HomeMy WebLinkAboutO-1205cff �W X �v U ZI M : w� 11 yy11 16 ORDINANCE NO. 1205 WHEREAS, CITY OF FAIRHOPE , the owner of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying contiguous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to - wit: Property is located next to the City of Fairhope Public Works Building (Dirt Pit) LEGAL DESCRIPTION: TAX PARCEL 46-04-20-3-000-025.000 From the Northeast corner of the Baron DeFerriet Grant Section 18, in Township 6 South, Range 2 East, run S 31 ° 15' W along the eastern line of said grant section a distance of 490 feet to a stake, which is the Southeast corner of lands conveyed to Sam Jackson by Carl Bloxham by deed of April 29, 1946, recorded in Deed Book 107, at pages 233-4, Baldwin County Probate Records, for the POINT OF BEGINNING of the property herein described: Thence run S 31' 15' W along said grant line a distance of 865 feet to an iron pipe corner marker at the Southeast corner of said grant, which point is on the North boundary of Lot 10, Sec. 20, T6S, R2E, per the Official Township plat; thence run N 58' 45' W, or nearly so, along and on the Southern boundary of said grant, a distance of 655 feet; thence run N 31' 34' E, 745 feet to a point on the South line of the Robert Bell land; thence run S 69' 30' E, or nearly so, on and along the Southern line of the Robert Bell and Sam Jackson lands, a distance of 673 feet to the Point of Beginning. EXCEPTING THEREFROM that certain 3-acre tract heretofore conveyed to Henry Hankins to Norah L. Sanders by deed recorded in Deed Book 258, pages 510-11, Baldwin County, Alabama, probate records; and also Excepting the Western TEN (10) feet of the above described tract, to be used by prior grantors and grantees as a joint driveway. The Tract herein described, after allowing for said exception, contains 8.5 acres, more or less, and is the Eastern Half of that certain tract of land acquired by Eugene and Leona Bosby from Henry Hankins by deed dated 24 Feb., 1954, recorded in Deed Book 205, pp. 520-521, Baldwin County, Alabama, Probate Records; and lies in the De Ferriet Grant Section 18, T6S, R2E, Baldwin County, Alabama. Contains 8.5 acres more or less. This property shall be zoned R-1, Low Density Single- Family Residential District. BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County, Alabama.
