ORDINANCE NO._1133 AN ORDINANCE AMENDING ORDINANCE NO. 557 KNOWN AS THE ZONING ORDINANCE, AND TO AMEND ORDINANCE NO. 1079 TO AMEND THE PLANNED UNIT DEVELOPMENT KNOWN AS SOUTHLAND PLACE WHEREAS, Mr. Tripp Pittman and Kevin Boone are the property owners making the request, to amend the PUD of Southland Place. The property is located East of Greeno Road, South of Fairhope High School on the South Side of Manly Road; and, WHEREAS, At the time of PUD consideration the old ordinance was in effect. It required a blanket 40' setback around the perimeter boundary lines of the proposed development regardless of the types of uses. WHEREAS, The new PUD does not have such blanket requirements. It requires that the developer indicate the desired setbacks based on environmental considerations and good planning principles. WHEREAS, As Southland Place now sits there is a 40' rear setback requirement on the lots that are on the perimeter boundary of the development. Mr. Boone desires to alter this rear yard setback from 40' to 35'. Our R1 district (the one with the largest setbacks) requires a 35' rear yard setback — for comparison. To approve the rear yard setback modification from 40' to 35' for just the properties that abut the boundary of the perimeter development. WHEREAS, after appropriate public notice and hearing, the Planning and Zoning Commission of the City of Fairhope, Alabama, has forwarded a recommendation to the City Council for amendment of Ordinance No. 557 as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA: 1. That, in Case Number ZC 01.09 the property described in "Exhibit A', shall develop in substantial conformity with the attached site plan attached as "Exhibit B". Any substantial deviation from the attached site plan, as determined by the Director of Planning and Building will require re -approval by the Planning Commission and the City Council of the City of Fairhope, Alabama; 2. That, Attached as "Exhibit B" is an approved site plan that indicates setbacks for lots, landscaping requirements for lots, and other development regulations. 3. That, Attached as "Exhibit C" is a list of uses that will be permitted in the Planned Unit Development. 4. That, Maximum building heights measured from grade level to roof line shall not exceed 35 feet or two stories for all property within the district. 5. That, Side yard setbacks shall be 15 feet on the driveway side (if the drive accesses the rear yard) with a minimum 3 foot green area at the property line. All other yard setbacks are indicated in "Exhibit B". 6. That, all other structures or improvements to property within the district shall meet other City requirements unless otherwise specified in this Ordinance. 7. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph, or section.
