HARPE , the owner of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying contiguous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: Property is located at 718 South Mobile Street, Lots 1, 2, and 3, Fairhope, Alabama LEGAL DESCRIPTIONS: TAX PARCEL 46-03-37-0-012-014.000 Lot 1 From an iron pin at the Southeast corner of Olivet J. Powers' fence, which point is also the Northeast corner of Wilmer C. Davis' fence, ad which point stands Three Thousand Three Hundred Twenty-eight (328) ft. east of the Southeast corner of Section Twenty- four, Township six South, Range One East, (said point also being N 09' 45' E, 50 ft. from the Southeast corner of Wilmer Davis' lot, said SE Cor Davis Lot) (being S 15' 02'W, 1429.8 ft. from Ala. POWERS, for his use, and the use of his heirs and assigns, to provide passage for him and them to and from the lot this day conveyed to my said son, ORLANDO C. POWRS, and the Eastern Shore Boulevard: the Grantee herein being hereby perpetually enjoined from fencing or otherwise enclosing or obstructing the said driveway, except by permission of the said ORLANDO C. POWERS, or his heirs or assign. ALSO, there is hereby conveyed to the said ELEANOR P. HARPE, and to her heirs or assigns, a passageway three feet in width along and over the south three feet of the lot this day conveyed to my son, ORLANDO C. POWERS: the said passageway being reserved from the conveyance to the said Orlando C. Powers in order to provide a passage for the Grantee herein, the said ELEANOR P. HARPS, and her heirs ad assigns, to and from the waterfront lot this day conveyed to my said son and daughter, Orlando C. Powers and Eleanor P. Harpe, in joint tenancy.
