HomeMy WebLinkAboutO-1302ORDINANCE NO. 1302 AN ORDINANCE AMENDING ORDINANCE NO. 1253 KNOWN AS THE ZONING ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA as follows: The ordinance known as the Zoning Ordinance (No. 1253), adopted 27 June 2005, together with the Zoning Map of the City of Fairhope, be and the same hereby is changed and altered in respect to that certain property described below: After the appropriate public notice and hearing of the Planning and Zoning Commission of the City of Fairhope, Alabama has forwarded a favorable recommendation, The property of Ray and Robin Lambert, located at 9271 Morphy Avenue, Fairhope, Alabama CEDAR TREE ESTATES TAX PARCEL 46-05-15-0-000-003.593 Legal Description: (Case number ZC 06.06) Commencing at a Railroad Spike being the Southeast corner of the Northwest Quarter of the Southwest Quarter of Section 15, Township 6 South, Range 2 East, Baldwin County, Alabama, run North, 20.0 feet to an iron pin lying on the North Right-of-way line of Morphy Avenue, for the Point of Beginning; thence run North 00 degrees 00 00 West, 642.65 feet to an iron pin; thence run South 89 degrees 45 00 West, 328.67 feet to an iron pin; thence run South 00 degrees 04 25 East, 341.20 feet to an iron pin; thence run East, 153.70 feet to an iron pin; thence run South 00 degrees 04 45 West, 300.00 feet to a point of said North Right-of-way line; thence run East, along said North —of-way line, 175.10 feet to the Point of Beginning. Severability Clause - if any part, section of subdivision of this ordinance shall be held unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or impair the remainder of this ordinance, which shall continue in full force and effect notwithstanding such holding. STAFF INTERPRETATION: The property is currently zoned R-A and is located on the north side of Morphy Avenue between County Road 13 and Hwy 181. They wish to rezone this parcel in order to subdivide the property. R-A requires a lot to be a minimum of 3 acres. This property contains 3.95 acres, and for any subdivision to occur, it must be rezoned. Staff has received one letter in opposition to this request. The issues associated with this request are as follows: Comprehensive Plan: This request is not contrary to the Comprehensive Plan. Adjacent Zoning: The properties to the north, east, and west are all zoned RA. Property across Morphy Avenue is zoned R-1. STAFF RECOMMENDATION: Staff sees no problem with granting this request.
