HomeMy WebLinkAboutO-1141_w 0 �R U ma .a U a '10a oC (M�g— W ORDINANCE NO. 1141 AN ORDINANCE TO AMEND ORDINANCE NO.544 BUSINESS LICENSE SECTION 1-118 BY AMENDING INSURANCE COMPANIES ADOPTED NOVEMBER 24, 1974 Pursuant to Section 11-51-121, Code of Alabama, 1975. Section 1. LICENSE TAX ON FIRE AND MARINE INSURANCE COMPANIES. There is hereby levied on each fire and marine insurance company doing business in the city a license, privilege or occupation tax of four dollars ($4.00) on each one hundred dollars ($100.00), or major fraction thereof, of gross premiums, less return premiums received on policies issued during the preceding calendar year on property located in the city. Section 2. LICENSE TAX ON INSURANCE COMPANIES OTHER THAN FIRE AND MARINE INSURANCE COMPANIES. A license, privilege or occupation tax is hereby levied upon each insurance company, other than fire and marine insurance companies, doing business in the city, twenty dollars ($20.00), and also of one dollar ($1.00) on each one hundred dollars ($100.00) or major fraction thereof of gross premiums, less return premiums, received during the preceding calendar year on policies issued during said year to citizens of the city. Section 3. WHEN STATEMENT AND TAX ON FIRE, MARINE AND OTHER INSURANCE COMPANIES IS DUE. On the first day of January, or within sixty (60) days thereafter, of each year, each insurance company which did any business in the city during any part of the next preceding year shall furnish the Mayor a statement in writing, verified by the affidavit of the president, vice-president or secretary of the company, which statement shall set out and show the full and true amount of gross premiums, less return premiums, received during the preceding year, on all policies of such insurance issued in the city during the said preceding year, and shall accompany said statement with the amount of license due from said company. Failure to furnish said statement or to pay such amount to the city, as herein required, shall cause a forfeiture of the right of the company so failing, or its agents, to continue to do business in the city until said statement shall have been furnished and said sum shall have been paid, and shall subject the company and its agents to the penalties prescribed by this Code for failure to pay license or privilege taxes. Section 4. SEVERABILITY. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
