HomeMy WebLinkAboutO-1074�Cr. w �D U NQ �U U aw a- c� 0 o� z .o w OH o ORDINANCE NUMBER 1074 AN ORDINANCE TO PROVIDE FOR THE HEALTH, SAFETY AND WELFARE OF THE RESIDENTS OF THE CITY OF FAIRHOPE. ALABAMA BY PROVIDING FOR CERTAIN IMPROVEMENTS IN THE CITY OF FAIRHOPE, ALABAMA, WHICH SHALL BE KNOWN AS THE 1999-2000 PUBLIC IMPROVEMENT ASSESSMENT PROJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as follows: Section 1. That the following areas of the City of Fairhope, Alabama shall be improved as hereinafter provided: Country Woods Drive in Country Woods Subdivision (Slides 1212-A, 1248-B & 1306- A, Probate Records of Baldwin County, Alabama and as further described in Act 99- 562, 1999 Acts of the Alabama Legislature) shall be improved by the installation thereon of 48-inch pre -cast manholes, 8-inch diameter PVC sanitary sewer mains with 4-inch PVC sewer laterals and required sewage lift station, force main and appurtenances to serve each individual lot within the said subdivision and to connect said lift station to the point of discharge at the Carya Point Station in Carya Point Estates at County Roads 13 and 30. Section 2. That the full details, drawings, plans, specifications, surveys and estimates of cost for the above described work, shall be prepared by Engineering Development Services, LLC of Fairhope (the Engineer) and shall, not later than 26 November 1999, be placed be file at the office of the Engineer, 23210 U.S. Highway 98, Building 1, Suite B-1, Fairhope, Alabama 36532, where property owners who may be affected by such improvements may see and examine the same. Section 3. That the improvements hereinabove described shall be made in accordance with the full details, drawings, plans, specifications and surveys of said work and cost estimates herein adopted and under the direct supervision of the Engineer. Section 4. That the total cost of constructing said improvements shall be prorated and assessed to all the lots in Country Woods Subdivision, equally; provided, however, that no assessment shall exceed the cost of the improvements or the increased value of such property by reason of the special benefits derived from such improvements. Section 5. That the Fairhope City Council (the Council) shall meet on the 13`h day of December 1999 at 5:30 p.m. (CDT) in the council chamber at 161 North Section Street in Fairhope, Alabama, to hear any objections, remonstrances or complaints that may be made against said improvements, the manner of making the same or the character of materials to be used therein. Section 6. This ordinance shall be published once a week for two consecutive weeks in the FAIRHOPE COURIER, a newspaper of general circulation in the City of Fairhope, the date of the first publication to be 27 November 1999, not less than two weeks before the 131h of December 1999. Section 7. A copy of this ordinance shall be sent by certified mail, postage prepaid, to the persons last assessed for ad valorem taxes on the property which may be assessed for said improvements, at the addresses most recently shown on the county revenue officer's records, said notices to be mailed by the City Clerk on 29 November 1999, not less than ten days prior to the 131h of December 1999.
