Subdivision indicated on the
Outline Development Plan shall be dedicated and maintained as a natural
easement and shall remain unopened.
Development Phases:
• Construction for any portion of this development abutting Rock Creek
Subdivision or Sandy Ford Subdivision shall be allowed but street stubs
shall not be constructed or connected to Rock Creek Subdivision or Sandy
Ford Subdivision until the site is connected to County Road 13.
A bridge over the wetlands shall be installed connecting the northeastern -
most section of the development to the southern portion of the
development, or the subject site must be connected to an additional access
point before the portion of the property between the wetlands and the
Woodlands Subdivision is developed.

Open Space:
• An open space/green space feature shall be incorporated into the design of
the commercial parking area in order to provide a more pedestrian friendly
village center environment. This requirement will be approved by the
Fairhope Planning Department.
Dead End Parking:
• There is dead-end parking located around the southwestern -most
commercial building and the Clubhouse. Dead-end parking areas shall
have striped turnaround spaces at the end of each dead-end drive.
Site Access:
• Approval and Permits from the Alabama Department of Transportation
(ALDOT) shall be obtained and submitted to the Fairhope Planning
Department.
Adjacent Site Concerns:
• All lots on the south side of the project immediately abutting The
Woodlands subdivision shall have a minimum lot width of at least 90 feet
at front setback line and a rear setback of not less than 30 feet.
Facade Requirements:
• Four-sided architectural features shall be incorporated into the design of
all commercial buildings.
Wetlands:
• The applicant has volunteered to dedicate the wetlands on the site as a
locally designated permanent Conservation Easement. The applicant shall
work with staff to coordinate this effort.
3. That, sidewalks and street trees as required by the Subdivision Regulations will
be required.

The property (05-46-02-04-0-000-001.00 and 05-46-02-04-0-000-002.000) is hereby
zoned as a Planned United Development concurrent with Annexation. This property
shall hereafter be lawful to construct on such property any structures permitted by
Ordinance No. 1253 and to use said premises for any use permitted or building sough to
be erected on said property shall be in compliance with the building laws of the City of
Fairhope and that any structure shall be approve by the Building Official of the City of
Fairhope and that any structure be erected only in compliance with such laws, including
the requirements of Ordinance No. 1253.
The property (05-46-03-08-0-000-001.000 and 05-46-03-08-0-000-003.000)
is hereby rezoned B-2 General Business to a Planned Unit Development (PUD). This
property shall hereafter be lawful to construct on such property any structures permitted
by Ordinance No. 1253 and to use said premises for any use permitted or building sought
to be erected on said property shall be in compliance with the building laws of the City of
Fairhope and that any structure shall be approved by the Building Official of The City of
Fairhope and that any such structure be erected only in compliance with such laws,
including the requirements of Ordinance No. 1253.
Severability Clause - if any part, section of subdivision of this ordinance shall be held
unconstitutional or invalid for any reason, such holding shall not be construed to
invalidate or impair the remainder of this ordinance, which shall continue in full force
and effect notwithstanding such holding.
Effective Date — This ordinance shall take effect immediately upon its due adoption and
publication as required -by law.

AMENDMENTS TO THE FLY CREEK PUD ORDINANCE
(1) All lots immediately abutting Sandy Ford Subdivision shall have a minimum
width of 90' at the front yard setback line and a rear yard setback of 30'. The
proposed alleyway will be eliminated.
(2) The proposed street stub that abuts Sandy Ford Subdivision shall be platted and
dedicated to the City of Fairhope. Construction and opening of said street stub
shall only occur by Amendment to this PUD Ordinance by a request to the City of
Fairhope City Council or by a petition of the majority of the property owners of
Sandy Ford Subdivision, Rock Creek Subdivision and East Rock Creek
Subdivision. Opening of said street shall require a public hearing by the City of
Fairhope City Council. Said stub may be used for pedestrian access and may be
used for emergency vehicles with the approval of the City of Fairhope Police
Chief or Fire Chief.
(3) The street stub -out into the Woodlands Subdivision indicated on the Outline
Development Plan shall be dedicated and maintained as a natural easement and
shall remain unopened. Construction and opening of said street stub shall only
occur by an Amendment to this PUD Ordinance by a request to the City of
Fairhope City Council or by a petition of the majority of the property owners of
Woodlands Subdivision. Opening of said street shall require a public hearing by
the City of Fairhope City Council.
(4) The following section shall be removed: Construction for any portion of this
development abutting Rock Creek Subdivision shall be allowed but street stubs
shall not be constructed or connected to Rock Creek Subdivision or Sandy Ford
Subdivision until the site is connected to County Road 13.
Additional Comment: The applicant could not agree to designate the lots abutting Fly
Creek as provisional lots.

CONDITIONAL PETITION FOR ANNEXATION
We, the undersigned Petitioner/s, owner/s of the lands in fee simple described in the
attached Exhibit A, such property being without the corporate limits of the City of
Fairhope, Alabama, but being contiguous to the said corporate limits, and such property
not lying within the corporate limits or police jurisdiction of any other municipality,
