HomeMy WebLinkAboutO-1190ORDINANCE NO. 1190 AN ORDINANCE TO PROMOTE THE SAFETY, HEALTH AND WELFARE OF THE CITY OF FAIRHOPE, ALABAMA MUNICIPAL AIRPORT BY ESTABILISHING SAFETY AND SECURITY PROCEDURES FOR THE H. L. "SONNY" CALLAHAN AIRPORT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as follows: Safety and Security Ordinance for the H. L. "Sonny" Callahan Airport Purposes: • To provide for the safety of anyone using the airport • To prevent this airport being used for illegal purposes • To safeguard aircraft, airport tenants, employees, and other personnel • To provide enforceable safety and security regulations Safety and Security: • Gates will remain closed at all times that a vehicle is not actually in transit through them. The pedestrian gate will remain closed, but not locked at any time. • Non -electronic vehicle gates will be locked when not in use, and at all times when the airport is unattended. • Vehicular traffic on any aircraft movement surface is restricted to vehicles displaying FAA approved lights or flags, or vehicles closely escorted by airport service vehicles displaying FAA approved lights/flags. • Vehicular speed limit is 10 miles per hour, except for emergency response vehicles. Aircraft/airport service vehicles will be have tires/wheels marked for speed control. • Vehicular traffic by t-hangar renters is restricted to a direct route to/from the proximity card access gate to/from the individual's t-hangar and nowhere else. A vehicle must be locked inside t-hangar if it is to remain while the aircraft is gone. Foot traffic to/from t-hangars is limited to a direct route to/from the proximity card access gate to/from t-hangar, or to/from t-hangar to/from large hangars via the grassy areas only, and not across any aircraft movement or aircraft parking areas. • Vehicular transit of all aircraft parking area and aircraft movement areas is expressly prohibited to all vehicles not displaying appropriate lights/flags. ORDINANCE NO. 1190 AIRPORT SAFETY AND SECURITY PAGE —2- • City vehicles requiring access to aircraft movement areas will display appropriate lights/flags. • Foot traffic will be restricted to a direct route from the personnel gate to destination building or aircraft with no deviations. • Privately owned vehicles will not park inside the security fence at any time. Properly escorted vehicles may go to an aircraft to pick up/drop off passengers, luggage, or cargo but will move outside the fence immediately after doing so. Vehicles so engaged will not be left unattended for any period of time. • Inside the security fence vehicle parking is limited to fuel trucks, aircraft/airport service vehicles, and rental cars awaiting pickup or after return. • Extended parking (overnight or longer) is restricted to the westernmost row of the grassy parking area across the access road from the large hangars. • All parked aircraft will be locked and secured. • All hangars will be closed and locked when the airport is unattended. • Fuel trucks will be locked and parked away from buildings, aircraft, and fences when not in use. • The fuel farm will be locked at all times it is not in actual use, and access to it will be limited to authorized personnel only who have been trained in its use. • Emergency numbers and this Safety and Security ordinance will be posted in prominent places at the main gates or on the airport. • The fixed base operator will maintain a current list of addresses, 24 hour telephone contacts, and email addresses of all transient and permanently based aircraft. Control of Proximity Access Cards: • Issuance of cards will be limited to aircraft based at the airport. Transients have 24-hour access via the pedestrian gate. • Cards 1 through 5 are issued to and reserved for Airport Authority and city use. ORDINANCE NO. 1190 AIRPORT SAFETY AND SECURITY PAGE —3- • One card only will be issued per aircraft. Requests for additional cards will be justified in detail and will be submitted to the Airport Authority for approval prior to issue. • Requests for issue of cards to non -aircraft -owners will be justified in detail and submitted to the Airport Authority for approval prior to issue. • Cards will not be issued on a temporary or permanent basis to any fixed base operator employee unless that individual owns an aircraft that is based at the airport. • The issuing authority will collect and hold for the Airport Authority a $25.00 deposit on each card issued to an aircraft or individual. This deposit will be forfeited if the card is lost, stolen, misused, or damaged. • The issuing authority may, at its option, collect an additional deposit in an amount not to exceed $10.00 per card which will be forfeited to the issuing authority if the card is lost, stolen, misused, or damaged. • All deposits will be returned to the individual when the aircraft is no longer based at the airport, or when the individual to whom the card was issued no longer owns the aircraft. Cards will not be sold with the aircraft, but returned to the issuing authority. • Cards will not be loaned under any circumstances under penalty of revocation. • Cardholders are prohibited from entering via the card -controlled gate and exiting by the main gate. • Records of card use will be maintained for a period of one year after the card is turned in, or as required by statute. • Records of card use will be treated as confidential, and will be accessible only to the issuing authority and the Airport Authority. Requested access by any other entity will be referred to the Airport Authority for approval prior to granting access. • Violation of any provision of this ordinance will result in the following penalties, and any other such tickets, fines, or penalties as allowed by applicable law and regulation: ORDINANCE NO. 1190 AIRPORT SAFETY AND SECURITY PAGE —4- First offense: warning letter to the cardholder with a copy to the Airport Authority. Second offense: suspension of card use for a thirty day period with a letter to the Airport Authority specifying beginning and ending date of the suspension and the reason for it. Third offense: revocation of card access privileges and loss of deposits with a letter to the Airport Authority stating the date of revocation and the reason for it. Reinstatement of suspended or revoked cards will be at the sole discretion of the Airport Authority. Severability: Each phrase, sentence, paragraph or section of this ordinance is severable from all other such phrases, sentences, paragraphs or sections. Should any part of this ordinance be declared unconstitutional or invalid by the courts, such declaration shall not affect any other part or portion of this ordinance Effective Date: This ordinance shall take effect upon its due adoption and publication as required by law.
