HomeMy WebLinkAboutO-1091eCc Y -w m tD U Un VI ORDINANCE No. 1091 AN ORDINANCE AMENDING ORDINANCE NO. 557 KNOWN AS THE ZONING ORDINANCE TO AMEND THE CURB CUT REQUIREMENTS IN ACCORDANCE WITH APPLICABLE STATE REQUIREMENTS The ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975, is changed and altered as described below: WHEREAS, the City of Fairhope Planning Department desires to amend the Zoning Ordinance to provide greater public safety protection; and, WHEREAS, the proposed amendments relate to the Curb Cut requirement found in Section 70.311, and WHEREAS, after appropriate public notice and hearing, the Planning and Zoning Commission of the City of Fairhope, Alabama, has forwarded a recommendation to the City Council for amendment of Ordinance No. 557 as set forth herein; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA: 1. THAT, Section 70.311 Curb Cuts is amended to read as follows: No curb cut shall exceed 24 feet in width. Non -single family uses are limited to 1 curb cut for every 75 feet of lot frontage. The number and location of curb cuts for lots with more than 75 feet of frontage shall be at the discretion of the Director of Planning and Building with regard for public safety. 2. SEVERABILITY CLAUSE. If any part, section of subdivision of this ordinance shall be held unconstitutional or in valid for any reason, such holding shall not be construed to invalidate or impair the remainder of this ordinance, which shall continue in full force and effect notwithstanding such holding. 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon its due adoption and publication as required by law. APPROVED BY THE CITY COUNCIL THIS 10th DAY of July , 2000.
