AN ORDINANCE AMENDING ORDINANCE NO. 557
KNOWN AS THE ZONING ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as
follows:
The ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975,
together with the Zoning Map of the City of Fairhope, be and the same hereby is changed
and altered in respect to that certain property described below:
The appropriate public notice and hearing of, the Planning and Zoning Commission of the
City of Fairhope, Alabama, has forwarded a favorable recommendation.
The property of Khim Vira located at 26 Laurel Street
Legal Description: ( case number ZC 01.11)
Parcel 1. Lots 9 and 10 in Block 7 of Magnolia Beach Addition to Fairhope, Alabama
and being the same lots conveyed to Annette Kennedy to (Mrs.) M. B.
Kimbrough by deed dated 16 June 1930 and recorded in deed book 49
N.S. page 218 Baldwin County, Ala records.
Parcel 2 From the NW corner of Block 8, Magnolia Beach Addition to the City of
Fairhope, AL according to Map thereof recorded in Misc. Book No. 1 at
pages 330-331, Probate Records of Baldwin County, AL, which point is on
the East margin of Satsuma Street in said subdivision, run south 37
degrees west 162 feet along the east margin of said Satsuma St. to the
dead end of said street and the point on the north fence line of lands
formerly owned by the said Phil W. Denton; thence run North 68 degrees
40 minutes west along the north line of said former Denton property 17.7
feet to an iron stake for the point of beginning, which point is the NW corner
of lands conveyed by Phil W. Denton and Lulu Denton to A. C. and Flora B.
Levi by deed dated May 6 1959, and recorded in Deed Book 286 at page
402, Probate Records of Baldwin County, Ala; thence continue North 68
degrees 40 minutes west along the Denton north fence line 116 feet to an
iron stake; thence run southerly 93 feet, more or less, to an iron stake in
the south fence line of Denton property; Thence run south 73 degrees 30
minutes east along said south fence line of said Denton property 116 feet
to the SW corner of lands conveyed to A.C. and Flora B, Levi; thence run
north 30 minutes west 79 feet along the west line of said property conveyed
to A.C. and Flora B. Levi to the Point of Beginning.
Also:
A triangular parcel of land 10 feet in width at the northern end thereof and 93 feet in depth,
more or less, adjacent to and on the western side of that certain property in the City of
Fairhope, AL in fractional section 19, Township 6 south, Range 2 east, lying southwesterdly
from the intersection of Laurel Street and Pomelo Ave in the Magnolia Beach Addition to the
Town of Fairhope, which was conveyed by deed date 28 April 1962, recorded in Deed Book
317, page 405, Probate Records Baldwin County, AL, more particularly described as
follows:
Commence and the NW corner of the lot above described, heretofore conveyed as a point
of beginning: run thence North 68 degrees 40 minutes west 10 feet; run thence south 22
degrees 15 west (or nearly so) 92 feet, more or less, to the SW corner of said lot; run
thence north 28 degrees 30 minutes east 93 feet along the west line of property described
above to the point of beginning. Lot lies is fractional Section 19, Township 6 south, Range 2
east, in that certain parcel of land bearing the name ADenton@ and shown as lying south of
block 7 of said Magnolia Beach Addition to Fairhope, AL on the map thereof recorded in
Misc. Book 1, at pages 330-331, Probate Records Baldwin County, AL, and all lying within
the Boundaries of the Barron de Ferriet Grant Section 37, Township 6 South, Range 2 East,
Baldwin County, Alabama. Said lot containing 460 sq. feet.

A map of the property to be re -zoned is attached as "Exhibit A"
The classification of said property is hereby changed from R2-Medium Density
Single Family Residential District to B-3a Tourist Resort Lodging District. This
property shall hereafter be lawful to construct on such property any structures permitted by
Ordinance No. 557 and to use said premises for any use permitted or building sought to be
erected on said property shall be in compliance with the building laws of the City of Fairhope
and that any structure shall be approved by the Building Official of The City of Fairhope and
that any such structure be erected only in compliance with such laws, including the
requirements of Ordinance No. 557.
Severability Clause - If any part, section of subdivision of this ordinance shall be held
unconstitutional or in valid for any reason, such holding shall not be construed to invalidate
or impair the remainder of this ordinance, which shall continue in full force and
effect notwithstanding such holding.
Effective Date - This ordinance shall take effect immediately upon its due adoption and
publication as required by law.

their joint lives and upon the death of either of them, then to the

ourselves, and for our heirs, executors and administrators,
covenant with the said Grantees, their heirs and assigns, that we
