AN ORDINANCE TO PROVIDE FOR THE PUBLIC HEALTH, SAFETY, AND
WELFARE OF THE PEOPLE OF FAIRHOPE, ALABAMA, BY PROVIDING
FOR AMENDMENT OF THE MANNER IN WHICH FUNDS ARE DEPOSITED
AND DISBURSED FOR RECREATION PURPOSES IN THE CITY:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FIARHOPE,
ALABAMA, as follows:
Section 1. From and after the effective date of this ordinance, all funds derived
from whatever source which were previously deposited to a
recreation fund shall hereafter be deposited to the general fund of the
City of Fairhope, Alabama, and shall be under the exclusive authority
of the Fairhope City Council.
Section 2. The Recreation Department shall be budgeted and shall request funds
in the same manner as other departments within the City, upon
request of the Recreation Board.
Section 3. All sums remaining in the existing recreation account shall be
transferred to the City's Capital Improvements Account.
Section 4. From and after the effective date of this ordinance, the Fairhope
Recreation Board shall hold no separate bank accounts and shall have
no authority to disburse funds.
Section 5. Each phase, sentence, paragraph or section of this ordinance is
severable from all other such phrases, sentences, paragraphs or
sections. Should any such part of this ordinance be declared
unconstitutional or invalid by the courts, such declaration shall not
affect any other part or portion of this ordinance.
Section 6.
ATTEST:
This ordinance shall take effect FY- 2001-2002, and shall take effect
upon its due adoption and publication as provided by law.
