WHEREAS, ROBIN C. HERNDON, III and BRIAN P. METCALFE, the owners of
the hereinafter described property, did, in writing, petition the City of Fairhope, a
municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama,
1975, as amended; and
WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW,
THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property, lying contiguous to the corporate
limits of the City of Fairhope, Alabama; and not within the corporate limits or the
police jurisdiction of any other municipality; be and the same is hereby annexed to the
City of Fairhope, Alabama, to -wit:
Property is located at Scenic Highway 98, Fairhope, Alabama.
LEGAL DESCRIPTIONS:

Commence at the Southwest Corner of Fractional Section 19, Township 6 South, Range
2 East, St. Stephen's Meridian, for a Point of Beginning: thence run North 00 degrees
12 minutes 30 seconds West, 744.71 feet, more or less, to a point on the South Bank of
Sweet Water Branch; thence run South 87 degrees 22 minutes 30 seconds East, along
and following the meanders of said South Bank, 131.60 feet, more or less; thence run
South 51 degrees 12 minutes 18 seconds East, along said South Bank, 95.71 feet, more
or less; thence run South 35 degrees 32 minutes 24 seconds West, 335.19 feet, more or
less, to a point situated 10 feet East of the Section Line; thence run South 00 degrees 12
minutes 30 seconds East, 405.77 feet to a point on the South Line of said Fractional
Section 19; thence run South 88 degrees 50 minutes 33 seconds West, 10.00 feet to a
Point of Beginning, said tract contains 1.01 acres (44,000 Sq. Ft.), more or less, and lies
in Fractional Section 19, Township 6 South, Range 2 East, Baldwin County, Alabama.
The property conveyed hereby constitutes no part of Grantor's homestead nor that of
his spouse.
BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of
the Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin
County, Alabama.
This Ordinance shall take effect immediately upon its due adoption and publication as
required by law.

We, the undersigned PETITIONER/S, owner/s of the lands in fee simple described
in the attached EXHIBIT A, such property being without the Corporate Limits of
the City of Fairhope, Alabama, but being contiguous to the said Corporate Limits;
and such property not lying within the corporate limits or police jurisdiction
of any other municipality, do, by these presents, hereby petition the City of
Fairhope, a municipal corporation, that said property be annexed into the City
of Fairhope, Alabama.
The subject land is delineated on the map attached hereto as EXHIBIT B.
This petition is filed under authority of Section 11-42-21, Code of Alabama,
1975, as amended.
