ORDINANCE NO. 1290
WHEREAS, DUCK DUCK GOOSE, INC., the owner of the hereinafter described property,
did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under
Section 11-42-21 of the Code of Alabama, 1975, as amended; and
WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW,
THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property, lying contiguous to the corporate limits of
the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of
any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -
wit:
Property is located on the South side of County Road 44, East of Greeno Road next to Colony
Place.
LEGAL DESCRIPTION: PART OF SUMMER LAKE PHASE H
TAX PARCEL 46-08-28-0-000-001.170
Commence at the "locally accepted" Northeast corner of Section 28, Township 6 South, Range 2
East, St. Stephens Meridian and run thence North 89 degrees 43 minutes 12 seconds West, along
the North line of said Section 28, a distance of 1661.67 feet; thence run South 00 degrees 43
minutes 20 seconds West, a distance of 1313.65 feet to an iron pin marker; thence run South 89
degrees 53 minutes 35 seconds East, a distance of 330.10 feet to an old 4-inch by 4-inch concrete
monument; thence run South 89 degrees 39 minutes 18 seconds East, 114.88 feet to an iron pin
marker for a POINT OF BEGINNING; thence continue South 89 degrees 39 minutes 18
seconds East, a distance of 255.92 feet; thence run South 00 degrees 01 minutes 34 seconds
West, a distance 247.95 feet to an iron pin marker; thence run North 89 degrees 39 minutes 18
seconds West, a distance of 259.05 feet to an iron pin marker; thence run North 00 degrees 45
minutes 00 seconds East, a distance of 247.95 feet to the POINT OF BEGINNING. Tract lies
in the Northeast quarter of Section 28, Township 6 South, Range 2 East, Baldwin County,
Alabama. Contains 1.46 acres more or less.
This property shall be zoned R-1, Low Density Single- Family Residential District.
BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the
Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County,
Alabama.
This Ordinance shall take effect immediately upon its due adoption and publication as required
by law.

We, the undersigned PETITIONER(S), owner(s) of the lands in fee simple described in the attached EXHIBIT A, such
property being without the Corporate Limits of the City of Fairhope, Alabama, but being contiguous to the said Corporate
Limits; and such property not lying within the corporate limits or police jurisdiction of any other municipality, do, by these
presents, hereby petition the City of Fairhope, a municipal corporation, that said property be annexed into the City of
Fairhope, Alabama.
The subject land is delineated on the map attached hereto as EXHIBIT B.
This petition is filed tinder authority of Section 11-42-21, Code of Alabama, 1975, as amended.
