ORDINANCE NO. 1188
WHEREAS, CITY OF FAIRHOPE , the owner of the hereinafter described property, did,
in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section
11-42-21 of the Code of Alabama, 1975, as amended; and
'WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW,
THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property, lying contiguous to the corporate limits of `!
the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of My
any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to- �1

Property is located next to the H.L. "Sonny" Callahan Airport on County Road 32, Baldwin County,
Fairhope, Alabama (Former owner James E. Atchison)
LEGAL DESCRIPTIONS:
TAX PARCEL 05-56-02-09-0-001-003.000
A parcel of land located in Section 9, Township 7 South, Range 2 East, Baldwin County,
Alabama, more particularly described as follows: Commence at the Northeast Corner of the
Northwest'/4 of the Southeast'/4 Section 9, Township 7 South, Range 2 East, an iron spike
located in the center of Farm to Market Road; thence South 00 degrees 09 minutes 57 seconds
West a distance of 30.02 feet to a 1/2 inch iron rebar found; thence South 00 degrees 07 minutes
16 seconds West a distance of 1277.55 feet to a calculated point; thence South 89 degrees 39
minutes 18 seconds West a distance of 1201.42 feet to the POINT OF BEGINNING; thence
South 89 degrees 39 minutes 18 seconds West a distance of 795.91 feet to a post 3 inches by 5
feet high; thence South 00 degrees 03 minutes 04 seconds East a distance of 956.75 feet to a
calculated point; thence South 80 degrees 30 minutes 00 seconds East, a distance of 787.38 feet
to a calculated point; thence North 00 degrees 58 minutes 09 seconds East a distance of 1091.66
feet to the POINT OF BEGINNING; containing 18.50 acres more or less.
This property shall be zoned R-1, Low Density Single- Family Residential District.
BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the
Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County,
Alabama.
This Ordinance shall take effect immediately upon its due adoption and publication as required
by law.

Reference: Ordinance No. 1187
Dear Sir or Madam:
Please negate the corrected legal description and map for Ordinance No. 1187
(Instrument number 812116). We have discovered that the original. ordinance and
original map for Ordinance No. 1187 was correct (Instrument number 778169).
The original petition for annexation form, instrument number 778169 is also
correct.
I am requesting that the enclosed Ordinance No. 1187 and map be re -recorded, in
an effort to make a final correction.
I am also requesting that the corrected ordinances, Ordinance No. 1198
(Instrument number 793363) and Ordinance No. 1204 (Instrument number
810983) be re -recorded as well.
I greatly appreciate you assisting me in re -correcting and correcting these issues;
