AN ORDINANCE AMENDING
ORDINANCE NO. 557 KNOWN AS THE ZONING ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA as follows:
The ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975, together
with the Zoning Map of the City of Fairhope, be and the same hereby is changed and altered in
respect to that certain property described below:
The appropriate public notice and hearing of, the Planning and Zoning Commission of the City of
Fairhope, Alabama has forwarded a favorable recommendation.
The property of Susan D. Calhoun and Sally D. Megginson located at 716 South Mobile Street
(West of Scenic 98 South Mobile Street, South of Fairhope Ave.
Legal Description: (Case number ZC 04.01)
From the Southeast corner of Section 24, Township 6 South, Range 1 East, run North 3379.5 feet; thence run East 328.5
feet to an iron pipe at the Northeast corner of property formerly belonging to Wilmer C. Davis, which point is the
Southeast corner of property of Olivet J. Powers; thence run North 09 degrees, 58 minutes East, along the Western
margin of the ROW of Eastern Shore Blvd. (now US Hwy 98) 50 feet to the Northeast corner of the Olivet J. Powers lot,
which point is the Southeast corner of the William Davis, Jr. lot herein described, for a POINT OF BEGINNING: thence
run North 09 degrees, 58 minutes East along said Hwy No. 98, 93.1 feet to a fence corner; thence run, following the
North fence line enclosing the William Davis, Jr. lot, North 65 degrees, 12 minutes West, 218 feet; North 62 degrees, 34
minutes West, 85.3 feet; North 63 degrees, 48 minutes West, 322.6 feet to a point at approximate mean Flood Tide level
on the Eastern margin of Mobile Bay; thence run South 29 degrees, 30 minutes West, 92 feet to a point on the North line
of the said Olivet J. Powers lot; thence run South 63 degrees, 30 minutes East, 650 feet to the POINT OF BEGINNING;
including all lands lying between the North and South boundaries of the property herein described, extended to Mobile
Bay, together with all littoral or riparian rights thereto belonging or pertaining. Lot contains 1.5 acres, more or less, and
lies in Section 24, Township 6 South, Range 1 East, and partly in Section 19, Township 6 South, Range 2 East, Baldwin
County, Alabama, and is a part of that certain property conveyed to William Davis, Jr. by William Davis and Eloise Davis,
his wife, dated February 17, 1904, and recorded in Deed Book 7, at page 82, Probate Records of Baldwin County,
Alabama.
A map of the property to be rezoned is attached as Exhibit A
The classification of said property is hereby changed from R1-Single Family Residential
to R2-Single Family Residential. This property shall hereafter be lawful to construct on such
property any structures permitted by Ordinance No. 557 and to use said premises for any use
permitted or building sough to be erected on said property shall be in compliance with the
building laws of the City of Fairhope and that any structure shall be approve by the Building
Official of the City of Fairhope and that any structure be erected only in compliance with such
laws, including the requirements of Ordinance No. 557.
Severability Clause - if any part, section of subdivision of this ordinance shall be held
unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or
impair the remainder of this ordinance, which shall continue in full force and effect
notwithstanding such holding.
Effective Date - This ordinance shall take effect immediately upon its due adoption and
publication as required by law.

cxpc lent and necessary for the benefit of the City

with the comprehensive plan and in the best interests of the City as a whole, and

ZC 04.01 Public Hearing to Consider the Request of Mr. Danny Calhoun for
a Zoning Change from RI -Single Family to R2-Single Family
(Generally Located South of Bay Place on the West Side of South
Mobile St.)
Mr. Calhoun is requesting a zoning change from R1-Single Family to 112-Single Family.
The property was Mr. John Duck's property. Mr. Calhoun is Mr. Duck's son-in-law. The
request is being made because the property is proposed to be subdivided from 1 lot into
2 and the new lot will not meet the R1 dimensional requirement.
The issues associated with this request are as follows:
Comprehensive Plan: The request is not inconsistent with the plan.
Subdivision Case: This property is to be subdivided. However, staff cannot sign the plat
and it be recorded until the zoning is finally approved by the City Council. The applicant
has been advised of this requirement.
Public Input: Staff has received several calls and inquiries. Letters are attached from
several of the adjacent owners. However, it is important to point out that the Commission
cannot legally require the owners to adhere to the request that the owners have asked for.
As long as the property owner falls within the limits of the rules then any request for
building permits would be approved.

THAT, WHEREAS, JOHN V. DUCK, departed this life on or about
the 16th day of December 2001, leaving a Last Will and Testament,
and
WHEREAS, SUSAN D. CALHOUN and SALLY D. MEGGINSON, were named
as Personal Representatives under the Last Will and Testament of
JOHN V. DUCK, deceased, and Letters Testamentary were duly issued
to them on the 25th day of January, 2002, out of the Probate Court
of Baldwin County, Alabama, and
NOW, THEREFORE, pursuant to and by virtue of and under the
terms of the Last Will and Testament of JOHN V. DUCK, deceased,
SUSAN D. CALHOUN and SALLY D. MEGGINSON, as Personal
Representatives and Grantors, for and in consideration of the sum
of: TEN AND 00/100 DOLLARS ($10.00) and other good and valuable
consideration to them in hand paid by SUSAN D. CALHOUN and SALLY D.
MEGGINSON, hereinafter referred to as Grantees, the receipt whereof
is hereby acknowledged, do hereby GRANT, BARGAIN, SELL and CONVEY
unto the said Grantees, as tenants in common, all of the following

Boulevard (now U:S. Highway No. 98) Fifty (50) feet, to
the Northeast corner of the Olivet J. Powers lot, which
point is the Southeast corner of the William Davis, Jr.
lot herein described, for a POINT OF BEGINNING: Thence
run N 090 58' E along said Highway No. 98, 93.1 feet to
a fence corner.; thence run, following the North fence
line enclosing the Williams Davis, Jr, lot, N 65' 12' W,
218 feet; N 620 34' W, 85.3 feet; N 630 48' W, 322.6 feet

Dear Mr. Baker:
Thank you for the opportunity to provide input to the zone hearing on the Duck property
at 716 S. Mobile Street, Case #SD 04-14. We are three homeowners and members of the
Bay Place Homeowners' Association with properties next door to the Duck property.
712 S. Mobile Street, Lots 4, 6 and 7 have no problem with the construction of a single
residence on the front of the property. However, we would have major objections to
construction of any structure on the rear of the property on the bay side. Construction on
the bay side would cause a number of problems for our homeowners.
In summary, if a waiver is approved for construction of a second residence on the Duck
property, we request that the waiver specify that construction will take place on the front
(street side) of the property only.
