HomeMy WebLinkAboutO-1229ei Y — w m Lj U N O aw EL �_ cc o� z =c O 1— o ORDINANCE NO. 1229 AN ORDINANCE DIRECTING THE TRANSFER OF A TEN FOOT STRIP OF LAND TO HARRELL PROPERTIES, L.L.C., $5,000.00 AND DECLARING SAID PROPERTY TO BE SURPLUS AND NOT NEEDED FOR PUBLIC OR MUNICIPAL PURPOSES. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA AS FOLLOWS: Section 1. The legal description of the real estate that is the subject matter of this Ordinance is in Baldwin County, Alabama and is more particularly described as follows: Beginning at a crimp top iron pipe at the Southeast corner of Lot 3 of a subdivision of the lands of ALCO Land & Timber Co., Inc. as recorded in Map Book 10, page 9, in the Office of the Judge of Probate, Baldwin County, Alabama, run thence North along the West right-of-way line of Section Street a distance of 104.50 feet to an open top iron pipe at the Northeast corner of said Lot 3; thence run South 89' 57' 14" East along a projection of the North Boundary Line of said Lot 3 a distance of 9.92 feet to a capped rebar iron pin; thence run South, 104.58 feet to a crimp top iron pipe; thence run North 89°31' 08" West, 9.92 feet to the point of beginning. Said parcel of land contains 0.02 acres, more or less. Section 2. The CITY COUNCIL OF THE CITY OF FAIRHOPE, has determined that the above described property is surplus and is no longer needed for public or municipal purposes and the Mayor is authorized to execute a deed of said property to Harrell Properties, L.L.C. for payment of $5,000.00 to the general fund. SECTION3: SEVERABILITY CLAUSE — The provisions of this Ordinance are severable. If any part of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, such declaration shall not affect the part that remains. Section 4. This ordinance shall take effect immediately upon due adoption and publication as required by law. Adopted and approved this 11 th day of October , 2004.
