WHEREAS, JOHN DAVIS ALEXANDER NICOLSON and ANNE CARSON IRVINE NICOLSON , the owner of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying contiguous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: Property is located at 19087 Scenic Highway 98, Fairhope, Alabama LEGAL DESCRIPTIONS: TAX PARCEL 45-06-24-4-000-029.000 From the Southeast corner of Section 24, Township 6 South, Range 1 East of St. Stephens Meridian, run West along the South line of the said Section 24, a distance of 12.325 chains (813.45 feet) to the West line of the original right of ay of U. S. Highway Number 98; thence North 06 degrees 10 minutes East, along the West line of U. S. Highway Number 98, a distance of 4.75 chains (313.50 feet); thence North 11 degrees 45 minutes East, along the said original right of way line of U.S. Highway 98, a distance of 1.667 chains (110.02 feet) to a n iron rod set in a fence corner of the South line of the property of Edward A. Metzger; thence North 09 degrees 09 minutes East, along the old right of way of U.S. Highway Number 98, a distance of 31.68 feet, according to the stipulations in Will of Mary M. Metzger, as recorded in Will Book 25, Page 619 through 621 of the Probate Court Records; being a Codicil to instrument recorded in Will Book 26, Pages 387 through 389 of the said Probate Court Records and the point of beginning; thence North 83 degrees 46 minutes 55 seconds West fulfilling the terms of said Will, 463.46 feet; thence South 76 degrees 01 minutes 03 seconds West, 42.00 feet to a point 12 feet East of the East wall and 3.0 feet from the South wall of the residence of the late Mary M. Metzger, as specified in said Will; thence North 78 degrees 02 minutes West, parallel to and 3.0 feet distant Southwardly from the South risers of the said residence and along the projection of the said line, a distance of 74.00 feet to an iron set June 4, 1979 by Eugene Fagerstrom, Registered Land Surveyor; thence North 82 degrees 12 minutes 10 seconds West, a distance of 257.57 feet to a spike driven in the top of the new (1979) creosoted timber bulkhead constructed on the Eastern edge of Mobile Bay; thence North 31 degrees 06 minutes East, along and said creosoted timber bulkhead, a distance of 84.0 feet to a spike on the North line of the property of the said Mary M. Metzger, as marked by the Westward projection of a fence line; thence South 80 degrees 30 minutes East, along and said fence line projection 45.75 feet to an iron pipe of said fence line; thence continue South 80 degrees 30 minutes East, a distance of 100.00 feet to a concrete monument in the said boundary fence; thence continue South 80 degrees 30 minutes East, along said fence, 632.7 feet to an iron rod in a fence corner on the old right of way line of U. S. Highway Number 98; thence continue South 80 degrees 30 minutes East, a distance of 24.2 feet to an iron pipe on the West line of the present (1979) right of way of U.S. Highway 98; thence South 11 degrees 21 minutes 15 seconds West, along and said West line of U. S. Highway Number 98, a distance of 30.32 feet thence North 83 degrees 46 minutes 55 seconds West, a distance of 23.2 feet to the point of beginning. This property shall be zoned R-1, Low Density Single- Family Residential District. BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County, Alabama.
