AN ORDINANCE AMENDING ORDINANCE NO. 577
KNOWN AS THE ZONING ORDINANCE
TO AMEND SECTION 5.4 BUSINESS DISTRICT REQUIREMENTS
WHEREAS, the City of Fairhope, Alabama has established in the Zoning
Ordinance Business Districts; and,
WHEREAS, the City of Fairhope, Alabama has a duly adopted Comprehensive
Plan that addresses how the City wishes to develop; and,
WHEREAS, the City of Fairhope, Alabama feels that the development of large
free standing single use or tenant retail buildings are contrary to desires of
community development established in our Comprehensive Plan;
NOW THEREFORE AFTER APPROPRIATE PUBLIC HEARING AND NOTICE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA:
1. THAT, in Zoning Case 01.07 Section 5.4 Business District Requirements
is hereby amended to insert the following:
a. Any free standing single use or tenant retail building shall have a
maximum foot print of 18,000 sq. ft.
b. Any free standing single use or tenant retail building with a footprint
larger than 8,000 sq. ft. shall only locate within the Greeno Rd. Village
Center as contemplated by our duly adopted Comprehensive Plan.
2. Severability Clause - If any part, section of subdivision of this
ordinance shall be held unconstitutional or in valid for any reason, such
holding shall not be construed to invalidate or impair the remainder of
this ordinance, which shall continue in full force and
effect notwithstanding such holding.
3. Effective Date - This ordinance shall take effect immediately upon its
due adoption and publication as required by law.

The Commission has field a public hearing on this matter prior to this final report and wishes
to report to the Fairhope City Council as follows:
We (Do) (Do Not) recomniend the proposed zoning text changes as wise,
expedient and necessary for the benefit of the City
We find that the proposed zoning district change (Is) (Is Not) in conformity
with the comprehensive plan and in the best interests of the City as a whole, and
(Do) (Do Not) Recommend that the City Council adopt an ordinance
implementing the proposed changes as provided by law.
