AN ORDINANCE AMENDING ORDINANCE NO. 557 KNOWN AS THE
ZONING ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA as follows:
The ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975, together
with the Zoning Map of the City of Fairhope, be and the same hereby is changed and altered in
respect to that certain property described below:
The appropriate public notice and hearing of, the Planning and Zoning Commission of the City
of Fairhope, Alabama has forwarded a favorable recommendation,
The property of Fairhope 98 Joint Venture located West of US Highway 98 (Greeno Rd.), South
of Parker Rd.
Legal Description: (Case number ZC 04.03)
Lot 1, Bayou Volanta Commercial Park, Unit One, Map Book 11, Page 12, of the Office of the Judge of
Probate, Baldwin County, Alabama and more particularly described as follows:
Beginning at the Northwest corner of Lot 1, Bayou Volanta Commercial Park, Unit One, Map Book 11,
Page 12 of the Judge of Probate, Baldwin County, Alabama; Thence run North 70 degrees 5 minutes East
along the North line of said Lot 1, Bayou Volanta Commercial Park, Unit One and the South right-of-way
of Parker Rd., 91.17 feet to the Northwest corner of said Lot 1, Bayou Volanta Commercial Park Unit
One; Thence run South 13 degrees 57 minutes East along the East line of said Lot 1, Bayou Volanta
Commercial Park, Unit One, 210.75 feet to the Southeast corner of said Lot 1, Bayou Volanta
Commercial Park, Unite One; Then run South 77 degrees 00 minutes West along the South line of said
Lot 1, Bayou Volanta Commercial Park, Unit One, 90.44 feet to the Southwest corner of said Lot 1,
Bayou Volanta Commercial Park, Unit One; Thence run North 14 degrees 00 minutes East along the
West line of said Lot 1, Bayou Volanta Commercial Park, Unit One, 199.84 feet to the POINT OF
BEGINNING, containing 0.43 acres more or less.
A map of the property to be rezoned is attached as Exhibit A
The classification of said property is hereby changed from R1-Single Family Residential to B4-
Business and Professional Office. This property shall hereafter be lawful to construct on such
property any structures permitted by Ordinance No. 557 and to use said premises for any use
permitted or building sough to be erected on said property shall be in compliance with the
building laws of the City of Fairhope and that any structure shall be approve by the Building
Official of the City of Fairhope and that any structure be erected only in compliance with such
laws, including the requirements of Ordinance No. 557.
Severability Clause - if any part, section of subdivision of this ordinance shall be held
unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or
impair the remainder of this ordinance, which shall continue in full force and effect
notwithstanding such holding.
Effective Date — This ordinance shall take effect immediately upon its due adoption and
publication as required by law.

ZC 04.03 Public Hearing to Consider the Request of Mr. Mark Reed for a
Zoning Change from RI -Single Family Residential to 134-Business
and Professional Office (Generally Located on the South Side of
Parker Road just to the West of Print Excel)
Mr. Reed is requesting a zoning change from R1-Single Family to 134-Business and
Professional Office. The property is in Montrose and was annexed into the City as R1-
Single Family Residential. This parcel is between the old Fly Creek Swim and Tennis
Club and the Print Xcel office building (see map attached).
The issues associated with this request are as follows:
Comprehensive Plan: The plan supports rezoning of the property to commercial in
order to reduce zoning conflicts.
B2 / B4: The request made to the Planning Commission was to rezone as General
Business (B2). Mr. Ray Moore, representing Mr. Reed at the meeting requested B4-
Business and Professional Office. The Planning Commission recommended B4.
STAFF RECOMMENDATION:
To approve as B4 - Business and Professional Office.
